Thursday as Police Chief Daryl Gates shifted the fight to keep his job to court. Gates, who faces a mounting ouster movement over the March 3 videotaped police beating of a suspected speeder, was trying to overturn his recent 60-day suspension by the police commission. A judge who reluctantly accepted the case heard three hours of arguments Thursday before adjourning until next week, when more arguments will be heard. Gates was not present at the hearing. His lawyers argued for a permanent injunction against the Police Commission' s suspension of Gates, who will remain in office under a temporary order as long as the hearings continue. 'Take the Gestapo chief out!" sev eral demonstrators yelled, drowning out proceedings until bailiffs cleared away the protesters. Superior Court Judge Ronald Sohigian called the case too complex to resolve on the spot and said it was premature to approach the issue of a permanent injunction. "It's perfectly obvious, as everyone recognizes, that this case may wind its way up to the appellate court," the judge said. "A quick decision will not be made to get rid of it." At the outset, however, Sohigian in dicated the case may have undergone "a metaphysical transformation," and per haps the question of whether Gates can be suspended by the civilian Police Commission was moot. He also said he wasn't sure he should decide the issue. "The question is whether the judi ciary ought to intervene in certain kinds of disputes," he said. "The judicial branch should not be placed in a posi tion of running the government." The battalion of attorneys in the packed courtroom insisted the case was not moot, that the court was indeed the one that should decide it. The lawyers included representatives of the Southern Christian Leadership Conference, individuals who filed a tax payer suit, as well as an assistant city attorney, lawyers for Gates and a law yer for the Police Commission. The effort to oust Gates began soon after Rodney King, a black motorist, was beaten by police officers who pulled him over for speeding on March 3. The investi gation of the alleged rape at the Kennedy estate probably will take two more weeks, mainly because of difficulty identifying and reaching potential wit nesses, police said Thursday. Chief Joseph Terlizzese added that police are continuing to investigate pos sible obstruction of justice in the case, but he wouldn't give details. "That's part of the investigation," Terlizzese said. "I can't get into that. I don't want to make any judgments." Police had said earlier they were un able to contact possible witnesses or suspect William Kennedy Smith in the first hours of their investigation, even though they went to the Kennedy family's seaside estate several times. Sen. Edward M. Kennedy, D-Mass., who also was at the estate Easter week end, has said he has cooperated with investigators. A 29-year-old woman from Jupiter, Fla., alleged that Smith assaulted her near the estate pool on March 30. Terlizzese said police have been trying to identify all "people who were on the premises" and make sure they talk to every possible witness. Detectives went to Washington the week after the rape allegation to inter view Kennedy and others and obtain blood and hair samples from Smith, who refused to be interviewed on his attorney's advice. Terlizzese wouldn't say where de tectives would be going to interview other potential witnesses, but said some witnesses are out of town. He also wouldn't give the number of witnesses. Asked if police have identified all potential witnesses, he replied: "I hope so." He wouldn't say why police have had trouble identifying witnesses, but said that has prolonged the case. "We're not stalling in this investiga tion. It's a very active investigation," the chief said in an interview. State Attorney David Bludworth said earlier this week it will be about three weeks before his office decides whether to file charges, dismiss the case or let a grand jury decide. Terlizzese said he might have "a lot to say" when the investigation is over. "Right now, I don't want to do any thing that could prejudice this case," he said. Meanwhile, The Miami Herald re ported Thursday that two private detec tives for the Kennedy family weren't licensed in Florida when they were hired to look into the rape allegations. State authorities said both detectives have since filed applications. The Herald reported the detectives could be disciplined. Gates sued thecity and the City Coun cil was prepared to immediately settle by reinstating him. The commission and civil rights groups intervened, fore stalling the settlement. The focus ofThursday 's lengthy court exchanges was whether the city attorney's office has a conflict of inter est in representing the Police Commis sion as well as the City Council. Sohigian wanted to know whether the Police Commission is a part of city government without an independent role of its own. If such a "unitary" structure exists, he suggested, there is no division between the city government and com missions appointed by that government.
