Mrs. Bell Enters
Suit For $170,000
Against Airlines
Mrs. Peggy Kirk Bell, national
ly known woman golf pro, has
filed a $170,000 suit against East
ern Airlines and T. A. Latta, an
Eastern Airlines pilot, for injuries
allegedly sustained nearly three
years ago, which she said have
seriously affected her golfing ca
reer.
Mrs. Bell and her husband,
Warren Bell, are owners and
operators of the Pine Needles
Country Club and Lodges here.
In a complaint filed in Moore
County Superior Court at Carth
age, Mrs. Bell alleges that on Jan
uary 4, 1960, she and her young
daughter boarded Flight 784 at
Gresnsboro-High Point airport,
with permission of the stewardess,
in order to help a departing guest
get properly seated on the plane
for her flight to Cleveland, Ohio.
Before the departure of the
plane and on a signal from the
stewardess, the plaintiff states
that she and her daughter started
down the loading ramp. While
they were still on the ramp, she
claims, the pilot started up the
engines of the plane, causing a
powerful and sudden rush of
wind from the engines which
knocked them off to the concrete
loading area.
Mrs. Bell says she landed on
her left shoulder, dislocating,
bruising and damaging it, neces
sitating considerable medical
treatment since that time, with
the prospect of undergoing sur
gery later; that she believes the
shoulder to be seriously and per
manently injured; that she was
forced to cancel tournament and
golf instruction engagements and
has had to change her gplf swing,
besides undergoing much pain
and suffering.
She alleges that her injury was
directly due to the neg;^gence of
defendant and its Authorized
agent, pilot Latta, in that he fail
ed to determine that''there was
no one on the ramp who might be
injured before starting up the en
gines; that he neglected and fail
ed to give plaintiff any warning
he was about to start the engines;
and that his action was in viola
tion of FAA rules and regulations
which prohibit starting up. a plane
before all persons other than
maintenance and airport person
nel have clecired the area affect
ed.
Mrs. Bell claims that her activi
ties as a golf professional “have
been greatly curtailed” and that,
during 1960 alone, she lost an es
timated $14,400 in income as a di
rect result of the injxuy.
Howevr, she is asking recovery
of only $11,400 for loss of earn
ings, along with $820 in doctor
and hospital bills, and $150,000
“for pain and suffering.”

Judge Phillips, who was elected
to his third eight-year term in
1958, gave health as his reason
for resigning. He was formerly
solicitor for this district, and has
served continuously since 1940
except for a leave of absence at
the close of World War II, when
he was one of the U. S. judges at
the Nuremberg trials in Germany.
Judge McConnell was expected
to return from Raleigh to his
home here this (Thursday) after
noon.
He will return to Raleigh next
month for at least one other occa
sion of importance to Moore
County and the Sandhills. He will
swear in Rep. H. Clifton Blue of
Aberdeen when, as is expected,
the Moore legislator is elected
Speaker of the House following
the convening of the General As
sembly on Wednesday, February
6. This will be a historic occasion
in the life of the State as well as
Moore County, as it will coincide
with the opening of the new State
House which has been under con
struction for the last two years.
A large delegation from Moore is
expected to attend.
