North Carolina w 4^ r> Two Civil Suits Involve Former Elks Home Here Two civil suits involving the handsome property of the Elks Lodge, the former Elks Home on South May street, were filed last week in Moore superior court. In one, W. W. Sherman and wife Josephine seek foreclosure of the property, asking that the court order a commissioner’s sale so that terms of a promissory note for $20,000 executed by' the Elks Home of Southern Pines, Inc., to the Shermans may be met. "The note, for which the old Elks Home was to secure payment,, is alleged to have been made in February 1951 with privilege of renewal for three additional 90-day periods. These have all passed without any payment on the'principal, though interest has been paid to May 1, 1952, the complainants state. In the other suit, Wayne D. Boring and wife Lois of Westches ter county. New York, are asking the return of $6,000 allegedly paid to the Elks Home of Southern Pines, Inc., as down payment on a $15,000 purchase price. The purchase, they state, was to have been contingent on the securing of a town permit for a motor court, hotel or other hostelry on the tract. They also want return ed $375 allegedly paid to Mrs. J. J. Banigan as part of the commis sion as sales agent due her if the negotiations went through. The Borings state that, since these payments were made last October, they have not received the town permit, also that they have failed in their efforts to se cure the necessary funds for build ing. They ask recovery and also an accounting before the court. NOTICE OF SALE Saunders Elected To Presidency of Robbins Mills, Inc. William P. Saunders of South ern Pines was elected president of Robbins Mills, Inc., moving up from the job of executive vice- president, at a meeting of the board of directors held in New York City this week The election followed the resig nation of Edward A. Werner of New York, who served as presi' dent, treasurer and director dur ing 1951-52. Mr. Werner will re^ main with the companyin an ad visory capacity. Mr. Saunders, besides being ex ecutive vice-president of the pa rent organization, has also for some time been president of the subsidiary corporation Robbins Mills, N. C., Inc., which operates the four Robbins plants in North Carolina and one at Clarksville, Va.
