A I denTBody shall be Speaker of the Student 1 Legislature, Sectipn 4: The Student Legislature shalT have Jwer to levy and collect all student fees ex ctpTatUetic fees, but total fees shall not exceed ,20 per student per calendar year, unless the total amount of fees levied is changed by a Majority vote of at least 60 of the Student Body; to appropriate funds for student cations (provided that the total funds for publications shall be allotted to the Publications Board for apportionment among the student publications), to all agencies of the student government, and to such other extra-curricular activities as to it shall seem compatible with the general welfare of the Student Body; to ratify er reject all appoint, .ments made by the President of the Student Body by a majority vote, providing that the Legislature may by law specify auch minor offices as it shall deem proper to which appoint ment shall not require ratification; to over ride a presidential veto by a two-thirds ma jority of those voting; to establish its own rules of procedure; to seat or reject members of the Legislature ; to establish such subordinate officers and committees of the Legislature as it Bhall deem proper; to make all laws governing the conduct of student elections; to. determine offenses against the Student Body, categorizing each offense, and fixing maximum and mini Bum penalties and punishments for each cate gory, and, when it deems it proper, fixing specific punishments for particular kinds of offenses; to make recommendations to the Stu dent Welfare Board concerning matters affect ing the Student Body but not within the power of the Student Body to adjust; to require re ports from the standing committees and from all organizations receiving appropriations from the Legislature; to review rules made by the Dance Committee and the House Privileges Board; to make all laws necessary and propel to promote the general welfare of the Student ertion 5: The Student Legislature shall not alter the fee structure for a given school year later than April first of the school year imme diately preceding. Thee fee collections io nized by the University at the time this con stitution is ratified shall obtain until the Stu dent Legislature alters or repeals them. Section 6: Whenever the Student Legifla" ture shall deem it possible and proper, it shall create such class organizations as it shall, deem necessary. The Legislature shall fix the duties and powers of the class organizations and the manner in which class funds shall be secured. .Section 7: The Coed Senate shall be com posed of one member for each fifty women stu dents or each fraction over twenty-five stu dents in each women's dormitory and one member for each fifty women students living elsewhere than in University dormitories. No dormitory shall be without a member in the Coed Senate, and the women studente living elsewhere than in University dormitories shall not be without a member in the Coed Senate. In addition, there shall be four members from the junior class elected by and from the coeds in the University in December of each school year; they shall serve one year. Section 8: The Coed Senate shall have power to fix the manner, mode, and time of election of the Speaker of the Coed Senate and the of ficers of the Woman's Athletic Association; to make all social rules affecting women only; to organize and conduct coed mass meetings; to elect delegates to conventions and receive their reports; to pass laws affecting women only; to determine the courts in which cases involving violations of women's social rules shall originate ; to provide such special orientation for women students as it shall deem necessary; to estab. lish an officer-training program to acquaint new coed officers with the responsibilities of their offices ; to apportion the fees appropriat ed to it by the Legislature for women's gov ernmental activities. Section 9: The presidents of the women's dormitories and the house managers of the several social sororities sitting together shall constitute the Women's Interdormitory Coun cil. The Interdormitory Council shall have power to elect its own president and secre tary., It shall be the power of the Women's In terdormitory Council to make rules governing conduct concerning dormitories for women and to enforce those rules. All permanent changes ahall be eubleet to the approval of the Coed Senate. ! Section 10: The Men's Interdormitory Coun cil shall be composed of the Presidents of the men's dormitories sitting together and the coun selors appointed by the University. The Men's Interdormitory Council shall choose its own of ficers. The Men's Interdormitory Council shall have power: to make rules affecting conduct of men in dormitories; to serve as a court of ap peal to hear cases coming up from the Men's Dormitory Councils; to speak for dormitory men in dealings with the University. The Presi dent of the Interdormitory Council shall have power to authorize and carry out dormitory elec tions and no election shall be valid without this authorization. of the Student Abticle II Section 1 : The judicial power shall be vested in a Student Council, a Men's Coundl, a Wo men's Council, the