C. II. II. C. ; and, Whereas, we believe that etich ac ticn upon the part of said Federal judge is arbitrary, wrong, oppress ive, and without warrant of law ; and is an attempt to choke and thuzzlo the lrecJutn of the press and prevent the proper criticism of the eoiiduct of our courts and public oihecrs, who are nothing more than public servants. Therefore be it resolved by the Democrats of Surry county, in con vention assembled : 1. That we condemn and de nounce any Federal interference whatever in the management of any and all property belonging to the State of North Carolina. 2. That we are unalterably op posed to any attempt by any power, to cheek or restiain the freedom of the press. 3. That we are bitterly opposed to government by injunction, govern ment by contempt, or government bv any other method than that con temp'ated by the founders of this republic. 4. That we heartily commend Editor Daniels for the courageous and manly light which be has made and is still making in behalf of the people of Is'orth Carolina, and we pledge Lim our full sympathy and support. Fritchard yester day afternoon at half-past four o'clock released Editor Joeepbus Daniels, of the News and Observer, from the unlawful custody in which Lo was held by order of Judge Thomas li. I'urnell for three days and a little over three hours. The court was compelled to sup press the spontaneous outburst of approval that wis the beginning of a great demonstration by the tre mendous crowd that deneelv backed every inch ot space in the court room1 Then Mr. DauielH was swamped try friends who rushed forward to shake Lim by the hand and congratulate Lira upon the successful issue of bis brave and loyal etand for the people and the h!erty of the press. Judge Fritchard anked whether Jujge Furnoll s order granting Mr, Daniels the right of appeal had been issued berore or after his own order to Marshal Dockery to produce the body in court betore him. When informed that Judge Fornell'a order bad come after his own, be pro ceeded to bear the matter on the writ of babels corpus, thereby rendering entirely void and invalid the last orJi-r of Jndge Furnell. jNews and Observer, Juue 4th. Peebles Case Settled. The trouble between Judge Fvublot aud the Lutnberton lawyers has boti awicab'y adjusted. Walker held a long conference Fri day alternoon with the attorneys for Judjjo 1 ecblis and with the bum bcrton bar and Its attorneys. Judgo Peebles was cogniztnt of what was going on, but was not present. The answer of the rospondeuti to the rule waa so amended aa to purge them of any contempt, and an order waa thereupon signed by Judge Feebles and all tho attorneys for both sides discharging the rule. A further ordef was made by Judgo Feebles allowing all persons who had made aflldavits in the cause to withdraw them and directing the clerk of Robeson county to erase from bis docket all entries in regard to tho caso. No costs were taxed against anybody. Sam Jones on Dispensary. A Methodist minister sends to tho Morning Fost, with a n quest to publish, tho following item clipped from tho Epworth Era : "iwev. bum 1 . Jones hns bcon in South Carolina investigating tho dispensary system. His judgment is that it fails in every one of the particulars in winch it was believed that it would be an improvement over tho saloon. It is a worso ontangleinent of the lienor question with politics : it is a greater, and therefore more dangerout, source of revenue than license ; it docs not diuiiuiah, but probably increases the amount of liquor consumed." It is far from this paper to feel bound to endorse any expression of opinion from Uev. Sum Jones ; but in copying tho foregoing extract it is impelled to say that many good peo ple of lUleigh, who are sincere tem perance men, have soiious doubtsof tho value of the dispensary as a means of promoting sobriety. It is well within the limits of truth to say that many who gave their votes in favor of the dispensary did to with grave misgivings. It is no secret that some who wore strongly antag onistic to the saloon regarded the dispensary as a doubtful compromise hut they voted for it as a choice be tween two evils as they understood it. Six months after the opening of tho dispensary is too soon to de nounce the experiment as a failure, but it ia interesting to take note of the fact that the public is not satis fied that it is an unmixed blessing. We started out with the idea that only the best men in the community should be entrusted with the control and management, but it wai not long before one who was employed in the dispeiiE:ry resigned under pressure of appeals to his c mecience as a Christian man. About the same time strong ground was taken open ly in one of our city churches against its members having anything to do with t tie difpensary. If this view ot tho matter should be taken general ly in the community it would place those who were originally the sup porters of the dispensary in an atti tude of opposition to it, and tho u&l ural consequence would be to leave it friendless in its infancy. From an observation of the re enlts of the difptneary In Kaleigh it cannot be aflirmed that it is an entanglement with politics or that it has increased the consumption of liquor. It may be asserted positive ly, however, that the experiment bus not been altogether satisfactory to its