Mr. Blaine, is right when he makes the pay ment of indemnity to the families of the vie-" tims dependent upon proof of the violation of the treaty; but we shrink from thinking that, he considers that the fact of such violation still needs proof. Italian subjects, acquitted1 by American juries, were massacrea in prisons of the state without measures being taken to defend them. What other proofs docs the federal government expect of a violation of a treaty wherein csnstant protection and secur ity of subjects of the contracting parties is ex pressly stipulate? We have placed on evi dence thnt we have never asked anything else j but the opening of regular proceeding. In re- I gard to this, Baron Fava's first note, dated I March 1", contain even the formula of the telegram addressed on the same day by Mr. , Blame, uuder the order of President Harrison j to the governor of I.ouisiani. Now, however, : in the note of April 14. Mr. Blaine is silent on ' the subject which is, for us, the main point of controversy. Wo are under the sad necessity of conclud ing that, what to every other government would appear to be the accomplishment of strict civil duty, is impossible to the federal government. It is time to break off this boot less controversy. Public opinion, the sove reign judge, w ill know how to indicate an equitable solution of this grave problem. We have affirmed, and we attain nfhrm, our right. Let the federal government reflect upon its side, if it is expedient to leave to the niercy of cncli state of the Union, irresponsible to for eiini countries, the efficiency of treaties, pled ging its faitli and honor to entire nations.
