IMPEACHMENT COURT FINDS SULZERWtLT7 New York's Chief Executive Glynn Will Take the On Three Albany, N. Y., Oct 17. Governor William Sulxer was yesterday ' found guilty by the high court of impeachment on three of the articles numbers one, two: and four. He was declared .iano cent of tferiiharges contained in article three. t He will be removed from office, but not disqualified from holding office in this State in the future unless there is a substantial change in the informal vote reported to have been taken by the court on these questions in secret session. For the same reason it was expected that he wilt be found not guilty on the other four articles still remaining to be voted on when the court adjourned. Lieutenant Governor Martin H. Glynn, who has been acting governor since the impeachment of Sulzer, will become chief executive of the State. He is an Albany newspaper owner. Robert F. Wagner, a New York attor ney, will become lieutenant governor. He is the majority leader in the senate. The vote on articles one and two was 39 to 18, a bare two thirds majority. The former article charges that the gov ernor falsified his statement of cam paign contributions, the latter charges that he committed perjury in so doing The vote on article three, which charges the governor bribed witnesses to withhold testimony from the Frawley investigating committee, wasunanimou in favor of the governor, The vote on article 4 was 43 to 14, six members changing their votes on articles 1 and 2, from "not guilty" to "guilty," and two from "guilty" to "not guilty." This article charges that the governor suppressed evidence by means of threats to keep witnesses from tes tifying before the Frawley committee. New York took in and sheltered today the first survivors of the steamship Volturno to arrive in this country, 105 in num ber, brought into port by the Grosser Kurfurst, the North German Lloyd Liner that sent the first rescue boat careening across the heavy seas that made so difficult the task of removing passengers and crew from the burning Volturno. The wireless had brought graphic accounts of last week's sea tragedy; and today from the lips of some of the Volturno's survivors there came descriptions which contained the intimate detai.s for which the world had waited, accentuated the heroic conduct of the Volturno's captain, of ficers and crew, and of men who man ned the life-boats that put forth from other ships. The explosion of a drum containing chemicals was the cause of the fire according to the story told by Waldron Disselman, third officer of the Vol turno. Article 6 which charges that the gov ernor, committed larceny in speculating with his campaign contributions, was said not to have been sustained in the secret session, by a vote of 50. declaring the governor "not guilty" to seven against him. Article five, which charges that he pre vented a particular witness, Frederick L. Colwell, from attending the sessions of the Frawley committee, article sevcin, that he threatened to use his offce aid influence to affect the vote or political action of certain assemblymen, and ar ticle eight, that he corruptly1 used lis influence to affect the prices of securi ties on the stock exchange, were report ed also to have been decided in favor of the governor in the secret session By a practically unanimous vote. Ranking well up with the. bravery displayed by Captain Inch of the Vol turno, were the feats of daring of several of his officers, among them Second Officer Lloyd. While 10 ocean liners manoeuvred about the Volturno after darkness had settled on Thurs day. Captain Inch wirelessed: j. "We cant stand this long. Our boats are gone. Send boats." No rescue boats came in response to Inch's wireless. ., iM9 Then Second Officer Lloyd measur ed up to the mark. Taking four men with him he entered i a damaged life-boat, the Volturno's last, aud showed that the seas could be lived upon. Second Officer Von Carlsberg of the Grosser Kurfurst told the story of how Lloyd and his crew set the ex ample for the other ships. "Soon a light it was Lloyd's pocket lamps was seen dancing up and down on top of the waves," said Von Carlsberg, "and in a short time the Volturno's boat reached us. Second officer Lloyd and his crew were in the boat and no sooner had they boarded the Kur furst than their boat sank. In reports sent out from Beaufort during the trial of Jujjus Parker, charged with the murder of Charles Simpson at the Atlantic Hotel several weeks ago, it. was stated that "it is rumored that Simpson had been inti mate with Parker's wife and this was the cause of the killing." This report was erroneous inasmuch as the '"de fendant's wife 'was not mentioned during the trial and there was no evi dence to show that Simpson had been ntimate with her.
