MAY 10, 1956 THE PILOT—Southern Pines, North Carolina Youths Get Suspended Sentences For Beating Airmen In ‘Useless’ Attack Greensboro Men Get Straight Road Terms On Traffic Charges Three young Moore County men, convicted in what Solicitor W. Lament Brown termed the most “utterly useless” crime he had ever prosecuted in Moore Re corder’s Court, recei\{ed suspended road sentences Monday for beat ing up three airmen of the Air Force Air-Ground Operations School about two weeks ago. The three. Buck Kirk, Bobby Willard, and Charlie Lewis, all of whom live ne^u• Aberdeen, were convicted of beating Airmen George Cox, Richard Moody smd Amelio Estrada April 19 in South ern Pines. No reason was ever given for the three’s actions, other than that one of the airmen had made a slighting remark which apparent ly made Kirk mad. 'Testimony indicated the affray, which occurred near midnight April 19 at the intersection of Morganton Road and Indiana Ave nue, started when Kirk forced the automobile the three airmen were in to stop about a block away. Moody said that Kirk then at tempted to drag him from the car, and finally did after he (Moody) had driven a block with Kirk par tially inside the car and trying to get the ignition keys. When the car finally stopped, the defendants said, Kirk, togeth er with Lewis, Willard and anoth er defendant who was not in court, pulled them from the car and gave them a sound beating. The three defendants did not de- deny that they beat up the air men, although Lewis said he had been nothing more than a by stander and had even tried to puU someone off the airmen. Solicitor Brown said that the beating was a shame to the town, particularly in view of the excel lent relations that USAFAGOS and Southern Pines had enjoyed in the past. Kirk, identified as the ring lead er, received a six months road sentence for assault and battery and assault with a deadly weapon (automobile). The sentence was suspended on payment of a $100 fine and costs. Willard and Lewis received three months road sentences, also on the same charges, suspended on payment of $5(1 and costs. Gary Wathen, another defend ant, was not in court because of illness. His case was continued. Sent To Roads In another case that drew unus ual interest from the crowded courtroom, two young Greensboro residents, Julian McIntosh and Marshall Lowe, were handed straight 60 day road sentences for speeding, careless and reckless driving, and racing. State Highway Patrolmen had arrested the pair after clocking them at 90 miles per hour over a speed watch. Officers said they had been racing at breakneck speed and had passed on a curve. A prisoner serving a two-year sentence on a Moore Coimty road gang for assault on a female, was brought into court and given an additional six months for assault ing a fellow prisoner. James Johnson, the defendant, was charged with assaulting Rob ert Lee, serving 30 days, with a shovel several days ago while working on a ditch. Prison offi cials said Johnson threw an eel at Lee and when Lee struck at him with a shovel, Johnson flew into a rage and struck Lee with his shovel, making a severe gash in his head. Other cases disposed of includ ed: Danny Harrington, Robbins, driving without operator’s license, $25 to include fine and costs. Bobby Hinton, Stockbridge, Ga., speeding 70, $20 and costs. Yancy Lee Reeder, Asheboro, driving drunk, careless and reck less driving, speeding, 90 days on roads, suspended on payment of fine of $100 and costs. License revoked 12 months. Aston Franklin Williams, West End, failure to report accident re sulting in damage of more than $100, prayer for judgment contin ued on payment of costs. John Daniel Jones, Mt. Airy, allowing unlicensed person to drive his automobile, $25 to in clude fine and costs. Raymond P. Blakeley, Sanford, speeding 80, fine of $80 and costs, driver’s license revoked. William L. Wallace, Robbins, careless and reckless driving, ac cident, $25 and costs. Robert Clark Harris, West End, careless and reckless driving, fail ure to stop at stop sign, improper equipment, prayer for judgment continued on payment of $25 and costs. Charles Blue, Hoffman, affray, assault with a deadly weapon, cursing, making threats, three months on the roads, suspended on payment of $25 and costs, pay damages caused to plaintiff, re main on good behavior for two years. Chester Parker, Fort Bragg, al lowing another to use his driver’s license, and Wilson Voarse, Fort Bragg, using as his own another’s license, joint fine of $25 and costs. William Anderson McRae, West End, driving without operator’s license, prayer for judgment con tinued on payment of costs, and on condition defendant not drive until his license reinstated. Edsel Cameron Kelly, Newport News, Va., speeding 80, driving drunk, careless and reckless driv ing, three months on roads, sus pended on payment of $100 and costs. License revoked. Dwight S. Lynker, Fort Bragg, speeding, improper license, $20 and costs. Colon Ritter, Route 1, Robbins, unlawful possession of seal-brok en whiskey, $5 fine plus costs, sheriff to destroy whiskey. Cecil McKenzie, Route 1, Rob bins, allowing unlicensed minor to operate his Ccir, prayer for judg ment continued on payment of $25 to cover fine and costs. Wallace L. Wayne Derry berry, Robbins, public drunk, previous sentence of six months for contributing to de linquency of a minor and other of fenses put into effect. Defendant also ordered to pay a fine of $25 and costs and serve 30 days on roads, to run concurrently with sentence of six months. Charles Leimonds, Candor, speeding, $25 to include fine and costs.
