Multiple Office-Holding Questioned

How many positions of public trust and responsi

the same time"
This question was raised at a recent meeting of the
\rea Mental Health Board of Vance. Warren, Gran
vilie and Franklin counties, .lack Harris. Warren
i lunty commissioner, was reelected chairman of the
mental health board at that meeting
Harris is currently the chairman of the Warren com
missioners as well as the policy board of the Region K
Council of Governments He therefore holds member
ship or. one elective policy l>oard and two appointive
boards, and serves as chairman of all three
Harris also served on the Warren County Board of
Social Services from 1978 until July 1. 1980 During this
period, he was also a county commissioner, COG
board member and a member of the mental health
board
The North Carolina Constitution addresses this
question in direct fashion It prohibits a person from
holding r.ore than one elective office or from serving
in more than one appointive office in state and local
government
The constitution also prohibits any combination of
elective and appointive offices unless the N C.
General Assembly authorizes an exception by general
law
The General Assembly has modified the constitu
tional restrictions on dual office holding by authorizing
one person to hold two appointive offices or one
elective and one appointive office, with some excep
tions Serving concurrently in three or more public
offices appears to be a violation of both the constitu
tion as well as subsequent laws enacted pertaining to
public office holding
I-ouisburg attorney I,arry Norman, a member of the
mental health board, said he was familiar with the
state statutes in this area He was asked by Harris to
obtain an interpretation from the attorney general's
office about the legality of Harris serving simultan
eously on three public policy making boards
The question about multiple office holding can also
