£1 — - Varied Docket In County Court The docket of County Court in ses sion here Tuesday was composed oJ ■varied charges. J. S. Lockaby, of Morganton, was given a preliminary hearing on ar embezzlement charge, probabh cause found and defendant wa^ bound over to the January term o: McDowell County Superior Court Bond was set at $1,000. Mrs. R. G. Padgett plead guilty tc a bad check offense and was sen tenced to six months in jail and as signed to work by the Woman's Division of the State Highway anc Public Works Commission, sentence suspended and defendant placed or probation for two years. Ralph Jamison, possession, was sentenced to eight months on the roads. Defendant appealed and bond ■was set at $750. A judgment of non-suit was ren dered in the case of F. Z. Kuyken dall, speeding and reckless driving. William Moody, reckless driving, was sentenced to 60 days on the roads, suspended on payment of $25 and costs. Joe Williams plead guilty to pos session of illegal whiskey and was sentenced to six months on the roads, suspended on payment of $100 and costs and on condition that defendant not violate the prohibition laws of North Carolina for two years. Edith Cooper, possessing and transporting, was sentenced to six months in jail and assigned to wort by the Woman's Division of the State Highway and Public Works Com mission, sentence suspended on con dition that defendant not violate the ! prohibition laws of North Carolina for two years. Jimmy Elliott plead guilty to car ! rying a concealed weapon and was sentenced to three months on the roads, suspended on payment of a fine of $50 and costs. It was further , ordered that the pistol taken from . the defendant be confiscated and . destroyed by the Sheriff as provided ( by law. Clerman Suttles, possession and transportation, w as sentenced to eight months on the roads. Defend ant appealed and bond was set at $750. Police Raid Williams Premises Joseph Williams was arrested by Marion police this week on charges of unlawful possession, transporta tion and having whiskey for the pur pose of sale, and was released under $300 bond, Chief of Police D. W. Smith said. I Smith said the arrest was made by J. E. Roland and W. H. Wood who informed him they found eight gal lons of white liquor on the premises of his residence on Oak street. Webb, 81, of Marion, who died in C^mp Butner hospital Thursday after a long illness, were held at East Marion Methodist church Sat urday afternoon at 2 o'clock. Rev. T. G. Smith officiated and burial was in Oak Grove cemetery. Surviving are the widow, Mrs. Lillie Webb; four sons and three daughters, Fred D., Clarence and Glenn Webb and Mrs. Lester R. Barbary of Marion, Jasper E. Webb of Bridegwater, Mrs. Alex Cuthbert son of McCormick, S. C., and Mrs. Bessie Flack of East Marion; three brothers and three sisters, Cling Webb of Cross Mill, Luthem and James Webb, Mrs. William Banks, Mrs. William Hall and Mrs. James Pegg, all of Barnardsville. Rutherford Plans Injunction Snub In Beer-Wine Vote i Rutherfordton, Jan. 10—Election ; officials said today they would go ahead with the beer-wine referen dum scheduled in Rutherford Ruther ford county February 5 despite an injunction obtained by beer deal : ers. ! R. E. Price, chairman of the elec tion board, said the restraining or der obtained from Judge Dan K. Moore of Sylva, does not specifiy the board must halt planning for the special vote. Price is also chairman of the Allied Church League in Ruth erford county. The order, directed to the Ruther ford County Board of Elections, re quires the board to show cause be fore Judge Felix Alley in Marion January 19 as to why the election should be held. Pleasant Gardens Wins Doubleheader Pleasant Gardens girls and boys ^ met Glen Alpine in a doubleheader Friday night at the Pleasant Gard ens gymnasium. The girls defeated the Glen Alpine girls with a score of 16 to 5. Points for Pleasant Gardens: Wheeler 6, Heers 5, and Staton 5. For Glen Alpine, Carswell 5. The Pleasant Gardens boys won 27 to 13.