Men's Dormitory Councils, the Men's Interdormitory Council, and the Wo men's House Councils. The Student Council shall have final jurisdiction in all eases involving offenses against the Student Body. Section 2: The Student Council shall be com posed of six members elected by and from the men students, three members elected by and from the women students, and three mem bers elected by and from the student body at large. No officer of the Student Body, no mem ber of the Student Legislature, no chairman of a standing committee, and no member of either the Men's or Women's Social Councils shall be a member of the Student Council; and no per son who shall not have been a student in good standing in the University for at least one academic year shall be eligible to serve on the Student Council. The Student Council shall elect its own chairman and clerk from its membership. ' Section 3: The Student Council shall have original jurisdiction in all cases involving the constitutionality of any acts of the Student Legislature when such act has been actually violated and its constitutionality questioned by the alleged violator. The Student Council shall have appellate jurisdiction in all cases decided by the Men's and Women's Councils, the Inter dormitory Council, and the Dance Committee. Except where the Student Legislature has fixed the offense and the limitations as to punish ment, the Student Council shall have discre tionary authority, providing thatit shall take full cognizance of the traditional offenses and punishments enforced by the Men's and Women's Student Councils prior to the adoption of this constitution. Section 4 : Any student convicted by the Men's or Women's Councils, the Men's Interdormitory Council, or the Dance Committee, shall have the right of appeal to the Student Council ; and any student sentenced to be suspended from the University by the Student Council "shall have the right to request a rehearing. The rehear ing shall be held not less than three days nor more than six days alter the original con viction. Section 5 : The Women's Council shall be com posed of three Juniors, three seniors, one grad uate student, and two women students at large. The Junior members shall be elected the second Tuesday in December. The Women's Council shall have original jurisdiction in all cases of violation by women of the Honor Code, the Cam pus Code, and all lawful rules except those cases properly under the jurisdiction of the House Councils and Dance Committee. It shall hear appeals from House Council decisions. The Women's Social Council shall choose its own chairman and clerk from its membership. Section 6: The Men's Council shall be com posed of two Seniors, two Juniors, two sopho mores, one pharmacy student, one medical stu dent, one law student, one graduate student and one holdover member elected by the council finishing its term in May. The Men's Council shall have original jurisdiction in all cases of violations by men of the Honor Code, Campus Code and all lawful rules except hose cases properly within the jurisdiction of the Men's Dormitory Councils, the Men's Interdormitory Council, and the Dance Committee. The Men's Social Council shall elect its own chairman and clerk. Section 7 : The composition of Women's House Councils shall be established by the Coed Senate. No person not a member of the House. Council shall sit with it during its deliberations unless summoned to do so by the Council. Each House Council shall haye original jurisdiction in all cases involving infractions of the house rules by residents of the house. Section 8: The Men's Dormitory Councils shall be composed of the President, Vice Presi dent, Secretary-Treasurer, and all the coun selors of the respective men's dormitories. Ex cept as otherwise provided by this constitution each Men's Dormitory Council shall have original jurisdiction in all cases involving infractions of dormitory social rules. It shall have original jurisdiction in all cases involving damage to dormitory property. The Men's Dormitory Councils shall have power to make such spe cial rules concerning dormitory conduct as shall not conflict with the rulings of the Men's Senate and the Men's Interdormitory Council; and each Dormitory Council shall have power to authorize and plan all dormitory activities. Section 9 : The Student Council and the Men's and Women's Councils shall make and" publish their own rules of procedure, but these rules shall not deny to any accused person the pre sumption of innocence until guilt is proven, the right to due notice and a fair hearing, the right o fthe accused to face bis accuser in the Stu dent Council, but not necessarily in the Men's and Women's Councils, and the privilege of assistance by a member of the Council, if re quested. The Council shall inform each accused party of his rights guaranteed under this sec tion at the time he is notified of the offense charged against him. The Student Council and Men's and Women's Councils shall have power to mitigate and suspend sentence and impose probation in particular cases when such action is deemed advisable. Article III Section 1: The executive power shall be vested in a President of the Student