PROPERTY REZONED Lawyer for Masons Says Board's Action Is Legal Ferd Davis, attorney represent ing the Zebulon Masonic Lodge in its negotiations with Mrs. Beverly Moore, owner of a lot across the alley from the post office, stated yesterday that he is certifying the lot as having been legally rezon ed for business. The lot, which the Masons have agreed to purchase provided it is rezoned for business purposes, was rezoned by action of the Board of Commissioners Monday night, June 7. Legality Questioned Thereafter Dr. L. M. Massey, chairman of the Board of Adjust ment, raised the question of the legality of the action, since there was no report made to the com missioners by the adjustment group. Town Attorney Foster Finch stated that it was his opinion that the rezoning action was entirely regular, and he was backed up by George Franklin, attorney with the North Carolina League of Mu nicipalities. Davis said that by state law the Board of Commissioners cannot make an original zoning decision without prior action by the Zoning Commission, but he pointed out that as soon as the original zoning ordinance is passed, the Zoning Commission no longer exists. Its membership, if continued in office, then became members of a Board of Adjustment. Advertised Twice He added that there is nothing in state law or local ordinance which requires the Board of Commis sioners to withhold action until the Board of Adjustment approves or disapproves a rezoning request. “The only irregular part of the action,” Davis said, “was the or der for the notice of the rezoning hearing to be run only once in the local newspaper, and that de fect was cured when the notice actually ran twice before the hear ing An affidavit in the town clerk’s office substantiates this point.” Appreciates Promptness Davis added that he regarded the criticism of the town board and attorney as unwarranted, and said that he appreciated the prompt action of the local officials in re zoning the Moore property. Methodists Plan Special Program <r There will be a special program given at Zebulon Methodist Church on Sunday, June 27, at 11 a. m., by Rev. F. D. Hedden, superintend ent of the Methodist Orphanage, with the assistance of 7 children from the orphanage. Mr. Hedden is well-known in both Zebulon and Wendell, having preached in revivals in both towns. Following the service there will be an old fashioned picnic dinner in which all who attend are invited to par ticipate. Announcement of this in teresting event is made by Rev. S. E. Glynn Hill Annual Revival At Hales Chapel Beginning Sunday, June 20, Hales Chapel will hold its annual revival services. These services will be held each weekday night at 8 o’clock. The Rev. Glynn Hill, pastor of the church, has announced that the visiting minister will be the Rev. Travis Styles. Mr. Styles is a na tive of Cullman, Alabama. C., Tuesday, June 15, 1954 Guardsmen Shoot During Weekend # At Camp Butner Nearly 37 percent of the mem bers of Zebulon’s Battery A who fired the M-l rifle at Camp Butner over the weekend qualified as Marksman or Sharpshooters. This percentage is better than the state wide average for National Guards men, and greatly exceeded that of th other three batteries firing Sat urday and Sunday. Sgt. John Clark and Pfc. Clar nce “Spot” Beddingfield tied for first place in the firing with 163 points. Both qualified as Sharp shooters. The range firing climaxed six weeks of intensive armory train ing for the Guardsmen. The work was under the supervision of Lt. Jack Potter and Lt. A. G. Hensen. Non-official scores awarded members of Battery A were: Master Sergeants: Carl Kemp, 111. Sergeants First Class: Ralph Creech, 88; Benjamin B. Hopkins, 104; Gordon L. Temple, 157. Sergeants: Connie M. Bunn, (See GUARD, Page 4) Cub Meeting The regular meeting of the Cub Scout pack, scheduled for tomorrow night, has been postponed to Wednesday night, June 23, according to Cubmaster R. G. Privette. The change in date was made to insure a better attendance, Mr. Privette stated. She is a Wakelon graduate. Officers Election Planned By Chamber of Commerce A new president and two new directors of the Zebulon Chamber of Commerce will be named at the chamber’s annual meeting Friday night, July 2, at 8 o’clock in the town courtroom. The mail election will be held during the next two weeks, Pres ident Ferd Davis announced yes terday, / and Secretary R. Vance Brown will be in charge of this phase of the election. The election date was set by the Board of Directors, who held their monthly meeting last Friday night. Davis Sons, Publishers Thieves Stay Cool While Taking Cash At Local Business In spite of the time and trouble that must have been required to break into the safe at J. M. Chev rolet Company last Friday night, no fingerprints were left and police and members of the Wake County Sheriff’s Department were having little success in discovering who made off with between S4OO and SSOO in cash. The building was entered through a window in the back of the garage sometime between lip. m. Friday night and 6:25 a. m. Saturday. Tools belonging to the garage were used to break open the heavy doors of the safe. Papers and checks, one for $2,- 000, were scattered over the floor when Donald Stallings, garage foreman, discovered the theft. V. Whitley and his Finer Carolina Contest committee.
