2 Monday, March 13,1995 Student Supreme Court Upholds Reid’s CAA Victory BY STEVE MAGGI ASSISTANT UNIVERSITY EDITOR Anthony Reid’s narrow victory in the Carolina Athletic Association presidential runoff will stand after Wes Galbo’s case against Reid and the Elections Board was dismissed by the Student Supreme Court on March 3. Galbo said the dismissal deprived him of the chance to present his case. “I think we had a solid case. I was disappointed that it was dismissed,” he said. The court did not allow Mohr vs. Karras & Bracey, a case Galbo wanted to use as a precedent in his case, as admissible evi P.QQ j ycw ■ i other offers. m ■ Used merchandise. “ 2/21/95 W. An affidavit from former Chief Jus tice Malcolm Turner said the case had never been heard and therefore should not be allowed as evidence. Defense counsel Mark Griggs argued that Galbo’scase rested onMohr vs. Karras & Bracey as precedent and that, because that case had been ruled inadmissible as evidence, Galbo’s case should be dismissed. The hearing, which lasted until 1:30 a.m., was adjourned after all defendants and Galbo testified. The court announced its decision to dismiss the case Friday after noon. All five members of the Elections Board who testified at the hearing said Galbo And We Invite You to Play an Integral Role. Join our team to continue building a dynamic local and national presence. Traci Nickel Recruiting Associate 1-800-726-2368 UNIVERSITY had promised he would not appeal the runoff after the board spent four days attempting to contact write-in candidates. During the hearing, Galbo questioned the Elections Board’s efforts to legitimize votes. Reid said he was relieved by the deci sion. “I’m glad it’s over,” he said. Galbo said he was frustrated by the Elections Board’s handling of the situa tion. “1 am disgusted with the conduct of the Elections Board and with their lack of responsibility." Galbo said the Student Government Code needed to be changed. “This demon strates the need for clarity in the Student Government Code,” he said. Galbo said he would not appeal. “The whole thing is over,” he said. COME WATCH THE § NCAA TOURNAMENT *|f MARCH 16-APRIL 3!! In’ 25* ARMADILLO WINGS FOR ALL GAMES! Equis Reid said that among his first duties as CAA president would be selecting new Cabinet members and planning events for this spring. “We want to have programs in the spring semester,” he said. “We’re going to get CAA on the right track,” Reid said. Galbo said his hard feelings toward the Elections Board did not extend to Reid. “I have no hard feelings towards Anthony. I’m sure he will do a good job,” he said. Galbo received 14 more votes than Reid in ™the original CAA election Feb. 14. When Reid won the runoff Feb. 21 by a count of 1,883-1,869, Galbo decided to take his case to the Student Supreme Court, requesting that the original election results stand, and the results of the runoff be ignored. ■Rs" * ■ W.Jy&W HH-. They don’t want to do anything that would remotely connect them with this search.” Because of the N.C. Open Meetings Law, candidates cannot come before the search committee as a whole without sac rificing their anonymity, Harris said.
