Notice is hereby given that, at
the regular meeting of the Town
Council of the Town of Southern
Pines, assembled at the town hall
on the 8th day of December, 1953,
the following ordinance was
adopted:
AN ORDINANCE REGULATING
THE COLLECTION OF GAR
BAGE AND OTHER REFUSE.
Be it ordained by the Town Coun
cil of the Town of Southern Pines.
Section 1. Definitions: Garbage,
as the term is used in this chapter,
shell be held to mean and include
all refuse, animal, fruit and other
vegetable matter, all tin cans,
glassware and crockery in which
any such matter has been put up
or stored, and all rags, waste
paper, floor sweepings and other
combustible refuse, except build
ing material scraps, tree trim
mings, and yard rakings.

that shall otherwise be a menace
to health, or cleanliness shall be
allowed to remain in any dwelling
house, hotel, boarding house, cafe,
restaurant, lunch stand, fruit
stand, meat market, store or oth
er building or on any premises a
longer time than shall be reas
onably necessary to remove and
deposit the same in can or cans
as hereinafter provided in this
chapter.
Section 3. Garbage Cans. The
occupant of every building, prem
ises cr place where garbage does
or may exist, shall provide him
self with a garbage can made of
substantial galvanized iron or oth-
ek non-rusting metal in which he
shall deposit all garbage existing
at the place occupied by him.
Such can shall be provided with
handles or bales and with a tight-
fitting cover made of the same
material as the can. All garbage
cans shall be water tight. They
shall be of a size that can be con
veniently handled by the garbage
collector (not to exceed in
holding capacity more than 30
gallons and shall not weigh more
than 20 pounds while empty). All
garbage c^ns shall be placed on
or near the parkway in front of
any dwelling. All garbage cans
shall be placed at or near the rear
entrance of any business establish
ment. In any event the garbage
cans shall be placed in such a
place that they can be convenient
ly reached by the garbage collec
tor. Garbage cans shall not be
placed in front of dwellings except
the night before or during day
light hours of scheduled days of
collection and shall be removed
at all other times from the front of
the dwelling and public park
ways, except for sunken patented
cans properly installed which
shall be flush with the ground.
All garbage cans shall be kept
reasonably clean by the! use of
lye or other effective cleaner.
Section 4. Wet Garbage. All
wet garbage shall have the liquid
drained off and shall be wrapped
in paper or other combustible
material before it is placed in the
garbage can, thus preventing
smell and the breeding of flies in
summer and freezing and adhesion
to the can in winter.
Section 5. Deposit of Garbage
in Public Places and on Private
Property. No person shall throw,
place or deposit any garbage in
any street, alley, public place or
private property within the city
limits, except in garbage cans or
garbage vehicles/ and as provided
in this chapter.
Section 6. Transportation of
Garbage and Slops by Private
Persons: No person or persons
shall collect, handle, haul or
transport, on any of the streets,
alleys, public ways or places of
the city any garbage (or use the
Town sanitary land fill) without
first having procured a permit
therefor from the Office of the
Town Manager. This section
shall be strictly construed as to
non-residents but in the case of
residents shall be subject to
modification by such regulations
as the Town Manager may pro
mulgate and publicize.
Section 7. Removal of Garbage
by Town. Garbage will be col
lected and removed at least twice
weekly in residential districts and
as often as is necessary in the
business districts on such sched
uled days as shall be announced
and publicized by the Town Man
ager.

Materials, Tree Trimmings and

Yard-Rakings. Scrap building ma
terials, tree trimmings, and yard
rakings shall be collected and re
moved weekly on such scheduled
days as shall be announced and
publicized by the Town Manager.
To facilitate action cn such col
lections, citizens should call the
Town Office and request this
service.
Section 9. Removal of Ashes by
Town. Ashes will be collected and I
removed on the same days that
garbage is collected. A separate
container shall be provided by
each building for the deposit of
ashes for collection.
Section 10. Removal of Dead
Animals. Dead animals will be
removed at any time upon request
to the Town Office.
Section IL Penalty. Any person
who shall violate any prevision
of this Ordinance shall be" fined i
not less than $5.00 nor more than
$50.00. Each and every violation,
and each and every day’s contin
uance thereof, shall constitute a
separate offense.
Section 12. All ordinances or
clauses of ordinances in conflict
with this ordinance are hereby re
pealed.
Section 13. This ordinance shall
be in full force and effect from,
and after the 8th day of Decem
ber, 1953.
