and his wife, M. E. Bailey, executed
aud delivered to the underagned D. E.
Hudgins, Trustee, a certain deed of trust
conveying the lands therein and herein
after described as security for indebted
ness therein described due W. A. Con
ley, which said indebtedness was made
payable on the 1st day of March, 1913;
and whereas, powar of sale of the lands
was given to the said Trustee in the
event of default in payment of the in
debtedness at maturity, upon request of
the said W. A. Conley, or his represen
tatives; and whereas, default has been
made in the payment of said indebted
ness, and request has been made by the
Administrators of W. A. Conley, now
deceased, for foreclosure of the power
of sale:
Now, the undersigned Trustee will on
the 21st day of February, 1916, Monday,
at and between the hours of 13 o’clock,
m. and 2 o’clock p, m. ofiEer for sale to
the highest bidder for cash, at the court
house door in Marion, McDowell coun
ty, N. C., for the purpose of satisfying
said indebtedness, the following de
scribed lands, to-wit:
A certain tract or parcel of land, situ
ate in McDowell County, Finley’s town-
sMp, (now Nebo township). North Caro
lina: Beginning on the south side of
the Catawba river on a locust tree on
the river bank below the mouth of a
small branch and runs west 26 poles to
a lorge branch, crossing the same course
86 poles-to a red oak; then north 10 poles
to a black oak; thence north 43 west 104
poles to a forked chestnut on a ridge;
thence west 32 poles to a black oak; then
north 32 poles to a sourwood on the
river bank; then down the river north
80 east 140 poles to a wild cherry, in the
bend of the river; then down the river
to the beginning, known as the Morrel
tract, and being more fully described in
said deed of trust to D. E. Hudgins,
Trustee, which appears of record in
Book No. 14 at page 418 of McDowell
County Mortgage Deed Records.

Whereas, by virtue of the power and
authority contained in chapter two hun
dred and ninety one, section twenty-one,
of the Private Laws of 1909, as amend
ed by chapter one hundred and twenty-
one of the Private Laws of 1915, the
Board ot Aldermen of the to^n of Ma
rion enacted an ordinance requiring Mrs.
M. M. Morris and husband, James Mor
ris, to construct a concrete sidewalk
abutting their property on Garden street
in said town, and issued due notice there
of to the said Mrs. M. M. Morris and
husband; and whereas, said parties fail
ed to construct the said sidewalk with
in the time prescribed by the said Board
of Aldermen; and whereas, the said
Board of Aldermen caused said sidewalk
to be constructed and made at a cost of
$29.76, one-half of which said cost is due
and payable by the said Mrs. M. M.
Morris and husband, James Morris; and
whereas, the Secretary of-the Board of
Aldermen of said town has certified the
said amount to the undersigned tax
collector, with instructions to collect
the same as other taxes due the said
town; and whereas, the said amount of
$14.88 has not been paid upon demand
Now, therefore, to satisfy the said
amount together with costs of sale, the
undersigned tax-collector will expose to
public sale to the highest bidder -for
cash at the court-house door in Marion
North Carolina, on Monday, the 7th
day of February, 1916, at 11 o’clock a
m., the following described real proper
ty, to-wit: All of that lot abutting Gar
den street on the east side, bounded on
the north by Spring street, on the east
by Haryey James, and on the south by
J. W. Streetman, and being the lot on
which the said Mrs, M. M. Morris and
husband, James Morris, now reside.

certain mortgage deed contained, which
was executed on the 31st day of Janu
ary, 1911, by Waits Brown, to secure
the payment of a certain sum of money

in Block No. 18; containing 6250 square

State Making Smallpox Vaccine.
The State Laboratory of Hygiene
is DOW manufacturiog smalldox
vaccine, the output being consid
ered sufficient to supply all de
mands in the State. Dr. C. A.
Shore, the director, has written ta
the health authorities in every
county advising them that this
vaccine is available and seeking to
ftscertain the extent and location of
smallpox infection. The plan is
to issue the vaccine to the - county
authorities and let the physicians
and others desiring the vaccine ap
ply to the county health office.
The only other vaccine now made
in the laboratory is that for ty
phoid fever, for which there was
an especially large demand last
season. The laboratory has, how
ever, reduced the cost of anti
toxin for diptheria to fully one-
fourth of its former cost to citi
zens of the State, this reduction
being attained through special con
tracts with manufacturers, who
obligated to supply the anti-toxin
in large quantities to be distribut
ed through the director of the
laboratory.

President Wilson is considering

Col. John S. Cunningham, tobacco
crop forecaster for North Carolina, in
an interview recently, stated that to
bacco wilt in Durham and Granville
counties is causing farmers deep con
cern. The wilt, according to the colo
nel, comes from lack of crop rota
tion, long cultivation of soil with fer-
tlHzer.
Horse meat has been declared a
legitimate food in Durham by the city
meat Inspector.
In an attempt to thaw out the
frozen water pipes under her home
Mrs. H. B. Hyde of High Point, came
near losing her home.
The House Appropriations Com
mittee, which completed work on the
urgent deficiency appropriation rec
ommended by Secretary McAdoo,
provided for continuance of work on
four postoiflce buildings in North
Carolina as follows: Burlington,
$130,000; Chapel Hill, $500; Shelby,
$24,000; Waynegville, $3,000.
