FEDERAL RENT CONTROL LAW IS EXPLAINED Imi immediately for hu own nae •s housing accommodations. The landlord cannot evict you in order to have hia relatives move into the unit. Neither can he evict you to convert your dwell ing1 for commercial use. He and hia immediate family must fully intend to live in the dwelling.„ 1 4. If the landlord, in good faith, has contracted, in writing, to sell the premises to a pur chaser for hiB immediate and per sonal housing use. Just your landlord's statement that he has sold the dwelling is not enough, it must be in writ ing, and the purchaser must in tend to use it for housing, not as a store or office. 5. If the landlord, in good faith, is going to remodel or alter the premises substantially. You can be evicted for remod eling or altering only if: a. the alterations are neoessary to protect and conserve the hous ing accommodation*, and b. these alterations camtdt be made with the tenants Irving on the premises and c. the landlord has complied with all local and federal laws for making such alterations. Your landlord cannot evict you to remodel or miter your dwelling for commercial use. 6. if the landlord seeks in good faith to recover possession of your dwelling foe the purple of demolishing it and replacing it with new construction. You have no protection against eviction in this case, regardless of the kind of new building he will coijstruct. v It may be new housing' or a commercial, building. The only restriction on the land lord is that he comply with all local and federal laws for such new construction. 7. If year qfemlseg are the spare room' or some writer portion of the landlord'* own home, which is not suitable fos housekeeping use. If you are living in a furnished, non-housekeeping accommodation in a single dwelling occupied by your landlord and the building is not used as a rooming or board ing house, the law permits the landlord to evict* you. Recovery of Damages by Tenants If your landlord charges you more than you are legally bound to pay for rent, you can bring %uit against him in any state or federal court within one year of his violation of the law. You can bring court' action against him for this. In the case of a clear violation, you can sue the landlord for triple damages and court costs. You can also go to the area rent of fice and ask that it get a court! order compelling the landlord to pay back the overcharge or re store the 'services to which you are entitled. Housing Removed from Rent 'Control Certain types eof housing ac commodations are no longer con * rolled^ under the new federal law. But rent control is removed from such housing only when the land lord flies a special form with the area rent office proving that his accommodations are eligible for removal from control. The units are not automatically decontrolled. The types of housing from which rent control is removed include: 1. Motor courts. All such unitd are decontrolled. Even though you have been a permanent resident of a motor court, you are given no protec tion under the law. 2. Tourists homes exclusively fcr transients. If you have been a permanent resident in a rooming house, your rent is still controlled. Only those tourist homes which serve transi ents exclusively can be decon trolled upon application of the landlord. 3. Housing newly constructed or converted, and completed after February 1, 1947, but not if the tenant is a World War II veteran. If you are a World War II veteran and the unit in which you aie living was converted or com pleted before July 1, 1947, with the aid of priorities or allocations mode under the Veterans’ Emer gency Housing Program, your rents remain under .control. Or if you are a veteran and you were not yet residing in such a unit before July 1, 1947, but. had u written or verbal promise of the unit from the landlord, your rent must be the rent agreed upon at that time. It will 'remain con trolled through February 29, 1948. If, however, you are not a vet eran or a member of his immed iate family and Vour dwelling w'as complete# after February I, 1&47, Jhe federal law gives you no pro tion. 4. Housing which at no time between February 1, 1945, and January 31, 1947, was rented as housing accommodations, except to immediate members of, the oc cupant’s family. If at sometime between these i two dates the housing was rented to someone other than the immed iate family of the occupant, rent ,control will remain in effect on' such housing. 5. Hotel accommodations which furnish customary hotel services, j Rents on units in transient. j residential and apartment hotels! are subject to decontrol where residents a^e provided with cus tomary hotel services such as maid service, the furnishing and laundering of linen, telephone and j desk services, use and upkeep of furniture, and bellboy services. ! Organized Tenants Are Better Able To Resist Rent Increases The rent law does not require you to sign a lease for an in creased rent. A landlord may try • to make things difficult for. one tenant and may threaten him with eviction when rent control expires, if the tenant refuses to agree to an increased rent. But if you" live in an apartment house and all the tenants refuse to pay an increase, the landlord will be re luctant to undertake mass evic tion. A group of tenants organ ised to resist rent increases now will be effective after February 29, 1948, when rent control ex pires. Joint action'of all tenants at that time can prevent extreme rent increases. Form or join a tenant association for your pro tection. - Keep your union in formed. iX—~ A. F. of L. Action The A. F. of L. is doing every thing possible to safeguard you as » tenant- It fought the re vision of the rent control law. Immediately following the enact ment of the Housing and Rent Act of 1947, President Green called on Central Labor Unions to recommend qualified A. F. of L. representatives to the Governor of each state for appointment by the Expediter on the important local advisory rent boards. These local rent boards will largely determine the type of rent control which will operate in your community. Thpy can recommend that the Housing Expeditor end all rent control in the entire area. They can recommend that rent ceilings in the entire community be raised. They review hard ship cases and the operation of the area rent office. The expe diter must approve the rent board's recommendations if they are supported by evidence and do not violate the law. Every local rent board should have labor rep resentatives on it. No matter how good, a local advisory board cannot be very ef fective without the help of ten ants. Tenants should know their rights under the law. They should report 'violations of the law to their Central Labor Union * or the CLU Hosuing Committee. ' February 29, 1948. will mark the end of all federal rent con trols. So long as the hous ing shortage continues to l>e se vere. -jvithout these laws, you will have no protection from rent, in creases. Every A. F. of L. Central La bor Union should have an active Housing Committee. This local Housing Committee should be in a position to help local unions to conduct rent surveys, keep in touch with tenant associations and present to city officials a strong case for effective rent reg ulation. It is the responsibility of every unionist to help his com munity assume effective local re sponsibility for tenant protection. Federal rent control ends Feb ruary 29, 1948.
