What difference does it make! As to our part we concede to the Observer all it asks for itself in the traditional and scared names, what we want is for the "pot to continue to boil." Winston Repub lican. Governor Aycock's New York ad dress is applauded and much praised in the north. The New York corres pondent of Philadelphia Press writes "that those who heard the North Carolina orator 'have leen speaking ever since with fine enthusiasm of his brilliant speech.' According to the Press correspondent, 'no address has been delivered in New York to com pare with it since Henry W. Grady astonished and delighted the mem bers of the New England Societ3r by a revelation of the higher gifts of oratory." The Baltimore Sun says of him: "Although comparatively a young man he has a wide reputation as an eloquent and forceful speaker, As a political campaigner he is with out a superior in the Tar Heel State which has never lacked able and ef fective orators." Speaking of the evils of the cigar ette habit the Greensboro Record ob serves: "And yet if the manufacturers of the cigarette but give liberally to various worthy causes they are im mortalized. Why not worship the distiller who makes liquor, provided he does a little 'endowing?' He is not whit worse than the former in fact the traffic has to do more with the youth of the land than whiskey, there are at least a few safeguards thrown around liquor while the cig arette can be purchased anywhere and almost at any time." During the Educational Conference here some one described a "crank" as wrho knows the Lord would do things according to his notion if the Lord knew as much about it as he does. We are reminded of this definition by the following remarks which Dr. Kilgo is reported to have made in an address at Greensboro, a few nights ago, to-wit: The broadest spirit, in this coun try today is the business spirit, not the religious or political spirit. Civil ization is now encraaed in a ereat fight for supremacy in the Celestial Empire. I tell you that God will go into China through the cotton fac tory, the railroad and the telegraph quicker than through the praver- meeting." We do not think Dr. Kilgo's "reve lation" will be.subscribedtoby those missionaries in China who complain that their work has been retarded by the "business spirit" which introduc ed the vile cigarettes and accompany ing lewd pictures Into the Celestial Empire. Winston Sentinel. There is a class of politicians who live on hate, who never shed the sun shine of peace and good will. They steal when they can, and when caught in act, in order to cover up their own guilt, they cry out against honest men, and cry fraud and corruption, and sometimes well-meaning men are deceived by their loud clamor. These men are found generally in the shape of some dirty fellow who has been elevated in the Radical revenue service; sometimes he Is the hired tool of the revenue ring; sometimes he is a creation of the ring, wanting an office only to disgrace It and for loot and plunder. Again he is a sorehead without credit or the confidence of his neighbors, and, desperation seeks surcease for his sorrow In consolation with swine-feeding on the husks and refuse from Hann's table. These are the Johnnie McLaurlns of politics, who have boxed the political compass with each changing wind, and who never had any politicial convictions other than those promoted by their desire for office or the refuse from Hanna's table. The career of such is short-lived; rocks and mountains soon fall upon them. Asheboro Courier. Dr. Kilgo Is much given to striking paradoxes, and is troubled with a "breaking out" at the mouth. He is a forceful speaker and a fine dc;aimer but frequently pains his friends by rash speeches. He is reported to have said some time ago that he "could lead a woman anywhere with a diamond ring. " This in all conscience, was bad enough, if it were said; but it comes perilously near sacrilege for a minister of Christ to suggest that God will go into China on the waves of commerce rather than on the wings of prayer. We believe that if the churches of Christendom should go down on their knees in dead earn est God would go down into China and stay there. We have scant faith in a God that has to go to China or any where else boxed up in com mercial packages and labeled "Duke's Cigarettes." It would be of advan tage to the church if some of its rep resentatives had a stopper applied to the hole in their heads. Morgan ton Herald. NEW TRIAL IN K1LGO CASE. Supreme Court Sets Aside Verdict in Dam " atfe Suit T1 oUDreme Court grants a new t . . . tl notable and sensa tlonal damaire suit of Rev. T. J Gattis, of the North Carolina. Meth odist Conference, against President John C. Kilgo, of Trinity College; W, It. Odell, and B. N. Duke. The lower court srave a verdict for $20,000. The new trial Is granted because of certain errors in the judge's charge. It is held that Dr. Kilgo had a right In his defence to recent charges against his character. In the case of Gattis vs. Kilgo Justice Montgomery delivers the opinion of the court ordering a new trial. There is no dissenting opinion Justice Clark ma not sit in tms case, The opinion is of great length. The court sa s that whether or not the speech of Kilgo published by defen dants in pamphlet form was a privi leged communictiticn was a question of law and the judge below properly tried the case as one of qualified privi lege. In vindication of Kilgo's char acter, he (Kilgo) has a right to pub lish a fair and honest account of acts done In the course of Investigation, provided the publication was free from malice. No error is found