Body, who shall have the assistance of a Vice President and a Secretary-Treasurer of the Student Body. The three officers of the student body shall be elected by and from the Student Body at large. Section 2: The President of the Student Body shall have power to appoint the chairman and members of all standing committees and boards not otherwise provided for in this con stitution; to appoint the chairman and mem bers of the Board of Elections ; to make recom mendations from time to time to the Student Legislature i to administer and enforce the laws enacted by the Student Legislature; to veto acts of the Student Legislature, provided he shall exercise such power of veto within ten days after the passage of an act by the Legis lature; to call and preside at meetings of tha Student Body; to serve as an eas officio mem ber of all standing committees and boards; to address the Student Legislature from, time to time, provided that he shall notify the Speaker of his intention in advance; to issue orders to the standing committees and require reports from them; to represent the Student Body of the University of North Carolina in all dealings with the students of other schools, colleges, or universities, in all dealings with the faculty, and in all dealings with the Board of Trustees; to establish such bodies subsidiary to him as he shall deem. necessary and proper to aid him in the performance of his duty. Section 3: The Vice-President of the Stu dent Body shall perform the duties of the President in the event of his absence or in capacity. He shall succeed to the presidency should that office become vacant The Student Legislature shall by law provide for the filling of -the office of President should a Vice Presi dent who has succeeded to the presidency also vacate the office ; but the Speaker Pro Tempore of the Student Legislature shall not succeed Body of VOTE FOR THE FOR BETTER STUDENT GOVERNMENT Printed here is the proposed Constitution of the Student Body, as amended and approved by the student legislature, and in the form which will be presented to the student body for ratification. The Daily Tar Heel urges your support of this constitution. Both the Student Party and the University Party have joined the student legislature in endorsing this constitution, and it is approved by the great majority of student leaders. It has not yet received the approval of the faculty and administration, but they have not officially opposed it. This constitution guarantees to every student the right to face his accuser in the higher student courts, and it insures many other student freedoms. All agencies are co-ordinated into one systematic governmental "Organization, and full powers of initiative, referendum, election, and recall are completely in the hands of the student body. Allegiance to the honor code and campus code is demanded by the-constitution, and every student will be guaranteed an equal share in the benefits of stu dent democracy. to the Vice Presidency or the Presidency. The Vice President of the Student Body shall be Speaker of the Student Legislature. Section 4: The Secretary-Treasurer of the Student Body shall accurately record and pre serve the minutes of all meetings of the Stu dent Body. He shall disburse all monies ap propriated by the Student Legislature, and he shall be chairman of the Budget Committee. Section 5: The Student Audit Board shall be composed of a chairman and four members ap pointed by the President of the Student Body and confirmed by the Legislature. The members of the Student Audit Board shall have experi ence or training in business methods. The Student Audit Board shall supervise the Stu dent Activities Office; and it shall require all organizations receiving funds by appropriation from the Student Legislature to operate their funds through the Student Activities Office. Any other student organization shall have the right to operate its funds through the Student Activities Office; and the Student Legislature may grant the Student Audit Board authority to examine the books of any other student or ganization when conditions warrant it. It shall have power to inspect the books of any organization coming under its jurisdiction. The Student Audit Board shall from time to time on request of the Student Legislature supply such information as the Legislature shall specify concerning the financial condi tion of the organizations under its jurisdic tion. The Student Audit Board shall have power to conduct such investigations of the expenditures of -organizations under its control as it deems necessary and report its findings to the Student Legislature. It shall assist the Budget Committee of the student government in every way possible; and it shall make a semi-annual report of its activities to the Leg BOTH PARTIES WANT CONSTITUTION Dear Morrison, At last the long-awaited campus constitution is ready for a student body decision. Many of us have worked hard and long over it and are glad to see it in its final stages, approaching either acceptance or rejection. We feel that at this point we would like to ask the student body to take time out from their individual interests and cast their vote on this document. Our