THE SUN, THURSDAYMOR NING,' SEPTEMBER 21, 1922 r - 'X EARLY HISTORY OF RUTHERFORDTON Act Passed In 1787 To Build County Seat Names Of Early Settlers And Builders Court Four Times A Year After the abolishment of Tryon county in 1779, Sampson Lambkin, Benjamin Hardin, John Walker and John Gullet were appointed by the General Assembly to run the divid ing line between Rutherford and Lincoln. At the same time it was enacted that "The courts of Ruther iord be held constantly on the fourth Mondays in April, July, October and January of each and every year and the first court for the county of Hutherford be held at the residence of Col. John Walker." This act also provided that the following commit tee be selected to select a site for the courthouse and lay out a county seat; Benjamin Hardin, Thomas Welch, Abraham Kurkenendol, John Earles, and John Potts. At this time there were two "towns" or set tlements in Rutherford. These were Rutherfordton and Gilberttown. The entire population of Rutherford county (that of the present bounds,) probably did not exceed two or three hundred. The town of Gilberttown got its name from the fact that the Gilberts, one of the leading families of the day, all lived near together. There were two or three families of then.. The first committee selected to lay out a county seat failed to function and at the next General Assembly it was enacted that "John Earle, Robert Porter, William Wlhite ides, James Miller, and Andrew Hampton were appointed to lay out a place for a courthouse, prison and prison stocks and that fifty acres of land be bought from James Holland in the forks of Shepherd's (Gilbert town) for that purpose." For some reason this committee also failed to fulfill its duties, and no other com mittee was selected until about 1783. At that time the following act was introduced: "An act to amend an an act for dividing Tryon county and for other purposes. Be it therefore enacted by the General -Assembly of the state of North Carolina; That Felix Walker, James Wttiitesides, William Nevel, and Wil liam McMurry, be and are hereby appointed commissioners for survey ing the said county, and are investr ed with full power and authority to purchase fifty acres of land as near the center of the same as practicable for the purpose of building a court house, prison and prison stocks" (N. C. Colonial Records, Vol. XXIV, Pp 645-46.) This committee begun its work but could not carry out its plans to completion on account of no funds and part of the commission ers moving away, or failing to assist in the work, and in 1785 this act was passed : "An act appointing Commissioners in the county of Rutherford for building a court house, prison stocks and prison, in said county, and for levying a tax for the defraying the expense of the same. I Be it enacted by the General Assembly of the state of North Carolina and by the authority of the same; That Felix Walker, William Nevil, James Whitesdies, Alexander McDonald and William M'Murry or a majority of them be and are here by appointed commissioners wrho are hereby authorized and empowered to contract and agree with any per son or persons for building and finishing the courthouse, prison and prison stocks in the aforesaid coun ty, on the fifty acres of land already procured for that purpose by com missioners appointed by the act of the Assembly entitled, an act to a mend the act. Intitled an act to build a courthouse in Rutherford county, and for other purposes. II And be it further enacted by the authority of the same that a tax of four pence (8 cents) be levied on every, one hundred acres of land and a tax of one shilling (23 cents) on every poll and a tax of one shilling on every hundred pounds ($486.00) value of town property in said coun ty, to be collected for the years one thousand seven hundred and eighty six and one thousand seven hundred an eighty-seven, and accounted for as all other taxes are in a like na ture." (Passed Dec. 27, 1785.) 'No record exists as to what this commission did, but the following act was passed two years later. "Be it enacted by the General Assembly of the State of North Carolina, etc., That Felix Walker, William Nevil, James Miller, James Wfiitesides and Thomas Rowland or a majority of them be, and are hereby appointed commissioners, to lay off and erect a town in Rutherford county on the land already procured for erecting thereon the public buildings of said county and are hereby authorized and empowered to lay out aforesaid fifty acres of land into half acre lots with proper streets and alleys. And be it further enacted: That when the town is so laid off the commissioners or a majority of them shall reserve two of the said lots, which to them shall appear most convenient, for the purpose of erecting the public buildings thereon; and the remaining lots shall be sold by the said commis sioners or a majority of them for the purpose of raising money for the completing the aforesaid buildings and the aforesaid commissioners or a majority of them are h reby au thorized to make good sufficient titles in fee simple to respective purchasers of said lots. And be it further enacted : That if any of the commissioners ap pointed should refuse to act, die or remove away from the county the surviving commissioners shall be and are hereby empowered to elect a nother in the room of him or them, refusing, dying or moving away." (passed Dec. 22, 1787. N. C. Colon ial Records, Vol. XXIV. pp 934-35). It appears that this committee went to work in earnest, at first. There were never any more com mittee established Gilbertown or Gilberttown as the county seat. The ! first courthouse built there was com pleted in 1802 and was construct ed of logs. Gilberttown was the county seat until 1834, when it was J removed to Rutherfordton. CLARENCE GRIFFIN, Spindale, N. C. Immersed At 105 Years Mrs. Susan Pruett, widow of the late David Pruett of Casar, was im mersed, or baptized recently in Cleveland county. The ordinance of baptism was administered by Rev. J. F. Weathers, who built a large water-tight vat which was mounted on a truck and was filled with warm water. Six men carried her on a sheet from her sick bed and lowered her into the water. More than 1000 people saw the unusual ceremony. Contracts for all amusements have been closed with T. A. Walfe's Sup erior Shows, which carry with them 16 tented shcvs and six riding de vices. In addition there will be five high grade free attractions, most of which contain several acts that will be given both day and night in front of the grand stand. C, the following describ ed lands, the same being lots No. 18 land No. 19 of the sub-division of the lands of J. W. Hampton as shown on map or plat of said lands made by W. N. Ellis and recorded in Book 112 at page 600 in office of Register of Deeds for Rutherford county, re ference being hereby made to said map or plat for a full and complete description of said property. NOTICE OF PROPOSED CHANGE OF SITE OF COUNTY JAIL Notice is hereby given that at a regular meeting of the Board of Commissioners of Rutherford coun ty held at the Court House, in Ruth erfordton, N. C, on Monday, the 4th. day of September, 1922, the follow ing order was unanimously passed and adopted by said board, to-wit: Upon motion it was ordered that a new County Jail be built and that the site of County Jail be changed from the present site of County Jail to either (1) the lot known as the Couch lot on north-western corner of Washington street and Third streets or (2) the western side of the present Court House lot, either of which sites are less than one mile distant from the present site of the County Jail; and it is ordered that a notice of this proposed change in the site of the County Jail be published in THE SUN, a newspaper published in Rutherfordton, N. C, for three months immediately preceding the regular December meeting of this board to be held on the first Mon day in December, 1922; and it is further ordered that the clerk of this board procure a copy of said notice to be posted in one or more public places in every township in this three months: and it is further ordered that at said regular meeting of this board in December. 1922, this board will finally deter mine the selection of the site of said new County Jail, as provided for in Section 1297, subsection 10, of the Consolidated Statutes of North Carolina, at which time this board will hear any persons desiring to be heard upon the said question of location.
