Raleifch, Dec. 14.—Eij^bt ap peals were decided by the Supreme court in its weekly delivery of opinioDS. Especiall.y notable was State vs. Eds:ar Frady, which came up from Buncombe, the con viction and sentence in the lower court beinfi: affirmed by the Sup- rene court. I'his is the noted blackmail case in which Frady and two accomplices, Martin Bickman and Mj/rtle Pressley were accused of sending letters to D. P. Lance, a merchant of Arden in effort to frij^hten him into paying lar^^e sums of money. In the trial be low the girl was acquitted and the jury could not agree as to Rick- in. They convicted Frady and he was sentenced to two years on the ^roads. This conviction and sentence is affirmed, the court holding that there was no merit in any of the grounds of appeal. Other appeals decided in the batch of opinions delivered this afternoon follows: Barber vs. Berry, Guilford, re manded; Bailey vs. Long, Burke, reversed; Tyler vs. Hayes, Avery, affirmed; Bank vs. Loven, Avery, affirmed ;lBailey vs. Bailey, Mc Dowell, reversed; Ingram vs. Johnson, Burke, affirmed; Bell- Thrash Co., v s. McCormick, Burke, no error. Unjon County Receives the Demo cratic Flag. Raleigh, N. C.,Dec. 15.—Union county is to receive the splendid silken state flag from the state democratic executive committee as the banner democratic county of the state in having made the largest gains in the November election over the state vote for 1912. Union’s per cent gain was 59.97 per cent. Buncombe gained 15.79 per cent. There were eighty-seven coun ties that showed democratic gains as figured out by Democratic State Chairman Warren. Thirteen counties showed losses in democrat ic vote. The net gain in the demo cratic vote in the state was 11.86 per cent under the announced plan of the award. Verdict Against M’Coy. Jacksonville, Fla., Dec. 15.— Thomas C. McCoy, of Asheville, N. C., was convicted by a jury in federal District court here today of conspiracy to defraud the gov ernment out of revenue tax on whiskey distilled, at the Long* branch distillery here. The case was completed late today and the jury was out an hour and ten min utes before returning a verdict, McCoy’s attorneys informally gave notice of a new trial. It was announced that sentence will not be pa^ed on McCoy until after the prospective motion for a new trial has been heard. The maximum penalty is four years in penitentiary or a fine of $20,000. Bailey Turns Down Appointment to Bench. RaleigbflDec. 14.—J. W. Bail ey, ColI(5Ctor of Internal Revenue, declined to accept the appoint ment to the Superior Court judge ship for the Seventh District ten dered him yesterday by Governor Craig to succeed Judge Charles M. Cooke, resigned. He wrote the Governor this evening that his private business is just now in such a condition as would not ad mit of h;is continued absence from Raleigh such as service on the bench would exact. He expressed deep appreciation for the tender of the apoointment. ^ Governor Craig will leave the mat^r of further appointment open for a few dayr and says he has no one all in mind at this time.
