'I’he department J nf justice is this week distributing j a 12-page compilation of laws gov i erning the use of municipal fire I lighting equipment beyond the cor I porute limits of cities and towns. I h-• ! memorandum was prepared by j James E. Tucker, assistant attorney i general but was checked and ap proved bv the entire stall betore being mimeographed and distribut ed. Conclusions reached from careful tudy of statutes and supreme court opinions are that municipalities have full authority to provide fire pro tection within two mill's of eorpor ,tc limits and may contract to Im pish such protection within a twelve mile limit. After service lias been established, eithei under statute or by agreement, the same general laws ! apply outside and inside corporate j lines. Fire fighting equipment is exempt from usual speed limits, but suen | exemption does not relieve drivers j from responsibility lor public solely. Firemen have the same rights out side as within cities to enter upon I property, either to destroy property, I when necessary to combat fires. It is concluded also that municipal authorities have the same right to order firemen to go outside corpor ate limits on same basis as they are required to protect inside properly I and in such cases there is the same liability under workmen's compen sation acts for injury or death sus tained by firemen in line of duty. It is further held that fire com panies enjoy the same immunity Irom liability in tort for persona injury or damage to property wluit fighting fires within the two milt statutory limit or the twelve milt limit under contract Individual fire men, however, arc not immune Iron prosecution for injuries or damagt resulting Irom their own careless ness.
