Page Eight THE PILOT—Southern Pines. North Carolina FRIDAY. JUNE 13. 1952 J Where Are Banigans? Judge Nettles States Intention of Issuing Warrant Judge Zeb V. Nettles said Mon-'^' day at Wadesboro that he would issue a warrant for the arrest of Mr. and Mrs. J. J. Banigan of Southern Pines on charges of con tempt of court, when for the fourth time they failed to appear at "a hearing as ordered. Mr. and Mrs. Banigan were first cited for contempt of court in April by C. C. Kennedy, Moore Coimty clerk of superior court, when they failed to produce doc uments for a commissioner’s hear ing in connection with a civil suit filed against them by Mr. and Mrs. W. W. Sherman of Hartford, Conn. At a showcause hearing M!ay 10 NORTH CAROLINA MOORE COUNTY NOTICE Notice is hereby given that the partnership heretofore existing, wherein R. C. Johnson and Hazel E. Brown (now Hazel E. Brown Green) were partners trading and dfhng business under the firm name and style of “Johnson and Brown” in the Town of Southern Pines, in the County of Moore and State of North Carolina, has this day been duly dissolved by mu tual consent of the partners. This 5th day of June, 1952. This the 5th day of June, 1912. R. C. JOHNSON HAZEL E. BROWN GREEN i6-27incl they again failed to appear, and their attorney filed with the clerk an affidavit stating that they had turned over the documents in question to the Commissioner of Internal Revenue at Greensboro. Mr. Kennedy found them guilty of contempt, and notice was given of appeal. In the meantime Mr. and Mrs. Banigan left Southern Pines for New York City, saying they would be back in a week or two, but they have not yet returned. When the appeal hearing was held before Judge Nettles at Car thage May 26, they stiU had not returned nor had anything been heard from them, their counsel said. Judge Nettles sustained the finding of contempt and only the attorney’s strong plea saved them from immediate indictment. Dn. Neal and McLean VETERINARIANS Southern Pines. N. C. Children May Get Speech, Hearing Tests Saturday SOFTBALL TEAMS Free speech and hearing tests will be held for all Moore Coun ty schoolchildren at the county health center at Carthage Sat urday from 9 a. m. to 12 noon, preparatory to a clinic to be held this summer tfor correctipn of speech defects, small and large. The tests will be giveri by Mrs. D. D. Shields Cameron of South ern Pines, who is specially train ed in this work, and Miss Blanche Monroe, of the West End school faculty. Mrs. Cameron and Miss Monroe will also be in charge of the clinic, the dates and place for which will be announced later. He reported that he had been unable to make contact with his clients, as they apparently were traveling about a good deal, and consequently they were unaware of the swift succession of events as well as of the North Carolina statute in regard to their particu lar case. Judge Nettles continued judg ment until June 9—Monday of this week—at Wladesboro, where he was to be holding court. Counsel appeared at the hearing —but no Banigans. He was able only to report that he had heard from his clients, in a telegram in dicating their intention of return ing soon, but that they had not re appeared and he had still been able to establish no contact. $2.10 Pints $3.35 Fifths 86 Proof M snAraHnmflSKm M iM( I AU 4 VEAIS OK MOM tiin. sax I MMKsr. The crossfire between the parties was marked by the attach ment of a Chrysler Imperial sedan, garaged at Pinehurst, by the Ban igans last January 2 pending the filing of their suit against the Shermans. The car was released to the Shermans May 26 on their petition that it was owned not by them, but by the Roger Sherman Transfer company of Hartford, Conn. Pending against the Banigans, as co-defendants with the Elks Home, Inc., is another civil suit filed by Wayne D. Boring and wife to recover option money and a partial agency commission paid by them in expectation Of pur chasing the former Elks Home here. Total amount involved is above $6,000. The Banigans have failed to answer this suit and, though an extension of time was granted .by plaintiffs’ counsel, this time is running out. Involvements in other real es tate matters are also said to make the Banigans’ reappearance im- Stammering, stuttering, lisping and other types of speech im,ped iments will be the subject of the clinic’s special training, designed to help the boy or girl overcome these difficulties and enjoy nor mal communication with his fel lows. The hearing as well as speech tests are important, as of ten a child’s speech becomes blur red through not hearing distinct ly how others talk. Such impediments can cause deep psychological and personal ity troubles, much misery on the part of the child and seeming backwardness in school work even where the child is actually very bright. Parents are urged to bring their children whom they know or sus pect of having speech Or hearing difficulties to the center for test ing. The clinic will be the second to be held in Moore county. The first was held last summer in South ern Pines, with a group of chil dren and young people from the southern part of the county as pupils. A survey has showed that many in the northern end need this training, and it is planned this year to- locate the clinic where it can be of benefit to them. Any adult softball teams in terested in forming a league to play this summer are asked to call Irie Leonard, summer recreation director, at his home, 2-7482. He will be glad to work them on organiza tion, scheduling of games and practice. The summer recreation pro gram is not just for children and teen-agers, he- said, but for adults alsov Churches, civic clubs and other organi zations are invited to form teams and get up a league, tis- ing full facilities of the local program under the Municipal Recreation Commission. FIREMEN (Continued trom Page 1) department has been invited to bring its modern fire truck, just acquired last week, which fights fire with fog. It is anticipated that its proud owners wiU bring it over if this is found in any way practicable. Supper and Dance At 5:30, all the firemen will be guests at a supper, to be held in the grove of the former Elks Home on South May street. This will be followed by the street dance downtown. Officers of the Sandhills Fire men’s association are: Clarence Rush, Asheboro, president; N. L. VanBoskerck, Pinebluff, vice- president; E. P. Leatherbury, Hamlet, secretary-treasurer. The local committee for the convention includes all members of the host department, headed by Chairman George B. Little, Har old Fowler, E. W. Davis, Stanley Dunn, Ralph Mills, Joe O’Callag han and others. These are services of the Moore County unit of the N. C. Society for Crippled Children, financed through the annual Easter Seal Sale campaign. Mrs. Shearwood Brockwell, Jr., of Southern Pines is chairman of the county unit, with Miss Millie Montesanti serv ing as campaign chairman, and also at present as acting chairman of the unit. perative. Mr. and Mrs. Banigan came to Southern Pines in September 1950 as managers of Jefferson Inn for M)-. and Mrs. Sherman, whose home is in Hartford, though they winter in Pinehurst, Also on be half of the Shermans, the Bani gans handled the sale of the Southern Pines Country club to the Elks Home, Inc., in December 1950, and of Jefferson Inn to Mr. and' Mrs. Oscar Holtzclaw last summer. Troop leaders and some of the mothers will have charge of the activities each day. A qualified Red Cross Ufesaver and instructor will be supplied by the Moore County chapter.
