pun LIC ACTS.
1. An Act making appropriation for
carrying on and completing Ihe Capitol
in die City of Raleigh. Appropriates for
this purpose the sum of 75,000.
2. To crct a new con my, by the name
of Yancey. Provides that said coiitiiv
shall bo erected out of a portion of the
counties of Burke and Buncombe.
3. Declaratory of the law in relation to
the rights and duties of Sheriffs and In
spectors, in holding elections. Gives tu
Inspectors the sole and exclusive right to
judire of the qualifications of voters, ex
cept where there is an equal division of
opinion between the Inspectors, in which
cuse I lie Sheriff shall decide.
4. To amend an Act passed in 1782,
giving Equity jurisdiction to the Superior
Courts. Provides that the Sheriff' or
oth.T officer executing any process from
a Court of Equity, against ihe body, shall
take bond and two sufficient securieties
in double the sum for which the defend
ant is arrested, or subject themselves as
epi'i ial bail.
5. To extern! the time for registering
G ants, mesne Conveyances, Powers of
Attorney, Bills of Sale and Deeds of
gift. Extends the time two years from
the passage of this net.
G. Con-'ruiui; Official and other Pub
lic bonds. Provides that they shall here
after le made payable to the Slate of
No' tii Carolina.
7. To extend the provisions of an act
passed at the last session, authorizing
lh' removal of buildings on public lands
in the town of Franklin. Extends the
provisions of the above recited act to all
persons who have built on the public
lands therein mentioned.
8. To repeal an Act passed in 1788,
fixing the sum hereafter to be paid to the
State for vacant lands. Reduces the
entry money to 5 cents jrui acre, where
the number of acres entered by any one
person, in any one year, does not exceed
100; if this number of acres be exceed
ed, 10 cents per ucre is to be paid on the
excess.
9. To give further time for paying in
Entry money. Allows until the first of
March for t his purpose.
10. Directing the manner in which
Constables shall be appointed in this
State. Provides that hereafter, there
shall not be a greater number of Consta
bles in the Stale, than one for each Cap
tain's district, except in those districts
including the county towns, which shall
be entitled to two Constables, to be elec
ted by the inhabitants of such districts,
under the same regulations as are pre
scribed for Indding elections for Mem
bers of the House of Commons. The?
election to be held at anytime within one
month preceding the first County Court,
in each county, after the first of January
in each and every year. Inspectors to be
appointed by the Captains of Companies,
in each district, who arc to make return
to the first County Court, the Justices of
which shall qualify and take bonds from
the Constables returned as elected. No
person to vote fur a Constable in any
town or district, unless the voter lives in
such town or district.
11. Granting to Asa Pclozier atul
Henry Reagan, under certain conditions,
two tracts of land. Grants the land in;
consideration of f heir muKing known the
locality of the Silver Mine on the public
lauds of this State, which they allege to
have discovered.
12. Supplemental to an art passed at
the present session, to erect a new coun
ty by the name of Yancey. Appoints
Commissioners to determine upon a site
for the county town, to be known by the
name of " Burnsville;" and makes provi
sion for holding the Courts of said coun
ty and eleciing county officers.
13. Supplemental to an act passed in
1832, to enact with sundry alterations
and additions, an act to incorporate the
Portsmouth and Roanoke Rail Road!
Company, passed by the Legislature of
Virginia, on the 8th day of May, 1832.
Authorizes the Company to subscribe a
sum not exceeding 830,000, to construct
a Rail Road on the Wcldon toll bridge.
14. Directing the sale of lands remain
ing unsold acquired by treaty from the
Cherokee Indians. Authorizes the Gov
ernor to appoint a Commissioner to su
perintend the sale of the lands.
15. To establish the Merchant's Bank
in the town of Newbern, and ihe Albe
marle Bank in the, town of Edenton.
(Provides that these two Banks shall In;
established, the first with a capital of
250,000 the last, a capital of 200,000.
They are to have no branches. A tax of
25 cents on each share is to be paid into
the Slate Treasury.)
16. To establish a Bank in the State of
North Carolina. (Provides that the capi
tal of the Bank shall be 1 ,500,000, two
fifths of which, the State is tu have the
privilege of subscribing. The Principal
Bank lo be located at Raleigh, and to be
controlled by ten directors, of which
number the Slate is to appoint four.
Branches to be established whereve'rVit
may be deemed Advisable. A tax of 25
cents on each share, lo be paid into the
State Treasury.)
17. Supplemental to an act directing
how persons injured by the erection of
public mills shall proceed to recover da
mages, passed in 1809. (Prescribes the
manner in which notice shall be served
on the owners of mills, when an action
for damages is instituted.)
18. To prevent the throwing of ballast,
or otherwise obstructing the channel be
tween Bogue Inlet and the town of
Swansborough, in Onslow county. (Im
poses a penalty of $50 for every violation
of this act.)
19. For revising and digesting the
Public Statute Laws of this State. (Au
thorizes the Governor lo appoint three
Commissioners to collect, digest and re
vise all ihe Public Statute laws of the
State now in force, who shall, from time
to time, lay before the Legislature the
Acts so arranged and revised, to be ap
proved by them before they are publish
ed. Allows the Commissioners two
years to complete the work and gives
them a compensation of 81,000
each.)
20. To repeal in part an act laying du
ties on sales at Auction of merchandize.
(Repeals the section which makes it the
duly of Auctioneers to render a detailed
return of each article sold, permitting
them to exhibit the gross amount.)
21. To prevent injury to the naviga
lion of Cape Fear River, and for other
purposes. (No person to throw ballast in
said river, within seven miles of Wil
mington, under pain of fine and impris
onment.) 22. To prevent the conveying of slaves
out of this State, and to prevent -injury
being done to live stock upon RaiPRoads.
(Punishes with death any agent, mana
ger, &c. of any Rail Road Company,
who may carry off any slave with intent
to aid in their escape. Also provides
that the owners of slock killed on Rail
Roads, shall be compensated.)
23. To authorise the Clerks of Courts
of Record in this Stale, and those hold
ing the office of Clerk and Master in E
quity, to act as Notaries Public.
24. To amend an act passed at Inst
session, to repeal an act passed in 1830,
repealing part of the second section of
an act passed in 180G, to revise the mili
tia laws of this State. (Allows Quakers
and others averse to bearing arms from
religious scruples, to make oath to that
effect before any Justice of the Peace,
instead of before a Company Court Mar
tial, as now required.)
25. Authorising the Public Treasurer
to sell certain landsv in the vicinity of
Raleigh. (Directs him lo sell at public
sale, without reserve, the Bushy Branch
tract, late the properly of Treasurer
Haywood.)
26. To re-charier the Bank of Cape
Fear. (The capital to consist of 800,000
dollars, with authority to establish bran
ches, wherever deemed proper. A lax
of 25 cents on each share) ,
27. Supplemental to the act to estab
lish a Bank of the State of North Caro
lina. (Authorises the Governor, Secreta
ry of State and Comptroller to appoint
Directors on the part of the State, until
otherwise ordered.)
29. To regulate the times of holding
the Superior Courts in the 6th Judicial
Circuit. (1 lie Courts to begin at Cabar
rus and end with Iredell.)
30. More effectually to prohibit the
trading with slaves. (Adds to the prohi
bited articles mutton, cloth, corn, wear
ing apparel and bullion.)
31. To amend the law in relation to
Larceny. (Makes grand larceny infa
mous.) 32. To enforce the penalty incurred
by Entry-takers failing to make annual
returns of entries made in their respec
tive offices as required by law.
