JUNE 19, 1958 THE PILOT—Southern Pines, North Carolina Page FIFTEEN PUBLIC NOTICE (2) (3) (4) (1) (2) (3) (4) Public notice is hereby given that the Town Council of the Town of Southern Pines at regular session assembled on the 10th day of June, 1958, do enact an ordinance as follows: An Ordinance Establishing a Free Public Library in the Town of Southern Pines; and Setting Forth the Powers and Duties of the Trustees Thereof; BE IT ORDAINED AND ESTABLISHED BY THE TOWN COUN CIL OF THE TOWN OF SOUTHERN PINES, NORTH CAROLINA: I. SHORT TITLE—This ordinance shall be known and may be cited as the “Southern Pines Library Ordinance” II. DEFINITIONS—For the purposes of this ordinance, the fol lowing' terms, phrases, words, and their derivations shall have the meaning giVen herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural num ber include the singular number, and the words in the singular num- / ber include the plural number. The word “shall” is always manda tory and not merely directory.. XT O V (1) “Town” is the Town of Southern Pines, North Carolina. “Council” is the town council of the Town of Southern Pines. , „ “Trustees” is the Board of Trustees of the Free Public Library of the Town of Southern Pines. “Support” as used in this ordinance shall include, but is not limited to, purchase of land for library buildings, erection of buildings for library purposes, purchase of library books, materials and equipment, compensation of library personnel, and all maintenance expense for library property and equipment. . , , . , in. ESTABLISHMENT—There is hereby established a free pub lic library, or libraries, to be owned and operated as a part of the government of the Town, and to be supported by the Town from such nontax revenues as may be available for such purposes. IV. TRUSTEES—APPOINTMENT THEREOF—For the govern ment of said library the council shall appoint a board of six trustees to be chosen from the citizens at large with reference to their fitness for such office. Provided, however, that not more than one member of the council shall be a member of the trustees at any time. Pro vide further, that foy the initial term, two members shall be ap pointed for two years, two members for four years, and two members for six years, and imtil their successors are appointed and qualified. Thereafter, the terms of Trustees shall be for six years, and until their successors are appointed and qualified. All vacancies shall be immediately reported by the Trustees, to the Town Manager or Council, which shall fiU each vacancy for the unexpired term. The Council may remove any Trustee for incapacity, unfitness, miscon duct, or for neglect of duly. Members-of the Trustees shall serve without compensation. ^ , ,, V. POWERS AND DUTIES OF TRUSTEES—The Trustees shall organize immediately after appointment and shall elect one of ite members as chairman, one as secretary, and one as treasuier, and such other officers as it may deem necessary.' The Trustees shall have the power To adopt such by-laws, rules and regulations for its own guidance apd for the government of the library as may be necessary and in conformity with law. With the consent of Council, to lease and occupy, and to erect upon lands acquired by gift, devise or purchase, an appropriate building or buildings. To supervise and care for the rooms or buildings con structed, leased or otherwise acquired and set apart for lil?rary purposes. To appoint a chief librarian, and upon recommendation of such librarian, assistant librarians and other em ployees, and to remove such libraricms or employees: Provided, that no vacancies existing or occurring in the position of chief librarian shall be filled by the ap pointment or designation of any person who is not cer tified by the North Carolina Library Certification Board under the Provisions of General Statutes of i • North Carolina Chapter 125, Sections 9 or 10. To fix the compensation of the chief librarian and in consultation with such librarian to fix the compensa tion of the assistant librarian and all employees of the library and to prescribe rules for their conduct. To prepare the annual budget for the library^ for su'b- mission to the'Town Manager for his consideration in preparing the oves-sdi town budget submitted annually to Council. To extend the privileges and use of such library to_ non residents of the Town upon such terms and conditions as it may prescribe. The Trustees shall make an annual report to Council, covering the work of the library during each fiscal year. - VI. EXPENDITURE OF LIBRARY FUNDS—The treasurer of the Trustees, before entering upon his duties, shall give bond to the Town in the amount of $ , conditioned upon the faith ful discharge of his duties. Provided, however, that such tire^urer may be included in the coverage of any blanket bond which the Town may carry upon its employees who are entrusted with public funds. All monies received for such library shall be paid into the Town s treasury, shaU be earmarked for the use of the tibrary, and shall be paid out on warrants signed by the treasurer and countersigned by the Town’s accountant or finance officer: Provided, the countersign ing officer