In lieu of any other charges, the said Com pany shall have a right to charge a minimum of fifty cents. (50c) per month per meter. No minimum charge shall be made when written notice of discontinuance is given. The price of gas cannot be raised without the i consent of tho Cilv Council. Sec. 13. That the Said Southern Gas Improvement Company shall and will pay to the said Citv of Kinston a special privilege taxof two per cent, per annum of the gross income of said plant in said Citv after the gross sales of gas amount to ten thousand dollars ($10,000) per annum. During the contini,nn. of this franchise the said Southern Gas Improvement Company, its suc cessors and assigns 6hall supply gas of good quality of not less than 18 candle power, daily, average, or equal to the supply of any other city of. equal size, in. the State of North Carolina and the Citv Connnil eimii have the right at all "reasnnw. times to subject the same to a pro per test for purity and candle m. and for this purpose may makrf d of the appliances of the said South- ern Uas Improvement ComDanv. it . successors and assigns that may ba ' within the said City, or any other appliances desired to be used hv tha City Council. In the event of tha failure of the said Southern On Improvement Company, its succes sors and assigns to furnish gas as above stipulated there shall be a. r. duction in the price charged for gas ' corresponding to the value of the gas, so furnished for 'a Deriod of three months, affer which time if the said Southern Gas Imnrovement Company, its successors and assigns' -fail to restore the quality of the gas to the standard above specified, this franchise shall become null and void at the option of the Citv Coun cil. Sec. 17. Any consumer of eras shall have the right at anv time to demand the testing of the gas meter of said, consumer .by the said South ern Gas Improvement Company, its successors and assigns, provided a deposit of one dollar is made by such consumer with the Southern Gas Improvement Company, its suc cessors an4 assigns. If when such gas meter is tested it shall be found to be not running to exceed four per centum fast the . said one dollar so deposited shall be long to the said Southern Gas Im provement Company, its successors and assigns if however, the said meter when so tested shall be found to be running to exceed four per centum fast and incorrectfy meas uring the gas consumed the said one dollar shall be returned to the con sumer depositing the same and re bate of six months paid to the con sumer in "accordance with the ex cess charged over four per centum. Sec. 18. That the said City of Kinston shall have the right to purchase the entire gas plant main conductors and conduits in the ex piration of thirty (30) years, price of purchase to be determined by three men, one to be appointed by the City, one by the Southern Gas Improvement Company, and these appointees to choose a third. Sec. 19.
