MAYOR HICKS AND THE BONDS

All Important 3Ieeting of the Board of
Town Commissioners Held on
Tuesday Xijjlit.
The Town Commissioners held a
called meeting SatuVday night when
A. W. Graham, Esq.. presented the
O. & C. L. Railroad blank bonds for
Mayor Hicks' signature. Dr. White
said thev would like to take time to
consider and moved to adjourn until
Monday night, which motion was
carried by a vote of 4 to 3.
There was a full attendance Mon
day night. Chief of Police J. A.
Renn was elected clerk' pro tern in
the absence of G. P. Fleming.
Mr. Graham, of the Railroad Con
struction Committee, took up the
minutes of the commissioners and
read the petition signed by citizens
asking that an election be ordered
on a proposition to vote $40,000 to
the capital stock of the Oxford &
Coast Line Railroad.. Co., to build a
raili'oad from Oxford to Springhope
or to some point on the Atlantic
toast- lJiTrer or sonic oiuer rauroau
system ; read, the official election
notice, which stated that the $40,000
bonds were to be used to aid in build
ing the O. & C. L. R. R., to be ex
pended upon that part in Granville
county ; read the returns of the elec
tion, resulting for issuing the bonds;

read a resolution passed by the Town
Commissioners in August, 1891, or
dering the bonds of the town of Ox
ford to the amount of $40,000 be im
mediately prepared, and, upon a
completion of a contract by the rail
road authorities for the construction
of the road, the bonds be delivered
to the president of said railroad com
pany to aid or assist in building said
railroad; read of the appointment ot
a committee to have the bonds litho
graphed, of their performing this
duty and of the Board of Commis
sioners paying for the work of litho
graphing; and finally read the con
tract made with J. T. Pruden for the
construction of the railroad.
N. B. Cannady, attorney for the
railroad company, then arose and
formally tendered the blank bonds I
to Mayor Hicks and asked him to
sign them. -
Mr. Hicks replied that he had said
he would not sign them unless in
structed to do so by the Board of
Commissioners, and he asked the
Board what he should do.
Maj. T. B. Venable, who also rep
resented the 0. & C. L. R. R. as
counsel, said the Mayor and not the
Board was asked to sign these bonds;
the August resolution stated that
when a contract-for the construction
of the road was made the Mayor was
to sign the bonds and deliver them
over to the construction committee ;
the application was now made to the
May-ir, all the requirements' of law
and the August resolution having
been met, and he wanted the Mayor
to say whether or not Le would sign-"
them ; the Board had nothing; t do
with them.
Mr. Hicks answered lie would ask
the Board for ' instructions.
Dr. E. T. White offered the follow
ing resolution: j
-Whereas application is now made
to the Mayor and Board of Commis
sioners of Oxford to issue to the di
rectors of the Oxford & Coast Line
Railroad Com oanv bonds of the town

of Oxford to be used in the construc
tion of a road to run from Oxford to
the Durham & Northern Railroad at
Dickerson's crossing ; and
Whereas the Commissiqners of Ox
ford at their meeting held on the
30th of April, lSO'J, resolved not to
issue said bonds for the purposes for
which the same are intended to be
used; and 1
Whereas the situation in reference
to said road from Oxford to Dicker
son's crossing and to the using of
said bonds remains unchanged in all
material respects ; therefore
Resolved, That this Board of Com

against the Board; taking a hand in
the matter, and Mr. Cannady also
made an argument on the same line;
but the Mayor said the Board was
his advisors and he would not act
without their counsel. Mr. Canna
dy's speech was logical, forcible and
bristled with points, and made a good
impression.
Dr. G. A. Coggeshall moved that
the resolution be tabled. The motion
was lost by a vote of 3 for and 4
against.
The vote on Dr. White's resolution
was then taken, and resulted as fol
lows: Ayes, Currin, Whiter, Mitchell,
Hall 4. Noes, Coggeshall, Edwards,
Osborn 3. f
Mavor Hicks announced that 'the
resolution was adopted, and upon
Mr. Cannady once more presenting
the bonds, said he declined to sign
them under instructions of the Board
of Commissioners.
' Mr. Graham then stated that every
thing done by the Construction Com
mittee had been done in pursuance
of the authority given by the Board
of Commissioners and the Board of
Directors of the Railroad and that
the contracts had been made, money
expended by third parties, vested
rights had accrued, and unpleasant
as it might be the Board of Directors
would be forced to call in the unpaid
subscriptions of private stockholders
and institute a "suit for a writ of
mandamus'to compel the proper par
ties to .sign the bonds. That, of
course, it would delay the comple
tion of the road somewhat, but that
tie felt he had justice and.riht on
the side of the railroad, and . the
company would not give up until
the highest courts had .passed upon
the matter.
