Crane, counsel for the house in the im- peachment charges brought against Governor Ferguson by Speaker Frank FulJer, sprang a surprise today when he asked the governor to take the witness stand flrit. This Governor Ferguson refused to d;o, c'airoing his constitutional right to hear the evidence. McGinnis announced this afternoon that the men arrest ed on the charge of resisting the draft in connection with the Oklaho ma uprising will be tried for treas on and that the death penalty will be asked by the governor. District Attorney McGinnis said United States marshals were searching out the al leged traitors. COMMUTED TODAY By the Associated Press. Raleigh, Aug. 6. The three years' sentence of Dr. J. W,. Summers of Charlotte, convicted of manslaughter in August, 1916, after a sensational trial on the charge of malpractice in causing the death of a young woman of Greensboro was commuted to a fine of $1,000 today on the condition that he do no practicing for three years.
