The decision overturned a district court decision in which Maryland Public Interest Lenoir Hall vandalism reported A door on the first floor of Lenoir Hall was vandalized sometime between Friday afternoon, Dec. 2, and Monday morning, Dec. 5, according to University Police. Someone cut a design in a door leading into the AFROTC and art deparlments, police said. Pam Barefoot, of 326 Parker Dorm reported that she lost a purse in 103 Person Hall. Barefoot left a class lor five minutes, returned and found her board Friday also told the board that Tatel had assured him HEW would not take away UNC's federal funds if the department was sure UNC was acting in good faith to fulfill the 150-percent goal. The Board of Regents for the University of Maryland approved of the Student Government Association's allocation for the Maryland PIRG on the condition that no purse missing, police said. The purse contained $30 in cash, a dorm key, ID card, driver's license and checkbook. University Police also reported that an undetermined amount of cash was removed from three newspaper stands on campus. Chapel Hill police reported they had two suspects in custody who admitted to one of the thefts. The Maryland PIRG sued the board on the basis of the First Amendment, which provides the right to petition the government for redress of grievances. A district court judge ruled in favor of the Maryland PIRG. In the opinion which overturned that district court decision, Senior Circuit Judge Albert V. Bryan wrote that by denying the Maryland PIRG the right to use student fees for litigation, the University of Maryland had not infringed on the group's right to litigate, but only had prohibited one means of financing the court cost. "In reality, the plaintiff is asking the board to finance the plaintiffs assertion to the Amendment," Bryan wrote. The UNC Legal Services has a similar restriction on its use of student fees for litigation: it cannot use these fees to sue the University. This restriction came about by way of compromise with the University and the N.C. "Most of my time is spent in my office counseling and advising people of their rights." Bernholtz said she has gone to small claims courts from time to time to represent students. "The University has allowed the Student Legal Services to go forward," she said. Part of that forward motion has included the use of student funds for litigation in matters under $500. In the circuit court's opinion, the use of student funds for litigation may result in court action of which some students who payed the fees disapprove. Senior Deputy Attorney General Andrew Vanore said he feels this is a weak part of the ruling. "Students may disagree with what the Daily Tar Heel says, but the University still recognizes the right of the paper to publish," Vanore said.