request is only that they get to the polls and cast their vote one way or the other. As you know, it will take a minimum of 25 of all of us here in school voting before the issue can be settled. On that basis we are encouraging reach that required percentage, but also to make it a complete turnout for such an important decision. . In two weeks the campus will again be voting, but then it will be for their officers for the coming year. At this writing we can't know whether those officers will be elected under our pres ent governmental system, or whether they will fall under the provisions of the constitution. In any case we want to assure the campus that both of us will strive to make this a clean campaign and election, and will do all in our power to lead our respective parties toward that goal. Section 6 : The Dance Committee shall be com posed of the Secretary-Treasurer of the German Club, the Exchequer of the Grail, one student each from the School of Law, the School of Medicine, the School of Pharmacy, the Inter fraternity Council,' the Men's Interdormitory Council, the German Club, and the Order of the Grail, appointed by the Dance Committee from a list of three submitted by the elected student head of each of the above-named groups, and three members-at-large from the Student Body, appointed by the Dance Committee and con firmed by the Student Legislature. No freshman shall be a member of the Dance Committee. The Dance Committee shall have power to make rules concerning conduct at dances, sub ject to review by the Student Legislature, and shall try all cases of violations of Rules. The Dance Committee shall enforce the rules con cerning dances and shall report all violationsDf the rules to the appropriate student judicial body. The Dance Committee rules in force at the time of the ratification of this constitution shall remain in force until changed by the Dance Committee and the Student Legislature. Section 7 : The House Privileges Board shall be composed of the five members of the Execu tive Committee of the Interf raternity Council, and the Speaker and two members of the Coed Senate, one woman from the Woman's Coun cil elected by that bo3y, and one coed member-at-large appointed by the Speaker of the Coed Senate. It shall have power to make all rules concerning coed visiting privileges in fraternity houses, subject to review by the Student Legis lature. The chairman shall be the Secretary-Treasurer of the Student Body, and the members shall be appointed by the President of the Student Body and confirmed by the Student Legisla ture. The Budget Committee shall include per sons with training in business methods as well as persons with broad experience in student government. At least two of the members of the Budget Committee shall have passed a course in accounting. The Budget Committee shall annually propose a tentative midget to the Finance Committee of the Student Legislature. It shall make thorough investigations and hold open hearings before Vj"g- detailed recom mendations concerning the amount of student fees to be levied, the manner in which these fees should be expended for student govern ment, student publications, the Graham Me morial Student Union, and for such other student extra-curricular activities as the Budg et Committee shall deem wise and proper. Section 9 : The University Club shall be com posed of one member elected by and from each men's dormitory, each women's dormitory, each fraternity, and each sorority on the campus. Dormitory members shall not be members of a fraternity or a sorority. The TTnlversity Club shall elect its own officers. It shall be the pur pose of the University Club to promote in terest in campus activities and to encourage a high spirit of sportsmanship and school spirit in all University events and contests, to be responsible for meeting and entertaining all visiting intercollegiate, high school, and preparatory" school teams in conjunction with other agencies on the campus. The Club may designate honorary members by a two-thirds Vote of the members.' Such honorary members, including faculty members, shall be non-voting members and shall not be eligible to hold office in the club. ' Section 10: The Student Entertainment Committee shall be composed of a chairman and three student members appointed by the President of the Student Body and confirmed by the Student Legislature, one faculty mem-ber-at-large elected by the student members of the committee, one faculty member from the music department and one faculty member from the dramatic art department, both se lected by the student members of the com mittee. It shall be the duty of the Student Entertainment Committee to expend the funds appropriated to it by the Student Legislature in a manner designed to provide the campus, with a variety of suitable entertainment. Section 11:. The Campus Orientation Com mittee shall be composed of a chairman and nine representative men and women studente appointed by the President of the Student Body and confirmed by the Student Legisla ture. It shall be the duty of the Orientation Committee to devise and conduct an adequate program of orientation for all entering stu dents, and to assist