Jury chose Green's word over FBI agent's

RALEIGH Jurors who acquitted Lt. Gov. Jimmy
Green on charges of accepting a bribe and agreeing to
accept others had to choose between believing the state's
second highest elected official or an FBI undercover
agent.
They chose Green, who said he immediately was sus
picious of agent Robert J. Drdak. Green said he kept
meeting and questioning Drdak to learn the agent's iden
tity and intentions.
Drdak testified that Green asked him how he might re
ceive money and make it look legitimate. Drdak said he
believed Green twice agreed to take bribes of $10,000 a
month, agreed to take a $2,000 bribe and received a
$2,000 bribe.
. During the 10-day trial that ended Friday with Green's
acquittal, defense attorneys challenged the credibility
and undercover techniques of Drdak and the FBI itself.
In arguments, they compared the trial to the "Boston
witch hunt" but refused after the verdict to say whether
the case should have been tried.
"I'm willing to let history tell us what was behind it if
anything was behind it," defense attorney Wade Smith
said.
"I do not believe the government went after anybody
intentionally," said special prosecutor Jim Blackburn,
the U.S. attorney when Colcor began.
Robert Pence, FBI agent in charge of North Carolina
operations, said no individual was the target of the in-
vestigation and agents simply followed leads as they
developed.
Roger A. Schweickert, the FBI supervisor of the
$100,000 Colcor investigation, said the probe required
approval at many stages from state FBI headquarters in
Charlotte and national headquarters in Washington,
where there was a legal advisor.
He said it was decided to meet with Green after his
name was mentioned several times by other Colcor sub
jects. Green's attorneys say the FBI hounded him and based
the case on "a carefully drafted plan of innuendos and
statements less than true."
Defense attorney Howard Twiggs said Green repeat
edly told Drdak that his position was "not for sale at any
price to anyone."
"What does 'no mean to the FBI? Why did they con
tinue to hound the man?" Twiggs asked.
"I think some of the statements about the FBI mad6
by defense attorneys probably were for the purpose of
assisting the case for their client," Pence said in a tele
phone interview. "There are those who probably don't
agree with this type of undercover investigating tactic."
Pence said undercover investigations are used only
where witnesses refuse to come forward.
"Until something better comes along that is not so ob
jectionable we're going to work it as long as we think it's
proper," he said.
Questions also were raised about the FBI's failure to
record the first meeting between Drdak and Green and
the poor quality of a tape-recorded telephone call be
tween the two.
Drdak testified that FBI agents seldom wear body re
corders on the first meeting with a subject because they
have no idea about security precautions.
He said Green's voice cannot be heard in the tape of
the telephone call because the $4 microphone attached to
the phone malfunctioned.
"We've got something that J. Edgar Hoover would
turn over in his grave if he could see a citizen of this
country prosecuted for a five-year felony with this kind
of evidence," Twiggs said in closing arguments.
"The leads as they occurred were followed to the best
of the agent's ability," Pence said. "If that information
was not sufficient, if it was not persuasive to the jury
that's the beauty of the American system."
The indictment and prosecution of Green cost tax
payers more than $90,000, according to preliminary
estimates from court officials.
Green said he would have a statement this week about
how much the trial cost him personally. "The people of
North Carolina deserve to know," he said after his ac
quittal. L. Sneed High, a Fayetteville lawyer and a former
legislative colleague of Green, set up a Jimmy Green De
fense Fund in August. High declined to say how much
money was raised or how much was needed.
Months before he was indicted, Green said, "I would
think that the people of North Carolina would be tired
of the taxpayers' money being spent in this manner."

elections, you can vote in a new absentee
voting system.
The new one-stop absentee voting
system was implemented by the Orange
County Board of Elections. It deletes the
former lengthy process of several mailings
for absentee voters.
The new system requires voters to go to
Carrboro Town Hall and fill out their
ballot there. This special voting process
will continue through Thursday, Nov. 3.

to end eight years of turmoil, politi
cians said the reconciliation conference
was the last chance for Lebanon to sur
vive. State-run radio said Beirut's
southern slums and adjacent hills,
where fighting has persisted despite a
civil-war truce, were "remarkably
silent," and police reported no cease
fire violations by late Sunday. Two
Marines were wounded by a rocket
propelled grenade in skirmishes Satur
day. WASHINGTON Congress begins
the final three weeks of its 1983 session
today with the House debating how
long U.S. forces should remain in
Grenada and the Senate questioning
the Marine commandant about the
security of troops in Lebanon.
But while lawmakers are considering
the status of the U.S. military in the
Caribbean and the Middle East, the
clock will be moving toward a midnight
deadline for expiration of the govern
ment's ability to borrow money.
Senate Majority Leader Howard
Baker, R-Tenn., has said that even if a
debt-ceiling bill is not enacted by mid
night, the government probably has
enough cash on hand to pay its bills
and employees for a brief time.
But, Baker said Saturday, failure to
soon raise the debt ceiling could force
the administration into having to
decide who gets paid and who doesn't.
NEW YORK The Rev. Jesse
Jackson announced Sunday he will
seek the 1984 Democratic presidential
nomination and said he would try to
choose a female running mate.
The civil rights leader, in an inter
view recorded for the CBS-TV pro
gram 60 Minutes, said he would make a
formal announcement of his candidacy
Thursday in Washington, D.C. He is
seeking to become the first black presi
dential candidate nominated by a
major party.
Although many of the country's
black political leaders have said they
will not support him, fearing such a
campaign would be divisive, Jackson
said, "No candidate can expect to have
unanimous support from any given
community."
AMERICUS, Ga. Lillian Carter,
the opinionated and outspoken mother
of former President Jimmy Carter who
became known to millions as "Miss
Lillian," died Sunday at age 85.
Mrs. Carter, who had been at the
hospital since Tuesday, died at 5:05
p.m., according to a spokesman. The
ex-president, his wife, Rosalynn,
Carter's brother, Billy, and his sister,
Gloria Carter Spann, were at Mrs.
Carter's bedside when she died.
Mrs. Carter, who underwent surgery
for breast cancer in June 1982, was in
declining health. She had been at
Americus-Sumter County Hospital for
about a . week, but hospital ad
ministrator James Griffith said he did
not immediately know the cause of
death.
"Miss Lillian," as her neighbors in
Plains, Ga., called her, lived on the
fringes of politics for most of her life,
but was rarely shy about expressing her
opinions. In 1980, she created headlines
by saying that if she had $1 million, she
would hire a "hit man" to kill Iran's
Ayatollah Khomeini.
