WASHINGTON HEW has told the
NAACP Legal Defense and Education Fund
UNC is entitled to a hearing before any cutoff
of federal funds to the system.
UNC and HEW are currently at a standoff
over a desegregation plan for the 16 campuses
in the University system. The schools stand to
lose about $89 million a year in federal funds.
Earlier in the week, the Justice Department
asked the U.S. District Court to reject a
motion by Fund attorneys that would bring an
immediate cutoff of federal funds to the
University.
The Justice Department said in a response
filed late Monday, neither the court not HEW
can take such action until administrative
proceedings currently under way against UNC
have determined that the University operates a
segregated system.
chancellor Raymond Dawson said. "But they
also have an interest in the University system."
Friday said he has not talked with HEW
officials since the negotiations are being
handled by lawyers for the University.
Last week Friday met with four black
legislators to brief them on the latest
developments in the HEW controversy. Rep.
Kenneth Spaulding, D-Durham, asked Friday
a number of questions concerning facultv
guidelines.
Union President Frank Fitzsimmons
refused to say whether he thought the package
fell within the guidelines, leaving that to the
government. "1 can't figure their arithmetic,"
Fitzsimmons said after the two sides settled
Tuesday.
The agreement must be ratified by union
members, a process that takes four to six
weeks. "I'm sure they'll be satisfied with this
agreement," Fitzsimmons said. "At least I
hope so."
Union officials say the possibility that
members will reject the pact is a remote one.

HEW also argued the Legal Defense and
Education Fund has no right to ask the court
to stop aid to the 1 1 predominantly white UNC
schools.
"Plaintiffs cannot be allowed to simply
ignore the fact that a third party's rights are
being adjudicated in its absence," the HEW
brief said.
HEW secretary Joseph Califano, launched
the administrative proceedings on March 29
aimed at cutting off federal aid to UNC.
North Carolina has 20 days from that date
to reply to the contention by HEW that UNC
still runs its campuses in a manner that has

could take months, but Califano has said a
limited cutoff of $ 10 million to $20 million will

Tornado dead, injured rising
WITCH IT A FALLS, Texas (AP) Emergency crews strung lifelines
Wednesday to splintered neighborhoods in this north Texas city and three
other "Tornado Alley" towns hit by tornadoes that killed at least 60 persons
and injured more than 800 others.
Texas Gov. Bill Clements said the cost to rebuild would run between $200
million and $300 million.
The Department of Public Safety reported 44 bodies had been found in
Wichita Falls by noon, plus 1 2 in Vernon and one in Harrold, a few miles to the
west. Across the Red River in Lawton, Okla., three more were counted dead.
Galifianakis indicted for perjury
WASHINGTON (AP) Former North Carolina Congressman Nick
Galifianakis has been indicted on charges stemming from allegations of South
Korean influence-buying in the United States.
A federal grand jury Tuesday accused Galifianakis of perjuring himself in
testimony before the House ethics committee last year.
In the indictment, Galifianakis was accused of denying under oath that he
received $10,000 in cash from South Korean rice dealer Tongsun Park. The
indictment said he received the money tr hough "an aide to his 1972 senatorial
campaign.
He faces up to five years in prison and a $2,000 fine if convicted.
Radioactive waste stopped at border
COLUMBIA, S.C. (AP) Two trucks carrying radioactive wastes from the
Three Mile Island nuclear plant near Harrisburg, Pa., toward Barnwell, S.C,
were turned away by South Carolina health officials.
Heyward G. Shealy of the Department of Health and Environmental
Control said Tuesday he ordered the trucks not to enter South Carolina after
representatives of Chem-Nuclear Systems Inc. told him highly radioactive
wastes from the damaged Three Mile reactor were in one truck.
The wastes were en route to a Chem-Nuclear site near Barnwell, where they
were to have been buried in the containers they were shipped in, Shealy said.
Shealy said the trucks were supposed to contain low level radioactive wastes
from the Pennsylvania plant's number one reactor, which was not damaged in
last month's accident.
But the DHEC official said apparently some highly radioactive water from
the seond reactor, which was damaged, mingled with wastes from the first unit.
New safety measures needed for nukes
WASHINGTON (AP) The Three Mile Island accident has revealed the
need for new safety measures that could affect nearly half the atomic power
plants in the country, the Nuclear Regulatory Commission staff said
Wednesday.
The commission staff declared the accident requires consideration of
additional safety measures on a priority basis, and the agency expects to issue a
new directive to the industry Thursday.
Cold shutdown in the nuclear reactor at Three Mile Island could begin within
a week, Harold Denton, NRC operations chief, said Wednesday.
Denton told reporters that if tests show the amount of gas dissolved in the
primary cooling system water has been reduced to a safe level, technicians could
start the NRC-approved cooldown plan formulated by Babcock and Wilcox,
builder of the plant.
Somoza prepares assault on Esteli
MANAGUA, Nicaragua (AP) President Anastasio Somoza's national
guard moved troops and armored vehicles around the guerrilla-occupied city of
Esteli Wednesday, apparently preparing for a major push to capture it. .
Reliable sources said the national guard, Sombza's 10,000-man army,
controlled the Pan-American Highway on either side of town, the garrison and
ah airport on the outskirts.
More than 400 Sandinista National Liberation Front guerrillas sworn to
oust Somoza were reported barricaded inside the Esteli. Red Cross sources
estimated 5,000 of Esteli's 35,000 residents had fled the city 90 miles north of
Managua since it was overrun by guerrillas.
