The ordinance is part of a proposal that would extend Alert Cable TV a franchise for eight years. Both the ordinance and the franchise agreement must be read at a public meeting once more before they will be added to the town code. The ordinance would give Carrboro the option of revoking the franchise if the town proved to a judge that materials shown on the system were obscene. Town Attorney Michael Brough said that N.C. law defined obscenity as programming that the average person would find offensive. Alert Cable originally requested that they be allowed to add the Playboy Channel to their system, but they withdrew that request when the aldermen first considered the franchise earlier this month. Alert Cable can opt to add the channel at a later date, Brough said, and the only way the town can remove the channel or revoke the franchise is if a judge finds the programming obscene. The Rev. Gary Webb, pastor of Calvary Missionary Baptist Church in Carrboro, told the board that his church supported the obscenity ordinance. He also delivered a letter expressing his congregation's concerns. "At this point I'm very satisfied with the ordinance," Webb said yesterday. "If there is an objection to some programming at least now we will have some avenue to do something about it. "We're not concerned with who has these types of programs. We're concerned with the effect that it could have on the community," he said. In the letter, Webb asked the aldermen to adopt a stricter definition of obscenity, but this was not included in the ordinance that the aldermen approved. If the board approves the franchise at its next meeting, Alert will be required to expand their programming from 20 to 35 channels within one month. They will also be required to expand service to 54 channels within seven years, when its current franchise expires. Cable rates will also be raised if the aldermen approve the franchise. Basic rates will be raised from $7.50 to $10 while the cost for expanded services will increase from $3 to $4. In other business Tuesday, the board approved a land use permit for a Texas developer to build a 132-unit apartment complex at the intersection of Jones Ferry Road and the road leading to University Lake. The board listened for more than two hours before rendering its decision. Discussion concentrated on whether to require the developer to build a sidewalk along Jones Ferry Road, whether the width of the road should be changed, and whether left turns should be allowed going in or coming out of the complex. The aldermen decided to grant the petition on the conditions theat there be a sidewalk and that the developer widen the state road five feet.
