Butler a Bap tlst preacher at Do, ham, to Miss An nie Christian of that city. The license was procured In this city, it being re fused in Durham. Of cours, it Is known to mobt of our readeisthat the Register of Deeds Is required to Issue such licenses to persons of law ful age, &o. As to this requirement of law, the Register of Deeds cannot of his own knowledge be presumed to know. In this cas, It seems that Rev. Mr. Butler signed the.oatli stating, that the young lady was 1 1 years of age. On this, the license was issued. The onus therefore rests up on Mr. Butler, If any wrong has betn perpetrated. The Code provide. th t it is the duty of the Register pf Deeds to Issue license, provided it shall ap pear to him probable that there is no impediment to such marriage. In thia anA. no onnh Impediment was probable, unless misrepresentation was made by Mr. Butler. The license was issued on the 26th inst.
