SMITH, Town of Highlands,' Macon County, , Town Clerk and Tax Collector North Carolina LEGAL ADVERTISING NOTICE Whereas, the need of this Town resuire that there be installed ex tensions to the water mains, and a new water storage tank in the Town of Franklin J and whereas, the Board of Aldermen of Said Town ot Franklin have estimated the cost of said proposed water main exten sions and water storage tank, atid find that said water main exten sions and: water storage tank will cost in the aggregate not less than $Ju,IAa,'.U, . anu whereas the .saui Board of Aldermen have applied to the Public Works Administration for a grant to aid , in the building of said water main extensions and -water storage tank; and whereas if said Public Works Administration approves said grant the total cost to the Town of Franklin will be not less than $17,UX).00; And whereas, a statement of the debts and assessed value of the taxable property , of the municipal ity has been this day presented to the Board of Aldermen and fued with the Clerk of . this Town, and is open to inspection ; and whereas, the assessed.value of property with in the corporate limits of the Town of Franklin tas last fixed for mun icipal taxation is $1,064,418.00; and whereas, the net outstanding debt of said Town of Franklin is $35, 704.00; and whereas, the percentage that the net debt bears to -the net assessed valuation is .03354. Now Therefore, be it ordained by the Board of Aldermen of the Town of Franklin :. Section One: That there be is sued by the Town of Franklin not more than $17,000.00 water improve ment bonds, tearing interest not to exceed 4 jer cent per annum, for the purpose of paying for the water main extensions and water storage tank in the Town of Franklin, said bonds shall be issued at such time or times as the Board of Aldermen of said Town may direct by reso lution within three years after this ordinance takes effect. The time and place of payment; rate of inter est and other details in connection with their issuance not inconsistent with this ordinance, shall be pro vided by the Board of Aldermen by resolutions adopted prior to the issuance of - said bonds, provided said bonds shall mature and be made payable, the first not more than three years after the date of first bonds issued, the last of which shall mature and "be made payable not more than forty years from the date of the first issued bonds, and no such installment or series shall be more than 2z2 times the Smallest prior, installment of series. Section Iwo: That the maximum aggregate principal of said bonds, as hereinbefore stated, shall be $17,000.00. Section Three: That a tax suffi cient to pay the principaPand in terest of said bonds shall be annual ly levied -and collected. Section Four: That a statement of the debts of the municipality has been filed with the Clerk of the Town of Franklin and is open for public inspection. Section Five : That this ordinance shall take effect when approved by the voters of the municipality at an election as provided by law. Section Six : This ordinance shall be published once in each of two successive weeks after its final pas sage in the Franklin Press, a weekly newspaper published in the said Town of Franklin. A notice shall be published with the ordi nance in the form prescribed by Section 2944 of the Consolidated Statutes, with the printed signature of the Clerk appended thereto, stat ing the date the ordinance ' was passed, and the date the same was first published. And further stat ing that any action or proceeding questioning the validity of said or dinance must be commenced within thirty days after its first publica tion. .
