Dunlap was or dered held for grand jury action at the August term under $1,000 bond. The charge was assault with deadly weapon with intent to kill, inflicting serious injury. Dunlap, pleading not guilty, admitted fir ing the shots which struck Smith in the back and shoulder but said he did so in self-defense. At the same court session, Dun lap had his 14-year-old stepson, Isaac Jenkins, also June McCain, 16, up for felonious assault on himself. He said Isaac fired a shotgun blast at him, striking him in the back of the head as he was trying to get away. He had no medical report on his in juries, as he said he had picked the shotgun pellets out himself. Young McCain had backed up Isaac’s attack with threats with a pistol, Dunlap said. Details of the incident were vague and weer not clarified by testimony of Mrs. Dunlap, who said she had hold of the shotgun and was trying to get it out of sight when, as she came through a door, “someone” took it away —she didn’t know who. The shooting followed. Pleading not guilty, the teen- aged boys did not testify. The court found the evidence insuf ficient to sustain a felony charge against Isaac but found him guilty of a misdemeanor and turned him over to the juvenile court. McCain was ac quitted. This was one more in a series of cases involving violent as sault which have occupied much of the court’s recent time. At Monday’s ,session, Daniel Toomer of West End, pleading not guilty to felonious assault, disturbing the peace, etc., was found guilty of assault and bat tery on a female, and threats of violence (with shotgun). He re ceived a 60-day road sentence suspended for 12 months on pay ment of $10 and costs, placed on strict good-behavior conditions and ordered to stay away from his sister-in-law’s home for the next six months. Nol pros with leave on payment of costs was taken for Clinton Williams of Robbins, Route 1, on request of his wife the prosecu ting witness, who had indicted him for public drunkenness, as sault and battery on her and ma licious destruction of property. The case of Rowland C. Bass of Vass, pleading not guilty to assault with deadly weapon, was continued to next Monday, with subpoena ordered to issue for the prosecuting witness, Elton Bass.
