J (By Leased Wire to The Times.) New York, March 26. "There is no, inan on the Jury woo does not think , Thaw " is sane .at the present time." .. ; i . This statement was reported todiff to have- been -tnade- hy one of the Jurors who are trying Harry K. Thaw tor his life. Coming from ono of the twelve men .who have been studying Thaw's appearance and actions In the court room for weeks1 while hearing Xhetievidence in the case, the state- lenf has a double significance. '. It shows the impression Thaw has made'. on' twelve- unprejudiced ' men, and it shows the attltndu of the. jury as to Thaw's present mental condi tion. The juror's remark is alleged to thave been made in the 'rooms of th Sagamore Club . last Saturday evening. The Juror likquestion, it Is reported, was playing pichlcle with a member of the club. A -casual refer ence was made to the Thaw case, and another ' member rotnarked to the juror: ' suppose you are tired of your'JobT" ' , "Yes," replied the Jurori "I ahall be glad when the whole thing ft over. Detective Says Har ris Has Iveft Richmond. Determined efforts are -being made to locate .Sum W. Harris, the Wake field merchant, who disappeared on the. irth of the month, ' but so far nothing definite has been ascertained, further than the fact that Harris was In Richmond on the , 16th, and left there on the 18th.' Where the man has gone and what could have - prompted him to leave is) a mystery. : He was doing a good business' and it Is -said that he was Involved In no financial dlfllcullies whatever. , Mr. Charles V. Harris, . of this city, is endeavoring to ' locate the missing man and this morning 'he. received the following telegram.' from the chief de tective of Richmond: ' , "S. - W. Harris registered at Lexing ton Hotel on the 16th. from Wakefield, N. C, left on the 18th. ' . i "A. JJ. TOMIJNSON, - ('Chief .Detective." . Lnyton Killed A. II. Mooneylmni. All of the morning in the superior court was consumed with the Iayton cac and it looks like the remainder of the afternoon will be consumed In the same way. Tho case was begun late yostei-day afternoon. A verdict not creator than second degree murder is ashed, but the .evidence this morning led those in the court room to believe that Charles H. Layton would bo ac quitted. Layton, who Is a white man, killed A. H. Mooneyhani at Holding's dairy, also known as tho Raleigh Creamery, last October by striking him in the head with a shovel. Both men were employed at the creamery, Layton being what might be termed foreman. The men, according to the testimony, had been on bad terms since soon alter Mooneyham went to worn at the dairy, and several witnesses testified to having heard Mooneyham make throats against Layton. Owing to the nature of the evidence Layton was released under a $200, bond soon after Mm affair occurred. Tho state put on two witnesses this morning, Mi's. Mooneyham, wife of the murdered man, and her son, Charles Mooneyham. Neither of them saw the crimu committed, but they testified as to the statements made by Layton Im mediately, after he had struck down Mooneyham with the shovel, and Mrs. Mooneyham- testified that Layton knocked her down and " threatened to kill her.' - After the examination ' of those-iW.ltnosses the.state jrAatod' and thei -examination of witnesses lor th defense was begun. Two negroes were put on tlfe stand ftrst "and testtfted 09 to threats they had heard Mooney ham make and that bad feelings exist ed between the men. A Frenchman b the name of John Williams he explained that his fa ther was English was the reason ho was named Williams was next placed upon the stand and proceeded to give testimony that was very amusing from his peculiar accent and his way of demonstrating how certain things hap pened. The evidence was also very satisfactory to the defense, for tho wit ncss had Mooneyham making threats to "bleed Layton like a hog" on nu merous occasions. Williams said that when Mooneyham entered the barn where he and Layton were at work, he carried in his hand a large hickory stick (the stick was exhibited In court) and said to Layton, "I am going to kill you, d n you.'' In a few minutes Layton struck the fatal blow and Mooneyham was felled to the ground. The witness stated that Mrs. Mooney ham and her son rushed to the barn, and that Mrs. Mooneyham cursed Lay ton in a most violent manner. He gave a sample of the kind of language ho said she used 'and said that more could be given, but the court told him that he need tell no more. According to Williams, Layton was put in a position where he had to either strike Mooneyham or get struck himself, and he turned