costs. On a charge of
driving while impaired,
not guilty. It appeared to
the court from conversa
tions with the assistant
district attorney and
defense counsel that a
type of plea bargain had
been stnick which would
necessitate a mistrial.
Tlierefore it was ordered
that a mistrial be
declared and the trial on
the charge to be con
tinued to Jan. 15, 1906,
the plea bargain being
that defendant will plead
guilty to DWI on that
day.