in most of Judge Hoke's charge to the jury, but a new trial is granted for certain errors in the charge, the court holding thatKilgo's speech was absolutely privileged. The court holds thatKilgo's trial before the board of trust ass of Trinity College upon charges against his character and fit ness was like a trial before a court for violation of the law of the land and that he had a right in his defence to resent the charges. In this State defendants have entire immunity in trial before courts of law In such cases, provided what they say is pertinent to the issue. The court holds that Kilgo's speech, which was published by W. It. Oddell and B. N. Duke as the trustees of Trinity, was not intrinsic evidence of malice. The Durham Herald says the decis ion of the court makes the defendants side jubilant but the plaintiff side is not cast down and will go into a new trial with new hopes and con fident of winning. While the decision of the court will result In a new trial and in that for it is a victory for the defendant it is claimed that the court has settled several very impor tant points of law and that the con tentions of the plaintiff were upheld in the main. On the other hand the friends of the defendants claim that the court has left nothing on which the plain tiff can stand for a new trial, From what could be learned yester- dav it is thought that a new trial will be had at the July term of Gran ville Superior Court. The case will be tried again in Oxford and many think that the case will be called at the above named term of court. Since the atrial of the first case Attorney Ay cock' has been elected governor, and one of the attoneys for the de fense has died. This will necesitat the employment of at least two new lawyers and It is understood that several will be added. The next trial of the case will be a hard fought one and the best legal talent in the state will be employed on one side or the other. Atlanta, Ga , Nov. 7 1879. Dr. C. J. It wishes to see right done. It wishes to see, all things being equal, south ern publishers favored. The South is forever a hewer of wood and a drawer of water for the North. Have some independence, self-reliance and appreciation of home productions. We note with pleasure that our old friend of more than a half century, Mr. W. H. P. Jenkins, the eloquent legislator from Granville, who made such a fine impression upon the mem bers, has written a letter to Italeigh News and Observer in wrhich he says emphatically that the people are op posed out and out to giving the fa vors of the State to the very publish ers who fought the good law. We quote a passage from this intelligent legislator and ever faithful North Carolinian: "Notwithstanding the opposition of these companies the bill was pass ed and I learn that the bills of the va rious publishers show a reduction of from 35 to 40 per cent. For many years have been connec ted with the public schools of the State, and have found by long expe rience the books now in use were not satisfactory either in matter or price and no act in my legislative career given me more pleasure than the vote I cast for school book law. It is now reported that the Univer sity and American Book Companies are endeavoring to make the state board believe that the people vant the books; that these companies have furnished for the past 30 years at exorbitant prices, retained for the next 5 years." Peabody Scholarship. July 18th and 19th the examina tion of persons to fill the vacant scholarships at the Peabody Normal College will be held by the various boards of education. The State Su perintendent of Public Instruction finds that for years practically all the scholarships have gone to the wes tern part of the State. He is deter mined that all sections shall have a show. He was some weeks ago no tified by the president of the college that there were three vacancies. A few days ago he was notified that the president had made a nomina tion for one of the vacancies. The Superintendent said he would ignore this absolutely and have the exami nations held. It is more than pro bable that his decided action will re suit in a shake up of the old system Owners Held Responsible. The Charlotte Observer calls atten tion to a case of importance report 3d in the digest of the Supreme Court decisions and says: "A man known to be cruel and mean to children was superintendent of a cordage mill. In his service was a ten year old boy, a sweeper. For nonattention to his work the superintendent shoved the boy, so that he fell upon some spin ning frames and sustained the loss of fingers. The Supreme Court holds, in an action for damages, that the owner of the mill is liable, because he had no business tn put a superinten dent of such reputation in charge of the mill. The decision is a just one." While the family of William Riley was at breakfast Monday a cow came crashing through the roof of the house and landed on the break fast table. The Riley family live in the valley below the Starrucca Via duct, near Binghamton, N. Y., near the Erie Railway structure that rises 300 feet from the ground. The cow wandered into the bridge just as a train approached. The en gineer realized that if his train left the track it would be dashed to pieces, and determined ,to put on force enough to remove the obstacle. Ac cordingly he threw the throttle open and struck the cow at all speed.' There was a slight jar to the train, but the animal was hurled into the air and clearing the bride crashed through the roof of the house below. Then there was a wrecked roof, a spoiled breakfast and a dead coav, but no damage was done to the family.
