March 29, Judge seeks options By MELISSA MOORE Slatf Writer Imprisonment should not be the only available method of punishment in our criminal justice system, said Judge Willis P. Whichard of the N.C. Court of Appeals and chairman of the N.C. Commission on Alternatives of Incarceration. Whichard, a former UNC law student, spoke to an audience of about 45 Friday afternoon at the UNC School of Law. The prison system has many problems, Whichard said. One is the high cost of im . prisonment. "It costs us at least $8,000 per prisoner per year," he said. This amount does not include the cost of construction of prison cells or hidden costs such as of fenders' inability to pay restitution or to support their families. "There's no prospect for change in that (cost) if we continue to incarcerate at this rate," he said. Whichard said the prison system is an appropriate one for people who commit violent crimes but that "violent offenders constitute a small minority of those we in carcerate," and offered alternatives to imprisonment. One of these is restitution in which the offender pays the victim. The danger in this is that affluent people could buy their way out of prison; thus the challenge would be to find a means appropriate for both the victim and the offender. Another option is restitution to society, since crime harms both the victim and society, Whichard said. The offender could be required to work in areas of public need, thus losing time not money doing things for society which it would otherwise have to pay for or do without. Whichard also said, "We could expand the use of fines (that would benefit society), as punishment" but the amount of the fine should be based on the seriousness of the offense and the ability of the offender to pay. Otherwise, the practice would be discriminatory, he said. Whichard also named probation as a possible alternative to incarceration, ad ding that the cost of probation is $1 per day as opposed to the. $8,000 per year cost of imprisonment. Hill Community Church. Drinan, a former Massachusetts Con gressman and current President of Americans for Democratic Action, spoke before a group of about 200 members of the North Carolina Civil Liberties Union. Drinan refuted the assertion by President Ronald Reagan's administration that Salvadoran rebels are infiltrated by Com munists. "By centering on El Salvador and saying this is a confrontation between East and West (Reagan) shows the ridiculousness of the entire foreign policy approach of the ad ministration," Drinan said. The civil war in El Salvador is a "confronta tion going back 50 to 60 years ... and t,he alleg ed infiltration of Communists or Cubans really has nothing to do with (the civil war) at all," Drinan said. . There are "no choices to make. "You can vote for the right or the far right." Drinan said he expected the Reagan ad ministration to attribute the absence of the left in Sunday's election to their fear of losing. The real reason for the void of liberal alternatives, Drinan said, was a fear of death, not defeat, because liberal candidates would have been placed on the military's "hit list." "The U.S. in effect is supervising an election which we know ahead of time can't really be a free election," he said. Drinan said Reagan's foreign policy is; resulting in a re-emergence of a "Red Scare ... and the test somehow is in El Salvador." "The Red Scare came about in the 1950s because (the late Sen.) Joe McCarthy was say ing 'Who lost China?'," Drinan said. "Will -we have in this country today "Who lost El Salvador?" study juana. Although marijuana and drinking com bined may have contributed to 25 of the ac cidents, McKay said only one of the drivers was affected by marijuana alone. Author ay accelerated arms race should cease By ROSEMARY OSBORIS Staff Writer "We fool ourselves into believing more weapons will ward off an attack," said Richard Barnet as he delivered a speech Thursday entitled "The Future in Our Hands Freeze the Arms Race." Speaking to a near capacity crowd in Gerrard Hall, Barnet said it is time to say "enough is enough" to the arms race be tween the United States and the Soviet Union. " Barnet, author of Who Wants Dis armament and Real Security, said, "we all fall into the trap of using Orwellian language and say there is safety where there is no safety. "The. myth of defense where there is no defense is the most dangerous way to des troy the hope of a nation," Barnet said. He explained that both the United States and the Soviet Union build weapons in hopes of keeping the other nation in fear. But, he said, one nation cannot build ' enough weapons to make it safe from the ' other nation. , The "myth of deterrence" is also of concern to us Barnet said. "One has to assume one is dealing with rational peo ple. Agreements must be based on an un derstanding of reality. There are 20,000 weapons aimed at the Soviet Union and if this isn't enough, 300,000 won't be enough. What divides hawks and doves is k view of human nature which rests on the idea of reaching a magic number of casualties. "It has been the policy of the United States to reserve the right to use nuclear weapons in the face of a non-nuclear at tack. That is the policy our defense has been based on." ' ' Barnet said the Soviet Union did not enter the arms race until after the Cuban Missile Crisis. Before this time, the United States was in a race against itself, he said. When the Soviet Union gained the abi lity to destroy the United States, the United States lost its superiority. Barnet maintained that the arms race became useless from this point onward because neither side could really get an advantage in its defense. Barnet said it was a myth that a side could spend enough on defense to be safe. He criticized the Reagan admini stration for taking the attitude that in creased spending would mean increased national security. "Enough is enough. We can afford to take a breather. We can develop an al ternative defense system," he said. Bar net said he favored a freeze on the arms race. "A freeze at least creates the space where we can come up with something more acceptable."
