The next important case in which he figured was in the Pitt County l courts, where he was tried on a first- ilegree murder charge for the killing ot David Crandall at the Tom Shep pard mill. At the first trial he was convicted and sentenced to be hung, but appealed to the supreme court and Was granted a new trial. He re ceived a sentence of 30 years in the penitentiary' at the second trial. While serving this term he did railroad work and helped to build the Plymouth bianch' of the Atlantic Coast Line. ! He obtained a pardon after serving i or 8 years of his term in a rather novel, yet very treacherous and dis-| graceful way, according to his own story in after years.
