In an appeal from San Francisco
to tlie ' "supreme Court by Chief
of police against a dealer who sold
whiskey after license had been re
fused him, and he imprisoned and
granted a writ of In'jfis corjais, Jus
tice Field of the U. S. Supreme Court
in his Qled opinion says:
"It is undoubtedly true that it is
the riijht of every citizen to pursue
ny lawful basinet0, subject only to
such restrictions as are imposed up
on all persoas of the same age, sex,
or condition. 11 at the possesalon
and enjoyment of this right, and. in-,
deed, of til right?, are Bubject to
such restr.ctlons as may be deemed
by the governing authority of the
country essential to ',he safety,
health , peace and good order, and
morals of the community. Kven lib
erty itself is not unrestricted by
license to act according to one's own
will. It is only freedom from re
straint under conditions essential to
the equal enjoyment of the same
right by others. It is, then, liberty
regulated by law."
The Court says the regulations
goyerning the various pursuits of
life are almost infinite , varying with
the nature of the businea3, some re
gulations being designed to lessen
noise, others to protect health, others
to remove odors, io., and it would
hardly be necessary to mention thu,
the Court continue?, were it not for
the position often taken and vehe
mently pressed that there is some
thing wrong in the principle and ob
jectionable in similar restrictions
when applied to the business of sell
ing by retail intoxicating "liriuors. It
is urged that as liquors are used as a
beverigeaud the injury following
them if taken in excess is voluntari
ly ii.flicted and is conQned to the
party offending, then the sale should
be without restrictions, the conten
tion being that what a man shall

this way has therefore been bt all !
times considered a proper subject of j
legislative regulation. For that mat-
ter, their sale by the glass may be
absolutely prohibited. It is a queJ
tion of public expediency and public t
morality, and not of Federal law.
There is no inherent rijht of the
citizen to sell intoxicating liquors hy
retail, It is not a privilege of a
citizen of the State or of a citizen of
the United States- In prohibition
or regulation of the tratlio discretion
may be vested in officers to whom to
grant and to whom to refuse liquors
The ollicors may not always exercise
the power conferred upon them with
wisdom or justice to the parties af
fected. This matter is not one that
can be brought under the cognizance
of United States Courts.
The Court ears that it does not
perceive that the ordiance under
which the prisoner was arrested
violates any provision of the Federsl j
Constitution or law, and that as to
the State Constitution and laws it is
Mound by the decision of the State's
Supreme Court tbat the ordinance
does not violate them. The order
discharging the prisoner from custo
dy is therefore reversed nnd the case
remanded with directions to take
further proceedings in conformity
with the opinion of the Court.
