This discretionary liht is necessary to the existence and well being of every community. Tiie first Legislature convened under tho present' Con stitution, as well aa every subsequent ou, have given to this provision h practical construction, l'bey have conddered this section as dirtetory, and the Courts and the people have acquiesced n tbe construction aud I have no desire to un settle their decision. It is maintained however that previous Legislatures have been direlict in their duty in this respect and hence the ques tion is asked how can wo escape the obligations of pnr oaths, as oentitors, as representatives, as voters. For a'l these are recjuired to take an oath to support the Constitution. I apprehend that the oaths to support the Constitution has uo practical bearing whatever on this subject and I have reason to suspect that those who urged in argument that the obligation to levy the tax Wfts-imperative used it rather as a party slogan in the recent canvass to frighten tax- j payers, than otherwise. It is an oath of allegiance; of loyal ity; of adherence to the government It is true it also enjoins the performance of duty as re quired by that instrument, but it i.- a political duty and it should ahvpys be exercised iu ac cordance with reason aud natural justice and the dictates of honor, gratitude and charitv. It is aumed, Mr. President, that our oblia tion to pay, existed long before tho adoption of the Constitution and Article o, Section 4, of that instrument ha- by no means given it a'ddi tioirtd foiee or sanction. That much abused sec tion, in my opinion, is a very harmless piece of phraseology, and hhould never' be ued again to intimidate tax-payers. As legislators, wo can not be bound by any narrow or technical rule, for the general gooa of the people is a consider ation which enters into every question of taxa tion and is involved in the maintenance of good government. This consideration must neces sarily underlie every written Constitution a a principle of natural justice and equity, other wise government simply becomes a means whereby to accomplish its tinal destruction. Every Stats is bound to pursue that system of measures that is bft?3t adapted to the interests of 1 its people. There are certain expenditures ! which are absolutely necessary to the continued ttxisttuec of the government and there are para mount obligations that niUit be first discharged.