the Coeds' Senate in carry ing out such special programs of orientation as, after consultation with the Orientation Com mittee, they shall devise. Section 12: The Student Legislature shall fix the student offices which shall carry with them automatic membership on the Graham Memorial Board of Directors, and the Chan cellor of the University shall appoint the fac ulty members of the Board. The Graham Me morial Board shall be the governing body of the Graham Memorial Student Union. Section 13: The President of the Student Body shall make all initial committee appoint ments and submit them to the Student Legis lature within five weeks of his inauguration. Section 14 : Members of each year's cheering squad shall hold try-outs in the spring quarter and select from these persons, who try out, the members of the squad for the following year. The Head Cheerleader shall be elected by and from the Student Body at large. Abticle IV Section 1: Financial supervision of all stu dent publications financed by funds collected by authority of the student legislature shall be vested in a Publications Board. The Editors-in-Chief of the various publications shall appoint the Managing Editors, Circulation Managers, Business Managers with the approval or rejec tion of the Publications Board. "Either the Pub lications Board or the Editor of the publica tion concerned shall have the power "to remove the Circulation Manager, the Managing Editor, and Business Manager if they deem it necessary. The Publications Board shall fix the salaries of Circulation Manager, Business Manager, and Managing Editors of all student publica tions ; require . reports from them ; have their accounts audited; and recall and re place inefficient Business Managers. The Publications Board shall fix the salaries of all other paid officers of the student publications in consultation with the editor of the pub lication concerned. The Publications Board shall make all contracts involving student pub lications, control the expenditure of all pub lications funds, make an annual report to the Student Legislature of all financial activities. and make such special reports as the Legisla ture may from time to time require. The Pub lications Board shall meet at least ence each quarter and more often when necessary. On or before March first of each year the Pub lications Board shall submit a proposed budget for the next fiscal year to the Budget Com mittee and shall send a copy of the publica tions budget to the Chairman of the Finance Committee of the Student Legislature. 'Section 2: The Publications Board shall be composed of four student members elected by the Student Body and two faculty members appointed by the Chancellor of the University of North Carolina at Chapel Hill. Two of the student members shall be from the rising senior class, one from the rising junior class; one shall be from the Student Body at large. They shall serve a one-year term. The faculty members of the board shall be ap pointed for a two-year term, and they shall assume their duties on January first of the years in which their terms begin. Of the first two faculty members so designated one shall begin his term immediately upon his appoint ment and serve until December thirty-first of the year succeeding that in which he shall have been appointed; and the other shall begin his term immediately upon his appointment and serve until December thirty-first of the year next succeeding that in which the term of the first faculty member shall have expired. The Publications Board may make recommen dations to the Chancellor concerning these ap pointments. The Board shall select its own officers. Section 8: The Publications Board shall In no way interfere with the Editors-in-Chlef of the various publications in the performance of their duties, including the appointment of the staffs. Section 4: The Editors-in-Chief of the var ious student publications shall be elected by the Student Body. No person who has not worked on a publica tion for at least six months shall be eligible for nomination as Editor-in-Chief of that publica tion, but no student shall be denied the right to work on the publication of his choice and the editor of any publication shall have the right at Chapel Hill to remove any staff member for incompetence. Amuom V Section 1: Power to administer the lawa passed by the Student Legislature governing conduct of elections shall vest in a Board of Elections. The Board of Election, shall consist of a chairman and ten members appointed by the President of the Student Body and ratified by the Student Legislature. The President of the Student Body shall make these appoint ments within five weeks after his inauguration, but no more than five members shall be of on political party. Section 2: The Board of Elections shall ad minister aH laws governing elections passed by the Student Legislature, and shall conduct all elections for the Student Council, the Men's Council, the Women's Council, the Coed Senate, all officers of the Student Body, members of the Student Legislature, officers of Carolina Athletic Association, and such class elections as the Legislature shall establish. The Board of Elections shall