"Tta rebate jjive been a wrong

be possible to psrrglslation too

statute books which, so far as pro
hibition can go, ought to be suffl
clnt. it undoubtedly ,hak largely
checked rebatas, hvt It baa not atop
epd them entirely. To make the law
thoroughly efficient we ought to add,
In pay judgment, three provisions.
We should restore the former penal
ties of the Interstate commerce law
which should not hare been repealed
and make theje secret evasions of
the, published rates punishable by
Imprisonment. The men who perpe
trate these evasions In defiance ot the
law suffer but little by a One, even
if it be a heavy one. Their" resources
are too large to niako .a money pen
alty a serious one. For this very
reason they are persons who would
feel acutely a punishment by Im
prisonment, and that penalty ought
to be provided in any law which we
pass.'
Mr. Lodge combatted the idea that
the i-allioads are owned by a few men
and that. they ars Inimical ami Inde

"We all want to soe the settled and
established sections of the country

ed revolution In our methods of rail
road management woud bring on a
business panic, reduce wages and prob
ably carry disaster to our trade and
comma roc in a degree which Is impos
sible to estimate,"
' Mr. Lodge expressed the opinion that
there should be ample provision for re
view of the findings of the commisaiin
by the courts. He concluded:
"Thero seem to bo now prophets of

at the ver? heart of the measure. I am

yet prepared to substantiate for the
courts of the United States an executive
cbmmissloni' Legislation' cannot pre
vent an appeal to ths court if it is al
leged that the rate is confiscatory. But
this is a ver narrow ground and very
limited right. ; A rate may not be ab
solutely confiscatory pnd vet may be
in the highest degree unjust and unrea
sonable, and indeed well nigh ruinous.
I nhi not sure thai ft wou'd ba possible
to deprive a citizen bv, legislation Of
the? tight to appeal to the courts as to
the ' justice and. reasonableness ..of a
given rate, which is a purely judicial
question. But no attempt ought to be
made., either! directly or indirectly by

privilege, or, rather, this right W