to the solicitor while being cross-examined and said: 'If a man had come to you with that stick you would have struck him, too." The witness testified that Mrs. Moon eyham was not struck by Layton, but that 'she had hold of one end of the stick and Layton the other, and when Layton suddenly Jerked it out of her hand she. fell. iThe solicitor proceeded to. cross-ex amine the witness rather closely on this point, when suddenly the Frenchman-' left the .witness chair; picked up the stick' and said: "You just catch hold of that end and let me show you!" The solicitor did - not care .to demon strate tho matter, In that way,, but Col.' J. C L. Harris, one of Layton's attorneys, caught hold of the stick and gave the stunt of swinging back, leav ing the jury to Imagine what would take place if the -stick had suddenly left- his hands. Co). Jerome no Probably llove for Her Indicfmcnt ; A CHARGE OF PERJURV .i The District Attorney's Effort Clear the Nome of White, Bids 1 Fair to Prove as Successful as the I EU-rnal Task of Sisyphus in the I Pagan Hell. New York, March 26.- Evelyn Nesbit Thaw's indictment and trial for perjury committed to save the life of her husband, probably will be the most sensational and startling aftermath of the Thaw trial. Cer tain covert moves indicate that it is District Attorney Jerome's aim not to spare the young woman punish ment If she must be sacrificed to vin dicate Stanford White's memory. While the Thaw case was tempo rarily halted today, Jerome took pains to Insure that certain witness es, most of them women of the stage would ba on hand whenever he might see lit to call them. Whether Harry Thaw goes to the Matteawan mad house or to state's prison Is a matter of comparative in difference to Jerome, according to those who have discussed the matter With him. He is not so eagerly vengeful against Thaw as to be over- zealous to send him to tho chair. The more important matter is to establish the' falsity of the. allega tions brought against Stanford White by jSyelynu Jtfesbtt Thaw on, the wit-t. nees-'titawtl' ahd to clear his name bv sUowihg ?ffa:t shtf swore "lately. Vain endeavors were put forth by Lawyer Delmas to shield her from the district attorney's cam paign to impeach her story by get ting her account of the treatment to which she was subjected by the ar chitect Into the record in the guise of a conversation she had with Harry Thaw. This shield of protection failed when Jerome obtained from her a direct statement fixing the date of the attack by White. The Incidents in the mirror room of one of White's apartments she swore, took place on the night subsequent to the day upon which she had posed for certain photographs. By tho photographer the day of the month when the pictures were taken was ascertained. Although he could not introduce it as evidence, Jerome, aided by White's friends has proof, It is not doubted, that White on the night named by Evelyn was In his apartments in the Madi son Square tower receiving election returns. His Plans .Easily Seen. The trend of the district attorney's plans to provide a most startling and sensational aftermath to the Thaw trial were easily discernable in the tenor of his cross-examination of Mrs. Thaw and of questions he pro pounded to other witnesses. Much of the revelations he sought 'to bring out, were barred by the decisions of Justice Fitzgerald. These rulings, of course, would not apply if Evelyn were tried for perjury. The result would -be to place before the court a mass of lrand new evidence, much of It undreamed of by the public, bearing upon tha gay life led by Harry -Thaw and his wife and Upon certain episodes heretofore only hinted, at. .Arrayed behind the district attor-. ney are a large dumber of witnesses. majority of them have bean un der subpocnae by the . prosecution for months. :. Quietly the crowd slipped -up to- the rooms of the. Chamber of Commerce last night and the secret political paw wow took place, but it seems to have been principally talk, although it was decided to have a number of meetings between now and the date of the pri mary, secret meetings,' The object : seems to be not to put out candidates, -but to spot certain of the candidates already in the Held and throw their In- nuence to them. . Of course they may put out candidates if this does not tvork out Just right. But all that they do is to be secret, although their first meet ing In this respect has proven a fail ure. It Is said that the organisation decided not to put m man In the field for mayor, but -will devote their at tention to the aldermen. . , Among those present last night were, Messrs.
