The Building Committee of the new Union Depot met in Greensboro to day for the discussion of plans, etc. We may now look for an early start in the building line. No abatement in the Railroad War at Durham. Mr Christian, of the Dur ham, and Northern Road, is just from Durham this evening; says the excite ment is intense, atjd fears are enter tained of serious trouble. B P Dawson, deputy sheriff of Edgecombe county, on yesterday evening brought three convicts to the penitentiary, and this morning Sheriff W H Pulley of Person county, added three more to be number of board' ers of said institution. We can assure our worthy City Fathers, that there is an earnest de sire on the part of a very large ma jority of our people to have the mar ket house building painted. No bet ter time than now to put on a nice spring suit. The Railroad Investigating Com mittee met this moining, and after transacting some business looking to their next meeting adjourned to June 1 7th next. Mr C M Busbee was ap pointed to assist the Attorney Gen eral in mapping out and having all cases ready for next meeting. At the joint meeting of the Com inittees held yesterday, to arrange for the Chamber of Commerce Banquet, it was announced that l)r R H Lewis could not be present to respond to the toasf "OurEducationallnterest," and Mai E G Harrell was selected in his place. Another meeting of the committees will be held during the present week to perfect arrange ments. Prof Mclver, Teacher's Institute In structor, appointed by the Board of Education, who is spending some days in this city, visiting from his arduous labors for several mouths past, says the people are taking more interest in the subject of education than ever before that he thinks his next Teacher's Institute will be held at Wilson sometime during the first of May. The Professor is a hard work r and does most efficient work. Sad Cases. John R Upchurch reports that on yesterday morning he saw, down near tbe Harnett line, three of the most forlorn and destitute cases he had ever seen in this country. Three persons, two old ladies and one little girl about twelve ears old, on foot tramping through the country. The oldest one of the old ladies totally blind, the other one near sighted, could hardly see to walk; the little girl was on crutches. They claimed to be from Tenressee and originally from Illinois, and said they were trying to make their way back to said State. RAILROAD WAR. Exciting Times in Durham Be tween the R&D and D & X Kail Iiondg. The utmost excitement prevailed in our sister city, uurnain yesterday, owing to what may be termed a reg ular "Railroad War" between the friends of the Oxford and Clarksville road. (R & D) and the Durham and Northern Two attempts were made by the Richmond & Danville paity early in the morning to tear up tbe iron of the Durham it Northern. Both times the leaders were arrested, 1 hey were tried before his Honor, Mayor Chris tian. at-10 o'clock. He decided that they could not molest the track which was situated on P abody street, be cause the street belongs to the town and the town granted the right of way to the Durham & Northern. Tbe R&D authorities then repair ed to the point where thoD&Ntr-ick comes into P.. abody street. This point was promptly covered by box cars and flats by the D & N men. Since then the object of the R&D parties seems to be to connect with their opponent's line, and by running one of their engines over, remove the offending cars. They made false works, over which they intend to run thfir tracks. The town is very much excited, and great anxiety is evinced as to what will be the end of the fight. "Yesterday afternoon, the Chief of Police, of Durham, arrived in this city bringing with him Mr W L Mor ing, who was arrainged this morning before Judge ArmQeld on a writ of habeas corpus. It is stated that during most of the day, yesterday, all the police force of Durham were on duty at the scene of the disturbance, and people flocked thereby hundieds. The town au thorities having planted the post on Peabody street the police stationed themselves there to prevent the 0 & C force from proceeding farther. The men were ordered to remove the post and to proceed with laying the track aod t he first man to strike a lick was Uurin-' who was at once arrested. MB. MORING IISCHARGED ,1 ndge Arinfield, this morning de cided that there was nothing in the acts of Mr Mcring to justify the charge of , forcible trespass, and he was therefore discharged from custo dy and the town of Durham taxed with the costs. Itedu ed Rates. The Richmond and Danville Rail road Companv will sell parties at tending the Military Prize Drill at Raleigh, N C, round trip tickets