A bill that would expand North Carolina's open
meetings law was introduced in the General
Assembly last week by House Speaker Carl
Stewart and Rep. Patricia Hunt, D-Orange.
The legislation would require official meetings
of legislative, regulatory, executive and
administrative or quasi-judicial governmental
agencies, with only a few exceptions, to be open to
the public.
Included in the law would be the Council of
State, the Advisory Budget Commission (ABC)
and the Legislative Services Commission-

U.S. Rep. Jim Martin, R-N.C, said
Saturday that the recent saccharin
controversy has earned him the reputation of
being the sweetest guy on Capital H ill
Martin has drafted a bill that would lift the
Food and Drug Administration (FDA) ban
on saccharin as a cancer-causing substance.
The 9th District representative was guest
speaker at a banquet concluding a weekend
convention of the N.C. Confederation of
College Republicans. The UNC Young
Republicans Club hosted the convention,
held at the Holiday Inn.
Martin said the results of a Canadian
study showing that saccharin in large
amounts causes cancer in rats cannot
necssarily be projected to humans. He cited
several studies with humans done in other
countries and in the United States showing
that saccharin is not carcinogenic, or cancer
causing, in humans.
"It is very clear that saccharin is safe in a
normal amount," Martin said.
Martin's bill does not call for the repeal of
the Delaney Amendment, the FDA
regulation which calls for the ban of any
food additive shown to cause cancer.
"It (the bill) allows the secretary of health,
education and welfare (HEW) to make
exception to the Delaney Amendment if he
makes a finding that the public benefits
outweigh the public risks... The Delaney
Amendment is absolute," he said.
Martin explained that under the present
regulations a substance would be banned if
one test showed it caused cancer, even if 10
others showed it did not. He said the bill
would allow all evidence to be taken into

before retiring to go into private business.

The bill would also establish both civil and
criminal penalties for violations. No such
provisions are included in the current open
meetings law passed in 1 97 1.
Anyone who knowingly violates the bill's
provisions would have to pay a $250 fine or serve
six months in jail or both.
Civil penalties of up to $200 per violation could
also be imposed.
Any acti6n taken by an agency, commission or
board in violation of the measure would be.
voided.
Under the present law, written by Stewart, the
only action available to the public is to seek a
consideration.
Martin said the situation of diabetics and
others who must restrict their sugar intake
should be considered.
"If anything, you've got a lower incidence
of cancer," he said. "Obesity predisposes
people to cancer." From this viewpoint, he
said, saccharin is actually preventive
medicine.
The Congressman added that the ban
ignores the consumer's right to make
decisions of his own. He suggested that a
warning be placed on . saccharin and
products containing the substance.
"If you get to banning, then you've
practically got to ban the whole food
supply," he said. He named several foods,
including grains, milk, eggs and processed
meat, that contain detectable carcinogens.
"The most carcinogenic substance we
know is found in minute, but detectable
amounts in peanuts," he said.
Martin said the American Diabetes
Association, three former FDA
chairpersons and the chairperson of the
American Cancer Society support his bill.

He said he had been aware of the
limitations of the Delaney Amendment for
four years, but he could not challenge it
without a test case such as this.
Martin also challenged the College
Republicans to join in Congressional fights
again mandatory membership in labor
unions.
"We've got to continue involving working
men and women on the grassroots level," he
said. "Rank and file labor workers are not in
favor of having to join a union, even those in
unions."

"The bill is Carl's idea," Hunt said Sunday. "He
wrote the original bill in 1 97 1. He's a very great
believer in open meetings, and so am 1."
H unt said the penalties were added to the bill to
get the attention of boards affected by the law. "I
will be very surprised to see the criminal penalties
stay," she added.
She said opposition to the bill will probably
come from local governments, many of the state
commissions and university boards. "Many
boards believe there are things they can do better
in executive (closed) session," Hunt said.

In the bill, agencies would be permitted to hold
executive sessions to discuss property
transactions, litigation or judicial action, matters
concerning patients or privileged relationships
such as those between a doctor and patient or
lawyer and client, employee considerations,
student discipline, riots or other public disorders.
The bill exempts the courts; all law enforcement
agencies; state agencies, commissions or boards
making judicial rulings; and licensing boards.
Local zoning boards would not be exempted.
The legislation also would p'rohibit the agencies
