State vs. Luther Roberts, affray; failing to appear judgment nisi en tered and capias ordered. State vs. Mose Roberts, larceny and receiving; nolle pros with leave. State vs. Alvin Lyon, retailing; coin icted at last term and judgment suspended until this term; sentenced to two months in the county jail, with leave for county commissioners to hire him out or work him on public roads State vs. John Reams, forcible trespass; case dismissed at cost of the prosecution. State vs. Noah Landis, disposing of mortgaged property; nolle pros with leave. It is authoritatively announced that the rumors of a change in the manage ment of the Richmond & Danville rail road are without foundation. The R. & G. Railroad shops at Raleigh have just turned out a loco motive which is pronounced, a first class piece of machinery in every respect. The S. S. Convention for the Sixth District, embracing the counties of Granville, Durham, Person, Caswell, Alamance, Orange and Chatham, will be held in Durham February 14th and 15th. The trial of Mrs. Cora Scales Mor ris, at Went worth, charged with mur der of her husband, was ended yester-, day, resulting in the acquittal of the accused. The jury was out only five minutes. The Governor has refused to inter fere in behalt Lige Moore, sentenced to be hanged at Greensboro, and Man ley Panckey, condemned to the gal lows in Montgomery county, on Feb ruary 7th. Christian et al appellants vs the Atlantic & North Car olina Railroad company et al. 1 his case is of importance, not only in the amount of money" directly "involved, but in the important constitutional questions decided. Of late a number of cases involving the questions of the lia bility of the State to be sued have been brought before the Supreme Court. The court is: of the opinion that the State is an indispensable party to any proceeding in equity in which its property is sought to be taken and subjected to the payment of its obligation. This virtually decides he pending Temple case. IN A GENERAL WAY. Important Happenings in Otlier States and Countries Senator Bill Chandler took another turn at grinding the outrage mill-yesterday. Just now "the glorious climate of California" has deprsited sixteen feet of snow near San Francisco. A fire at the ; navy yard at Ports mouth, N. H., yesterday morning de stroyed some buildings and entailed a loss of over one hundred thousand dollars. It is stated that in accordance with the recommendations of the Senators from Washington, the President has appointed' P. H. Winston, of Spokane Falls, and Captain Brown, of Tacoma, District Attorney and Marshal, re spectively. Their nominations have not yet been made to the Senate, but the papers have been signed. Mr. Winston is a brother of our townsman, Mr. R. W. Winston. Passenger train No. 1 on the Mo non Railroad, which left Chicago Sunday night at 11:55 o'clock, was wrecked yesterday at 7: 50 o'clock,a. m one mile above Carmel, Indiana. The train wras running at a rapid rate and wras approaching a long trestle across Wilkerson Creek when the tender ot the engine jumped the track. The engineer reversed his engine but be fore the air brakes could check the speed of the train the locomotive and baggage car had cleared the trestle, but the sleeper and smoking car went over in the creek, both taking fire .al most immediately and being consum ed in a remarkably short time. Five cars were almost totally consumed. The total casualties are six dead and nineteen injured, most of whom are seriously hurt, and some likely to die. . '- 1 m ' - Squire R. H.
