two-week civil term of Moore
County Superior Court.

Suits Filed On
Alleged Cut-Off
Of Stream. Water
Two suits have been filed in
Moore County Superior Court
against Sandhills Properties, Inc.,
developers of the Whispering
Pines, for alleged cutting off the
waters of Wateree Branch by
damming them up to create a
new lake.
In identical suits, C. S. Bibey
and Harvey Wilson, owners of
farmlands in McNeills Township,
each claims his crop has been
damaged already this year to the
extent of $3,500. Seeking recov
ery of this amount, each farmer
also asks to have Sandhills Pro
perties restrained and enjoined
from continuing the impound
ment of the stream.
The plaintiffs state that Water-
ee Branch, running through their
property, has been a source of
water for irrigation and other
uses over the years until this
year. They state the dam erected
by the defendant has effectively
cut off all the water of the small
stream, with no overflow, in vi
olation of their legal riparian
rights.
A survey was ordered in the
boundary dispute case W. V.
