North Carolina THURSDAY, JULY 14, 1960 Liquor, Assault Cases Predominate in Long Session of Moore Court Monday Lendon Sanders, 41, at Eagle Springs made two appearances Monday in Moore Recorder’s Court, the first with Major San ders, 29, a cousin, in a whiskey law violation case, the second as prosecuting witness in an assault case against a Negro man who said he had shot at Sanders when he caught Sanders in the woods with his wife. In the first case. Chief ABC Officer C. A. McCallum testified concerning an ABC raid which took place about noon on July 4 in the talc mine area. A small copper still of about five-gallon capacity was seized, along with three barrels of mash and some new-run whiskey. Lendon and Major Sanders were arrested at the scene. Lendon, pleading guil ty of possession of illicit whiskey for sale, and of a still and manu facturing, drew a straight six months on the roads, with exa mination by a state physician or dered by the court. Major plead ing not guilty, was found guilty of aiding and abetting, and drew six months suspended for two years on payment of $200 and costs. In the second case, Robert Williams, Negro, of Robbins and been indicted by Lendon Sanders for assault with deadly weapon (pistol) and for waylaying from ambush. Found guilty on the first count, not guilty on the second, Williams told the court he had found Sanders in the woods with his (Williams’) wife; that he fired at Sanders two or three times as Sanders ran, but didn’t hit him. He failed to produce the pistol as ordered, telling the court some one had broken into his house later and stolen it. He drew a three months’ sentence, suspend ed on payments of costs, and on condition he produce and surren der the pistol to the sheriff with in 24 hours. Judge J. Vance Rowe also directed the sheriff to look into the alleged robbery, hitherto uhreported by Williams. Richardson Tried Harvey Lee Richardson of New London, Route 2, one of six per- . sons arrested last March in con nection with the break-up of a large still, between Pinehurst and Jackson Springs, made bond at ^ that time but failed to appear for trial, and was brought into court Monday, through cooperation of Montgomery County officers. Pleading not guilty, he was con victed on testimony of ABC of ficers of unlawful possession of etc., for manufacturing, also of driving without brakes. On the whiskey count he drew six months suspended for three years on payment of $300 and costs, and on the traffic violation an addi tional 30 days or $25 and costs. Four other persons have already been convicted in the whiskey case and are now under a felony indictment for manufacture of poison liquor. A sixth one, Mrs. Betty VanHoy Helms, is still be ing sought. Other cases disposed of: Three drunken driving cases drew 60-day terms, or $100 fines and costs, with 12-month license revocation, for their defendants Franklin Ernest Garner of Rob bins, James Junior Caviness, Rob bins, Route 1, and Angus Burton Brown of Mamers. Clarence Allen King, Vass, pub lic drunk, unlawful possession of illicit whiskey, $25 including costs; Allen Lacey Brewer, Eagle Springs, Route 1, failing to report accident, costs; Arthur B. John son, Fort Bragg, unlawful pos session of illicit whiskey, $25 in cluding costs; Rufus LeRoy Ham ilton, Eagle Springs, careless and reckless driving, driving without license, 60 days or $35 and costs; Lou Morgan, Cartherine Morgan, alias Catherine Jackson, of Car thage, Route 3, unlawful posses sion of home brew for sale and manufacturing, 60 days suspend ed for two years on payment of joint fine of $50 and costs; Eugene Whitaker, failure to comply with support order, commitment of 60- day sentence to issue, or to be suspended again if defendant pays for his children and expenses of bringing children from Florida, and complies with judgment from now on. Perry Criscoe, Seagrove, as sault with deadly weapon, $25 in cluding costs, found not guilty of malicious damage to auto; Walter Marley, Louis Hall, Perry Cris coe, assault with deadly weapon, continued to next Monday; Wil lie Charles Brady, Carthage, and Paul Eddeston Fussell, Sanford, escape from prison camp, three months on roads; Jamesr McMil lan, West End, Route 1, assault on female, not guilty, court finds prosecution frivolous and ma licious and taxes costs against prosecuting witness, Ruth Leslie; William Oliver Boyd III, Fort Bragg, failure to comply with glasses restriction, on• operator’s license, $5 and costs; Otis Cad- dell, Carthage, assault on female. days on roads. William Henry Norris, Carth age, assault on female with dead ly weapon (chair), three months suspended for two years on pay ment of $25 and costs, and med ical expense of Hattie Martin; al so assault and battery on female, 30 days or $25 and costs, clerk to pay ipedical expenses of Bell Har gett out of fine; Robert Goodwin, Rockingham, temporary larceny of auto, four months suspended for two years on payment of $25 and costs and on good behavior conditions, also expenses of re covering auto, or suspended on payment of costs if defendant will get admitted to psychiatric hospital for*treatment; Alton Mc- Crimmon, Vass, assault with dead ly weapon (hoe) on wife, on re quest of prosecuting witness, his wife, and in view of the fact that they have seven children all less than eight years old, judgment continued on payment of costs and good behavior toward wife during next two years. Barney Comer, violation of pro bation, three months, with court request for examination of defen dant by county and state doctors; Walter Gecobis, Carthage, speed ing, driving on wrong side, capias, bond $50; John Thomas Black, Rites Held Today For Mrs. Marley Mrs. Myrtle Lassiter Marley, 60, died at her home at Route 1, Rob bins Tuesday. Funeral services were held today at 2 p. m. at the i'iint Hill Baptist Church with tile Rev. Billy Metters officiating, assisted, by the Rev. Bennie Man- ess. Burial followed in the church cemetery.
