Hotel Liability

What is the liability of a hotel
for the property of a guest that
is brought into a hotel?
In North Carolina a hotel
cannot be held liable for loss or
damage of the property of a
guest unless the loss results
from the failure of the hotel to
exercise ordinary care. Even
then the hotel cannot be used
for an amount in excess of $100
if required notices have been
posted.
However, if a guest notifies
the hotel in writing that his
property exceeds $100 in value,
and furnishes it with a list of
the property and its value the
hotel may be held liable for any
loss or damage to the property
resulting from negligence on its
part.
Proof of the loss of any such
property, except in the case of
damage or destruction by fire,
is deemed prima facie evidence
of the negligence of the hotel.
Peoples Presides
Over Court Session
Judge Lin wood T. Peoples of
Henderson presided over a
lengthy session of Warren
County district court on Friday.
Only 12 continuations were
granted with 57 cases being
docketed. Among cases disposed
of were the following:
Calvin "Kitty" Allen, Harvey
Boyd and Bddie Roy Davis,
each charged with larceny were
given prayer for judgment
continued for one year and
placed on probation for one
year under the condition that
each pay cost of court and $50
restitution to E. B. Rideout. At
the end of one year, if the
defendants have satsified the
probation conditions, the case
will be dismissed.
William McLean Davis, also
cfiarg^d with larceny was
ordered to jail for 18 months
and assigned to work under the
supervision of the North
Carolina Department of Correction.
Notice of appeal given
to next criminal session of
Superior Court.
Theodore Watson, larceny,
was also found guilty of
misdemeanor larceny in the
above larceny cases and was
ordered to jail for two years,
suspended for one year on the
condition that he remain of
good behavior and not violate
any State or Federal criminal
laws, pay $100 as restitution to
E. B. Rideout and cost of court
and ordered to the Warren
County jail for 10 weekends.
Jasper Alston, nonsupport,
voluntary dismissal.
Earnice Ball, driving under
influence, improper muffler,
ordered to pay $110 and court
costs and attend alcoholic
control course at area mental
health clinic, to surrender
operator's license and not
operate motor vehicle on
highways of N. C. until allowed
to do so by Department of
Motor Vehicles.
Betsy W. Bolton, worthless
check, voluntary dismissal.
Byron Calvin Brown, no
operator's license, voluntary
dismissal.
Duke Wayne Buffaloe, speeding
70 in 55 mph zone, called
and failed. Ordered arrested for
appearance on April 15 with
bond set at $100.
Prince J. Bur well, assault
with deadly weapon, placed on
inactive file until defendant
returned to county.
Thomas D. Cabbagestalk,
Sr., two charges of worthless
check, ordered to pay court
cost and amount of checks.
Spurgeon Yates Daniel,
speeding 65 in 55 mph zone,
prayer for judgment continued
upon payment of court costs.
David Davis, speeding 82 in
55 mph zone, improper muffler,
found guilty of careless and
reckless driving, fined $50 and
court costs.
Ronnie Edward Tally, David
Watson and Vincent McKinley
White, each charged with two
counts of breaking, entering
and larceny, waived right to
preliminary hearing and bound
over to Superior Court to
answer charges with bonds to
remain in effect.
"Peewee" Dortch, injury to
personal property, voluntary
dismissal.
Millard Solomon, injury to
personal property, voluntary
dismissal.
Donald Wilkes, injury to
personal property, voluntary
dismissal.
Ivey Felts, three charges of
public drunkenness, ordered to
the North Carolina Department
of Corrections for not less than
30 days nor more than six
months to be treated as a
chronic alcoholic. He was also
ordered to the county jail for 30
days for contempt of court.
John Andrew Gifford, Jr.,
speeding 70 in 55 mph zone,
called and failed. Ordered
arrested for appearance on
April 15 with bond set at $100.
Keneth Morse Guill, speeding
70 in 55 mph zone, called
and failed. Ordered arrested for
appearance on April 15 with
bond set at $100.
Matt Ransom Johnston,
speeding 69 in 55 mph zone,
found guilty of exceeding a safe
speed, court costs.
Arthur Kearney, possession
of a weapon of death and
destruction and disorderly
conduct, placed on inactive file.
William Gray Neal, speeding
70 in 55 mph zone, driving
under influence, attorney's
motion for nonsuit in the D.U.I,
charge allowed and case
dismissed. He was found guilty
of speeding 70 in 55 mph zone
and fined $15 and court costs.
Notice of appeal given to next
session of Superior Court with
bond set at $100. After
completion of the case,
defendant dropped appeal and
paid fine and cost.

utilities engineer course at Ft.
Leonard Wood, Mo.
Students were trained in
basic engineering skills to
include carpentry, masonry,
plumbing, sheet metal, pipeline
construction, electrical repairs
and refrigeration.
A 1976 graduate of John
Graham High School, he
entered the Army in October,
1976.

BENNETT
New Troopers Begin Duties
Warren County's newest
highway patrolmen are A1
Bennett and William Palmer.
They were assigned to the
county and began duties here
on March 10.
Bennett, a native of New
Bern and Palmer of Elizabeth
City, were both previously
employed by police departments
before joining the State
Highway Patrol.
Bennett was employed by the
New Bern Police Department,
reaching the rank of sergeant.
He was also a member of the
New Bern Fire Department.
Palmer worked on the
Elizabeth City Police Department
for three years.
Both men recently completed
the basic training for patrolmen
at Chapel Hill. This is their first
as: ignment.
Trooper Bennett is married
and the father of a daughter,
age 8. They will reside on
Battle Avenue in Warrenton.
He is a "Civil War buff and
adds that fishing is one of his
hobbies.
Trooper Palmer is single and
resides in the Afton community.
He includes hunting and
fishing among his hobbies.
Both men are receiving
