Page TWENTY-FOUR THE PILOT—Southern Pines, North Carolina THURSDAY, MAY 7, 1964 MOORE COUNTY RECORDER'S COURT Young Speeders, Caught Driving 75 Side By Side, Lose Their Licenses Rites Conducted For Mr. Johnson Sunrise Theatre Two young Carthage men, Al vin Underwood Fry, 19, and Har old Layne Badgett, 23, pleaded not guilty at Carthage Monday, in Moore County Recorders Court, to speeding 75 in a 60-mile zone. Instead, they tendered a plea of guilty to speeding 70, but were found guilty as charged. Constable L. F. Wood of Green wood Township testified he first noticed the pair on the highway at Cameron because of their high speed, and because they were driving one directly behind the other—“bumper to bumper,” the officer said. Before getting them stopped, he said, he clocked them at speeds higher than 75. Though they were running side by side at this time, he did not charge them with racing on the highway. It was the second speeding charge of the day for defendant Fry, who had earlier pleaded guilty to 70 in a 55-mile zone, drawing a fine of $20 and costs. Defense counsel, speaking up for both youths said Fry knew he could not avoid license suspen sion and was prepared to take his punishment, but he put up a special plea for young Badgett. The defense attorney, W. D. Sab- iston, said the youth made his liv ing driving a truck, also that his wife was to have a baby in June. He asked that judgment be con tinued for Badgett util after the baby’s birth, so that he could take his wife to the hospital and drive back and forth at that time as needed. Judge J. Vance Rowe, however, continued prayer for judgment for both youths on payment of $25 fine and costs, each, leaving the law regarding their license suspensions to operate as it was designed to do. Traffic law violations and fam ily troubles predominated on Monday’s docket. Other cases disposed of: Howard Franklin Moore, Rob bins, Rt. 2, speeding 65 in a 55- mile zone, $10 and costs; Willie Thomas Welch, Robbins, Rt. 1, speeding 45 in 35-mile zone, $10 and costs; Felly Webster Hussey, Robbins, careless and reckless driving, accident and personal in jury, $25 and costs, defendant to pay or cause to be paid damage and injury resulting from wreck; Nelson Randolph Wooten, Carth age, driving without license (3rd offense), and without chauffeur’s license, presenting another’s li cense as his own, 30 days to be served at expiration of 6-months sentence suspended April 13, commitaent now ordered to is sue; Terry Alton Marsh, West End, allowing unlicensed person to operate his auto, and allowing him to use his license, 30 days sus pended for six months on pay ment of $25 and costs, to commit no sim.ilar offense in the suspen sion period. Harold David Blake, Box 53, Lakeview, speeding 65 in 55-mile zone, $10 and costs; Alexander Jones, Durham, speeding 70 in 55-mile zone, $20 and costs; Ger ry Nelson Frye, Pinehurst, speed ing 70 in 55-mile zone, $20 and costs; Louis McLaughlin, South ern Pines, non-support of three children, abandonment of wife and children six months suspend ed on payment of costs, defendant to return to his wife and children and support them to the best of his ability, or $25 and costs, $50 to be paid to his wife, then $30 weekly toward her support and that of the children till further order of the court. Russell Van Criscoe, Seagrove, Route 1, speeding 70 in 55-mile zone, $20 and costs; Hugh Bryant Morgan, Carthage, assault with deadly weapon on female (two counts), both defendant and wife Samuel Turner Johnson, 73, of Carthage, Route 2, died Friday. :Funeral services were held Sunday at Union Presbyterian Church. The Rev. H. L. Wilson, pastor, assisted by the Rev. Ben nie Maness 'and the Rev. Bill Shelton, officiated. Burial was in the church cemetery. Surviving are his wife, the former Bertie Mae Williams; one daughter, Mrs. Hazel Nall of Car thage, Rt. 2; one son, W. Frank Johnson of Durham; one step daughter, Mrs. Frances Williams of Manly; and 16 grandchildren. He was the owner and operator of Johnson Tobacco Stick Fac tory. Bone Black Pal $14.99 W. J.
