Aa to the claim of the Piedmont and Northern that it has been the intention of the company for many yvra to extend its lines to Winston Salem, the brief says; "It is very true that the Piedmont Syndicate declared the intention of the company to acquire by purchase or construction a system or number •f connecting or separate lines of railway in several named counties in North and South Carolina Including Forsyth county, but the applicant fails to mention that the etM me ra tion of the counties in North Carolina is followed bjr the words, or some of them. TV contention, therefore, that the Syndicate agreement shows an intention on the part of the pro moters to build a Hne into Forsyth county is uat—able."
