Franklin St.' Hours1 Downtown Chapel Hill If 1 J 1 1 Rodin document filed but forgotten By CHIP PEARSALL Stuff Writer Sometime during the summer of I976, a legal document which could have affected considerations by the Chapel Hill Board of Aldermen on the controversial l.aketree community was filed away in the town planning office. The document lay in the file, forgotten, for over a year while debate on the 387-acre planned community raged before the board and in the community. Developers Sylvia Rodin and Gertrude Groten had presented l.aketree as an answer to spiralling growth in town an answer which some called the best-planned development in the history of Chapel Hill. After public hearings, planning board sessions, aldermen meetings and political jockeying, the project came to a vote. It was defeated by a 5 to 4 vote by the board Sept. 12. The legal document, a judgment rendered in federal court against Rodin's husband, Eugene, in June 1976 for grand larceny involving a New York land fraud, lay still unrevealed in the town planning office. On Friday, Art Berger, the planning staffer who originally filed the document, brought it forward. Wallace requested information on developers Groten and Rodin Thursday. Wallace revealed the document to the Board of Aldermen, the Planning Board and the local press Tuesday afternoon. Accompanying it were copies of other documents Wallace obtained regarding the Rodin case. "While the document may have no direct legal bearing on the merits of it (Laketree), it is nevertheless, in my opinion, highly significant and relevant," Wallace said. "It disturbs me that it was not brought to our attention at an earlier date." "The fact is that somebody made a mistake," Planning Director Mike Jennings said Wednesday. Jennings said Berger received the copy from a lawyer interested in the Rodins, then filed it thinking it was not a pertinent question in the department's Laketree considerations. Alderman Gerry Cohen said Wednesday he might have voted against the project, but cited an Orange County Superior Court decision in a similar case. The court, he said, ruled that Carrboro could not deny permission to a developer with a criminal record to build in that town simply because of the conviction. Alderman Thomas Gardner said he had not decided what the legal effect of the court judgment against Rodin would be in the board's review of Laketree.
