McLEAN INNOCENT, IS CLAIM OF LAWYERS (Continued from page 1) stock of goods and equipment be longing to McLean and McLauchlin, operating as the Greensboro Oil Com pany, was inventoried at $2,900. “McLean drew three crecks as treasurer of the Central Carolina Oil company, these checks being for J2,- 000, $1,717 and $1,000 respectively. These checks the prosecution claimed, were applied to indebtedness not due by the Central Carolina Oil Company, but to personal debts of McLauchlin and McLean. “At the close of the evidence intro duced for the State, the charge of the embezzlement of the $2,000 was non suited on motion of the defendant and only the other charges were pressed. “McLean contended that ail he did was to pay himself the $2,900, the in ventory of the Greensboro Oil Com pany agreed upon, in writing the checks and that if he did not keep the books so as to show the checks as charged written to him and Mc Lauchlin, and then indorsed by them, the result was the same; that is, by making the checks direct to the per sons and getting credit for what was due to the payee it was the same as if the checks had been first made to him and McLauchlin and then deliv ered in the discharge of the indebted ness. “However, Judge Shaw charged the jury that the proper way for McLean to have handled tha transaction would have been to have made the check to himself and then indorsed them over to the other parties. “McLean did not keep any books of the transaction other than daily slips and, since after Dr. McLeod took over the business all these were carried to Charlotte, there was no written evi dence of the daily transactions and no inventory in writing was offered to the jury, though there was oral testimony to these facts. “When McLean and McLauchlin sold cut to Dr. McLeod they were to be relieved from all liability and the evidence disclosed that McLean per sonally receivea no benefit from the transactions, but that all the money paid out went to the benefit of the crmpany. ■ “McLean paid his own expenses in organizing the business, worked at night keeping the records, turned over to it more than $2,900 worth of property, drew no salary or compen sation and gets three years for issu ing checks to pay himself what was due him.” At Plnehurst The suave, the debonair George Ar liss, as plain hoboi There’s a situation to make the screen world wonder, confronting a contradiction in terms. Lovers of Dickens may pro test that the motion picture can not possibly catch the spirit and feeling of the author’s work yet they need only sit through the film to find they are in error. Seymour Hicks, who plays “Scrooge,” seems to have been created for the part. The same is true for Bob Cratchit, the un fortunate and timid clerk in Scrooge’s office, a role played by Donald Cal- throp to perfection. The entire cast, in fact, is as Dickensian as one could wish. The stars of “The Last of the Pa gans,” the attraction at Southern Pines Thursday, Friday, Saturday, December 26, 27, 28 with a Saturday matinee are Mala and Lotus, stars of "Eskimo.” It is a story of the South Sea Islands and for the most part, its supporting cast is compcsed of Polynesian natives. In character it is a love story, the exotic, glamorous love of a raiding native warrior for a girl he has made captive. Its drama is that cf a simple, honest, pagan people who lived in idyllic peace, menaced by native conflict until the white man came, bringing with him all the curses of white civilization to encompass the wrecking of an abor iginal people.