shall countersign such warrants when they are within funds earmarked for the library and within the amount of the appro priations duly made by Council. VII. ' PO^R TO TAKE PROPERTY-BY GIFT OR DEVISE With the consent of Council, expressed by an appropriate resolution or ordinance, the library Trustees may accept any gift, grant, devise, or bequest made or offered by any person for library purposes and may carry out the conditions of such donations. The Town in all such cases is authorized to acquire a site, levy a tax in accordance with and within the limitations contained in General Statutes of North Carolina Chapter 160, Section 66, and pledge itself by ordi nance or resolution to a perpetual compliance with all the terms and conditions of the gift, grant, devise, or bequest so accepted. VIII. TITLE TO PROPERTY VESTED IN TOWN—Title to aU property given, granted, or conveyed, donated, devised or bequeathed to or otherwise acquired by the Town for a library shall vest in and be held in the name of the Town of Southern Pines, North Carolina, and any conveyance, grant, donation, devise, bequest or gift to or in the name of the Trustees shall be deemed to have been made directly to the Town. , , , , IX. USE TO BE FREE—^The use of any library established under this ordinance shall be forever free to the inhabitants of the Town, subject to such reasonable rules and regulations as may be adopted by the Trustees and approved by the Council. X. JOINT LIBRARIES—By appropriate resolution Council may authorize the Trustees to join with proper authorities of Moore Coun ty or of other municipalities within Moore County or other counties of the State of North Carolina, for the purpose of • establishing and maintaining a free public library or the use of such a library or its facilities and equipment on a joint basis under the terms and pro visions of this ordinance. XI. PROTECTION OF LIBRARY—The Trustees shall have the authority to impose a reasonable fine or penalty upon any person who may damage or fail to return any book, plate, picture, engrav ing, map, magazine, pamphlet, newspaper, manuscript, film, record ing, aucuo visual equipment, or other specimen, work of literature, or object ofrart or of curiosity belonging to any library hereunder estab lished. XII. DETENTION OF LIBRARY PROPERTY AFTER NOTICE —^Whoever wilfully or intentionally fails to return to any public li brary established under this ordinance, any book, plate, picture, en graving, map, newspaper, magazine, pamphlet, manuscript, film, re cording, or audio visual equipment belonging to such public library within fifteen (15) days after the librarian has m^led or delivered in person notice in writing that the time for which such book, plate, picture, engraving, map, newspaper, magazine, pamphlet, manu script, film, recording, or audio visual equipment may be kept under library regulations has expired, shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than fifty ($50.00) dollars or imprisonment for not more than thirty (30) days: Provided, that the notice required by this section shall bear upon its face a copy of this section. XIII. EFFECTIVE DATE—This ordinance shall be effective from and after the date of its adoption. S. Social Security Administra tion office in S^yetteville said this week. With few exceptions, any per son who works as a domestic em ployee and is paid at least $50 cash wages in a calendar quar ter from one em:^loyer is cover ed by socia.l security. A calendar quarter is the three-month period ending March 31, June 30, Sep tember 30 and December 31. Do mestics employed in households on farms operated for profit are under a different rule. 'They must be paid cash wages of at least $150.00 in a calendar year from one employer or work at least 20 days on a time basis before their work is covered under social se curity. Some examples of those who are considered domestic employ ees are those who are employed in private, households as cooks, maids, housekeepers, laundresses, baby sitters, gardeners add han dymen. To insure that they get proper social security credit for their cial security number so that the employer can make his lor her report to the Director of Inter nal Revenue. Dr. Marr Resigns Staff Position At Moore Hospital Dr. Myron W. Marr, of Pine- hurst, who has long been associ ated with Moore Memorial Hos pital, has submitted his resigna tion as a member of the staff ef fective July 1, according to an announcement made this week by John F. Taylor, president of the hospital’s board of trustees. Dr. Marr’s resignation was ac cepted by the board last month. The board, by unanimous vote, however, voted to make him an honorary member of the staff on a permanent basis and accorded him all the privileges of an ac tive staff member. A one-time chairman of the hospital’s staff. Dr. Marr main tained his offices in Pinehurst. In a resolution of respect adopted by the board. Dr. Marr was described as one who render ed “ever thoughtful and splendid cooperation in behalf of the hos pital and its various activities, and to the patients and communi ty in general.” La Paz, whose f name means “The Peace,” is the world’s high est capitol.