supervise and conduct such special elections as may be necessary to fill vacancies in office. Section 3: General campus elections shall be held annually on the first Tuesday in May which the Univresity is in session. All office listed above in section 2 shall be filled by elec tion at the General Campus Elections. All election laws in effect at the time this consti tution takes effect and not in conflict with thk constitution shall continue in force until the Legislature shall make new laws pursuant to this constitution. Section 4: All officers chosen in the Gen eral Campus Elections shall be duly inaugurat ed on the third Tuesday in May on which the University is in session. Each officer shall take an oath to uphold, protect, and preserve thia constitution and the government thereby created. Article VI Section 1 : Any constituency shall have power to recall any officer elected by that constitu ency under this constitution. If the constitu ency is campus-wide, the petition to recall shall be' handed to the Speaker of the Student Legislature and shall not be valid unless it con tains the signatures of at least ten per cent of the qualified voters. If the constituency is less than campus-wide, the petition to recall shall not be valid unless it contains the signatures of at least twenty-five per cent of the qualified voters. Any officer so recalled shall have the right to be a candidate for the office from which he shall have been recalled in the ensuing elec tion. Scetion 2: Tht Student Body shall have power to initiate any act within the power of the Student Legislature; the women stu dents shall have power to initiate any act within the power of the Coed Senate; provided that ten per cent of the qualified voters in the group concerned shall sign a petition calling for an election within that group on a bill which they shall submit in writing with the petition to the President of the Student Body. The President shall, if he determines the petition to be in good order within the limitations of this constitution, di rect the Board of Elections to conduct an elec tion on the bill in not less than six nor more than fifteen days after he shall have received the petition and bill. Public notice of such election shall be given not less than four days before it shall take place. Section 3: The Student Body shall have power to call for a ballot on any act of the Student Legislature; the women students shall have power to call for a ballot on any act of the Coed Senate. A majority of the votes cast ' at the election shall be sufficient to pass the bill, provided a petition calling for the ballot and specifying in writing the act on which the referendum is to be taken shall be signed by ten per cent of the group con cerned and transmitted in writing to the Presi dent of the Student Body. The President shall, if he determines the petition to be in good order within the limitations of this constitu tion, direct the Board of Elections to conduct an election of the act in not less than six nor more than fifteen days after he shall have re ceived the petition. Public notice of such elec tion shall be given not less than four days be fore it shall take place. A majority of the votes cast at the election shall be sufficient to pass the bill. Section 4: No group or organization on the campus of the University of North Carolina shall coerce or in any manner unduly influ ence any student's vote. The Student Legisla ture shall have power to make laws to enforce this provision. Section 5 : Neither the Student Legislature of the University of North Carolina, nor the Coed Senate shall make any law abridging or denying the freedom of the student 'press or any other freedom guaranteed by the Constitution of the United States to citizens of the United States or by the Constitution of the State of North Carolina to citizens of North Carolina. ' Section 6 : It shall be the duty and responsi bility of every student at the University of North Carolina to obey the Honor Code pro hibiting lying, stealing, or cheating and to re port any lying, cheating, or stealing of which he has knowledge, and it shall be the further duty of every student to abide by the campus code, namely, to conduct herself or himself as a lady or a gentleman at all times and insofar as it may be appropriate that his fellow students do likewise. Section 7: This constitution and all laws enacted pursuant thereto shall be the supreme student law. Article VII ' Amendments to this "constitution shall be come valid when passed by a simple majority in the Student Legislature and ratified by a two-thirds vote majority of those voting at a campus election conducted by the Board of Elections at the direction of the Student Legis lature; or they shall become valid when, upon petition in writing signed by ten per cent of the duly enrolled students in the University of North Carolina, the President of the Stu dent Body shall direct the Board of Elections to conduct an election in which a favorable vote of two-thirds of those voting shall be necsesary to ratify the amendment. Public notice of such election shall be given by the Board of Elections not less than six days be fore the vote shall be taken.