to that point and return April 28th to May 2nd, inclusive, good returning until and including May 3rd, 1890, at the following rates from points nam ed: Charlotte, $ 6 55 Greensboro, 3 95 Winston-Salem, 4 85 Durham, 1 50 Goldsboro, 2 60 Rates from intermediate points in same proportion. Supreme Court. Argument of cases was continued this morning, and the following cases were argued: Roberts vs Allman,from Buncombe; rheo F Davidson, for plaintiff; Geo F Shuford for defendant. Billiard vs Oram, from Jackson, put to end of district, Owens vs Paxton, from Transylva nia, (motion for new trial) T F David son and Geo FShuford for defen dant. - Lenoir et als vs Mining Company from Cherokee; Geo F Shuford and T F Davidson for plaintiff; J W Cooper and E McCrady for defendant. Arrangements Perfected. A considerable number of ladies met last evening at tbe residence cf Mrs C S Allen on West Hargett street for the purpose of perfecting arrange ments for the concert and fair to be given by the Governors Guard, com mencing on the 29th in-1. Commit tees were appointed and the ladies are determined that nothing shall be left undone to rerder the occasion a complete success. Musical talent, of a high orJer will be secured for the concert. Eightei n contestants from various companies have been regU tered for the prize drill, which prom ises to be most exciting. Soldiers Home. The Ralign Firtiliz.)r Company of which W G Qpchnrch, Esq is Presi dent, offered at the late State Fair, a ton of Raleigh Fertilizer, as a prize for the largest number of bales of cotton exhibited, which was awarded to the Johoston County Alliance. It was agreed that the fertilizer should be donated for the benefit of the Con federate Soldier's home, and a com mittee was appointed to dispose of it for that purpose. In accordan-e with this arrangement, it will be sold to the highest bidder on May 9th, and in the meantime scaled proposals will be received for the purchase. All bids should be directed to W C Stron ach, Treasurer of the Soldier's Home who will open them. The right to reject all bids is reserved. The en velopes should be marked: "Bids for Guano.' The HsvleigH and Gaston Kail-, road Company Compromises With the State. ) A compromise was yesterday effec- ted between the State of North Caro ' Una and the Raleigh and Gaston Railroad Company, in the matter of taxes, by which judgment against the 1 road was rendered for fifteen thousand dollars, costs and disbursements, which amount to a li tie over seven teen thousand dollars, MesrsO M Bus bee and Armistead Jones, attorneys retaiaed by the St; te, each receiving one thousand dollars. This is aa am- . icable adjustment of matters for the j present though it is not to be con- 6trued a a barrier to either plaintiff or defendant in any controversy in the future. i The following is the judicial order: Norlh Carolina Wake County: In the Superior Court, April Term, 1890. D WBain. Publ 'c Treasurer of Nirth Carolina, A gainst the Jtaleiyh and Gaston Railroad Company. At this, the April term of said court, by consent, this action is compromis ed on the following terms: The defen dant agrees that judgment may be entered in favor of the plaintiff for ( the sum of fifteen thousand dollars, i being the amount levied and assessed upon the capital stock of the com pany for the fiscal years 1886, 1887, 1888, 1889. The plaintiff accepts this sum in satisfaction of all taxes due on said stock up to and inclusive of the fiscal year 1889. But nothing in this compromise or the judgment to be entered thereon shall be construed to estop or preju dice in any manner the plaintiff from demanding any other taxes which might be due from the defendant upon other subjects of taxation, nor shall it be construed to estop or pre judice in any manner the defendant from denying its liability for the tax on the capital s ock aforesaid, for fu ture years. It is, thereupon ordered and ad judged by the court that the plaintiff recover of the defendant the sum of fifteen thousand dollars, with inter est from the first day of this term, to gether with costs and disbursements. Mrs Caroline Blacknall, mother of Dr G W Blacknall, is in the city. Mrs M J Ramsey left the city yes terday afternoon for Roanoke, Va, to visit her sister Mrs Pauli, who is very sick. Mrs Wesley Whitaker who has been very "ow for several days, the physi cian thinks, is better this morning. Prof E A Alderman with his family will leave the city this afternoon for Chapel Hill to spend the summer. Dr Eugene Grissom has received a pressing call to attend an important case in consultation in Granville county. He left this morning. Deputy Sheriff P H Johns went home this morning sick.
