Sec. 7- The Board of road commis sioners of said county may with and under the advice of the county road superintendent divide the public roads of the county into' convenient districts or sections and appoint an overseer over each section or district, and assign the able-bodied male per sons living in said district or section liable to road duty, to work the roads of the ; district or section nearest where they reside; and each overseer so appointed shall be known and des ignated as road overseer and shall perform the duties imposed by this act, and such duties as may be re quired by the beard of road commis sioners, or by the county road super intendent under the supeprvision of said board. , .Sec. 8. The said board of road com missioners of said county, be and they are hereby authorized and em- popwered, when i their judgment the best interest of the county will be promoted, to let by contract the building, constructing, repapiring or maintaining of any section or district of any public roads in the bounty. Sec. 9 . The' said board of road com missioners may oppoint and em ploy, with the power at any time to remove or discontinue same, such road overseers, foremen, guards or other employees as may be needed to propeprly take care of and wors. any and all convict force' available in said county, or to do any other work which said board of road com missioners may desire to have done on the public roads or bridges of Granville County. Sec 10. The board of road commis sioners of said county may appoint and employ road walkers or inspec tors whose duties it shall be to travel the section of roads assigned to eacn at designated times, with such tools as may be necessary to remove leaves or other trash or obstructions from the road beds or ditches which are likely to cause mud Holes, or do other damage to said road, and shall fill the holes with sand or other material or by causeway, so as to cover them Each road walker shall receive such pay as the board of .road commission ersr may stipulate. Sec. 11. That all prisoners confin ed in the county jail under final sentence of the court for crime or imrisoned for nonpayment of costs or fine, or under final judgment in cases of bastardy or under the va grant act or all insolvents v ho shall board of county commissioners, shal work on the . public roads i of said cqunty for four days of eight noun each, in each and every year at such times and places, and in such, man ner as may be designated by the county road superintendent or road overseers: Provided, that such per son who is subje'et to road duty shall be assigned to work the roads of the section or district in which they re side nearest where they reside and shall be given at least two days no tice by the county road superinten dent or road overseer by personal warning, or by leaving a written no tice the time and. place such work is to be performed, and also designat ing in such notice the tool or imple ment with which such person shall be required to work. The county coad superintendent may exchange personal labor for use, of team or tools, making due report thereof to the board of road commissioners. In case of a washout or other unexpect ed obstruction to travel on any roac, the two days notice "herein required to be given shall not .be necessary, and anv person subject to road duty on the section in which such obstruc tion to travel may occur, shall, upon being properly notified by the county road superintendent, or road over seer, respond to such notice with rea sonable prompness for the purpose of doing whatever work may be nec essary to repair the said road: Pro vided any person subject to roaa duty under this section may cn or before the first day of April of each and every year, in lieu- of working the roads of said county four days, pay to" the Sheriff of Granville Coun ty four dollars, upon payment joi which amount such person shalr be exempt from the road duty in said county. Provided further, that any person coming of age, or becoming a resident of said county, after the first dav of April of any year, who shall be subject to road duty under this section, shall be required by this section for that year, or to pay the proportionate art of the money re quired in lieu of such work. All money paid underr the provisions of this section shall be by the sheriff of Granville County paid to the coun ty treasurer, who shall apply the same to account of the general road fund of said county; and the sheriff of said countv shall issue. a receipt to the person so paying, stating the amount paid and the purpose or same, and shall within thirty days af ter such payment furnish the board of road commissioners the names of every person in the county paying the fame- Sec. 13.