friends, that those who op posed it have not been converted and that some ot its original sup porters have shown an unexpected coolness toward it; but after all it remains to be said that the iucreaeed revenue to the city is regarded as a tavoraole argument, while the early closing feature is considered a re deeming feature. lUleigh Fost. Nothing ia known in government circlot here to night regarding the rumored capture of General Kuroki, the otliciaU at the war oflice having re ceived no news from the front since the annoucement this afternoon of the fight at Baimats za. It ii point ed out that nswi of such great im portance would not be held back a moment if it had been received. Tokio, Jane 5. The commander of the Japanese forces south of the I ala river telegraphed from booul to day nows of a series ot fights north of Fa Lan Tien, about forty miles north of Fort Adams, Liao lung peninenla Monday, received from Japanese cavalry scouting in tho vicinity ol Chun Chia Tung. It was learned that Cossacks had bcon lo cated at Telissu and the Japanese thereupon dispatehod infantry and cavalry, which dofeated and pur sued them. The Russian force con sisted of three eqaadrons. At Chang-Chia-Tun this force was joined by two additional squadrons and the Japanese again attacked and do feated the Russians. Five com panies of infantry and a battery of horse artillery joined the Russians' at Lung-Wang-Miao, where the Japanese attacked for the third time and the Russians fell back to Teliseup, where the Japanese and Russian cavalry coutinued in con tact Monday night. Mukdon, June 4. The situation in the war zone is not altered, and no news has been received here from Fort Arthur. The Russian successes in north eastern Korea are said to be causing great disquietude among the Japan ese. Seoul, June 4. The commission or of customs of Gen San, Korea, wires that a Russian attack on that place is deemed imminent. lie is making preparations to send the wo men and children to a mountain monastery, twenty miles distant. A junk has reported that the Russians have landed h'old pieces at Sha river, near Ilam-IIeung, north of Gen San on Rrougton bay, or the gulf of Korea, at which place Cossack rein forcements are expected. Faria, Jano 5. The St. Peters burg correspondent of the "Matin" says be learns from a trustworthy source that the advance guard of 14,000 men under General Stalken borg, sent by General Kuropatkiu to the relief of Fort Arthur has al ready reached the entrance to the Liao Tung peninsula, and that the bulk ot the army is following. The correspondent of the "Matin" at New Chwang confirms this, stat ing that important movements of Russian troops are proceeding to the southward of Tacbichao towards Kaiping. Tragic Death of a Murderer. A special to the Chicago News from v ictoria, li. (J., says : "If the voluntary declaration of a dying man is to be believed, finish has been written to the historic Snell tragedy of fifteen years ago and Tascott, the long sought murder er, self identified has paid the penalty of his crime with penitence and now tills an unmarked grave in the heart of the Alaskan wilder- I . 1 i t 1 t ness, wimner ne una ned lor the effacement of his individuality 'Philip Robertson, a strictly reli able man prospector and miner, re ceived the dying man's confession, and tells the story simply and dramatically. Robertson left the Klondike capital, be says, late last fall in a small boat bound for the new placer grouuds at Fairbanks He reached a point near Dahl River in a particularly desolate and for bidding region when the forlorn wailing of a dog surprised his ears He found the dog, a half starved shepherd, seemingly in much dis tress. Following this animal, Kobertson waa brought to a seem ingly deserted cabin some four hun dred yards above the river, con ceaied in a clump of spruce. A Fortune For Him. Inventive genius is what makes the mare go and the man who is up in this line, if possessed of a level head otherwise, has a fortune at his fingers end. Undergoing a thorough test at the Acme Mill Works in this place, is a new machine lor making ice, the in vention of S. S. Miles, of this place. So far the test is perfect, and while this one is a small affair, otben of proper size will soon be erected, Some of the advantages claimed tor the new macbino are that the old machine use from 200 to 220 pounds pressure all the time, while the new machine can fseeze at a pressure of 45 pounds. The prea sure in pounds never exceeds the temperature of the water ; for cool ing, the gas condenses at 45 pounds preii6ure using well water for cool ing. The machine runs cold with out the help of a water jcket and readily reduces brioe to a zero tern peiature. It is also stated that ice can be made more cheaply than the old way. The machine can run for half a day with no attention, other than putting in more water and tak ing out the ice. No ammonia is need in the process. Mr. Miles has been a resident of the city for abont twelve months, having come here from Cincinnati, Ohio. He has made a study of refrigeration for twenty years. All persona are in vited to call at the Acme Mill Works and see the machine in op ertion, aa being run by Messrs. Miles and L. M. Clymer. Seven vats of water containing enough for 35 pounds of ice may be seen in the process of freezing. Greensboro Record.
